Monday, December 17, 1973 at the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, ROLL CALL PRESENT: ABSENT: ALSO PRESENT: APPROVAL OF MINUTES Councilmen Heinsheimer, Pearson, Mayor Bear Councilman Battaglia joined the meeting at 7:45 P.M, Councilman Hesse Teena Clifton William Kinley Marion Welch June Cunningham Dr. Alex Palandech Cliff Bundy. City Manager City Attorney City Treasurer Secretary Assistant Principal Miraleste High School Resident A motion to approve the minutes of the meeting of December 3, 1973 as presented was made by Councilman Heinsheimer, seconded by Councilman Pearson and carried by the following roll call vote: AYES: Councilmen NOES: None ABSENT: Councilmen CITY COUNCIL REPORTS RIDING RING AT CITY PARK Heinsheimer, Pearson, Mayor Bear Battaglia, Hesse The Manager reported that the maps had been sent to the Regional Planning Commission and the Planning Advisor's Report would be submitted to the Planning Commission. PUBLIC UTILITIES COMMISSION The matter was ordered held on the agenda, ITEMS HELD OVER PUBLIC EMPLOYEES' RETIREMENT SYSTEM CONTRACT 786 Mrs, Clifton presented correspondence dated December 11, 1973 from the_ ­Public Employees' Retirement System acknowledging receipt of the Council's Resolution of Intention to participate in the Public Employees' Retirement System, and enclosing copies of the contract to be executed with the ordinance approving the contract. Mayor Bear ordered the matter held on the agenda for adoption twenty days after adoption of the Resolution of Intention which was adopted on December 3, 1973, ROLLING HILLS TENNIS CLUB REPORT 790 A letter dated December 13, 1973 from the Rolling Hills Tennis Club reporting on the meeting of the Executive Committee of the Tennis Club on December 10th was presented to the City Council by Cliff Bundy, president of the Tennis Club. -1 1 December 17, 1.973 Following review of the letter, Mayor Bear ordered the matter held on the agenda for further discussion at the meeting of the Council on January 14, 1974 when the moratorium on tennis court lights will be reviewed. He requested that the City Manager contact the City of Los Angeles and the County of Los Angeles and inquire about hours of oper- ation of their tennis courts.. EMERGENCY DISASTER PLAN 1352 _.. '.. Mrs. Clifton reported that the Simulated Emergency Drill was held in Rolling Hills on Friday, December 14, 1973 as scheduled and was con- sidered by the Committee to be.a success as far as response of the residents was concerned. During the drill approximately 320 telephone calls were received from residents. The Manager said that reports on the exercise were being prepared by the Fire Department and Sheriffs Department personnel, and the drill would be evaluated further after receipt of the reports and placed on the City Council agenda. CITY OF RANCHO PALOS V'ERDES. PROPOSED TENTATIVE TRACT 32046 1425 The Manager reported that she had discussed the matter of the proposed tract with Mayor Marilyn Rayan of the City of Rancho Palos -Verdes, and Mayor Ryan said she had not seen the map. A letter was sent to Rancho Palos Verdes and to Regional Planning, expressing the opposition of the City of Rolling Hills to the proposed development. NEW BUSINESS LETTER FROM A. Lo PALANDECH, MIRALESTE HIGH SCHOOL 1021 . Mayor Bear presented a copy of a letter dated December 5, 1973 from Dr. A. La Palandech, Assistant Principal of Miraleste High School complaining that lack of a leash law in the City of Rolling Hills is creating a serious problem on the high school campus. Dr. Palandech addressed the Council and advised that a similar letter had been sent to Mayor Marilyn Ryan of the City of Rancho Palos Verdes. In the discussion that followed Councilman Battaglia requested that the City Attorney provide sample leash laws for consideration at the next meeting of the Council. Because of the problems caused by wandering dogs, and since the complaint was made to the City of Rancho Palos Verdes in which the school is located, the City Attorney recom- mended that the Council discuss the matter with a representative of the School Board when the City Council meets with them in January as re- quested by Councilman Battaglia, and with representatives of the other cities on the Peninsula. FINANCIAL STATEMENTS 971 A motion to approve the Report of the City Treasurer for the month of November 1973 and the Statement of Receipts and Disbursements dated November 30, 1973 as presented was made by Councilman Heinsheimer, seconded by Councilman Pearson and carried by the following roll—call vote: AYES: Councilmen Battaglia, Heinsheimer, Pearson Mayor Bear NOES: None ABSENT: Councilman Hesse -2- December 17, 1973 PAYMENT OF BILLS 97.5 A motion to approve payment of Demands No. 3114 through 3138 was made by Councilman Heinsheimer, seconded by Councilman Pearson and carried by the°following roll call vote: AYES: Councilmen Mayor Bear NOES: None " ABSENT: Councilman CITY ATTORNEY ORDINANCE NO, 120 Battaglia, Heinsheimer, Pearson Hesse 453 Councilman Heinsheimer moved that Ordinance No. 120 entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS, CALIFORNIA AMENDING ORDI- NANCE NO, 115 WHICH AMENDED ORDINANCE NO. 67 ENTITLED "AN ORDINANCE OF THE CITY OF ROLLING HILLS, CALIFORNIA, REGULATING AND CONTROLLING THE DESIGN AND IMPROVEMENT OF SUBDIVISIONS AND OTHER DIVISIONS OF PROPERTY" be adopted, and that reading in full be waived. The motion was seconded by Councilman Battaglia and carried by the following roll call vote: AYES: Councilmen Mayor Bear NOES: None ABSENT: Councilman Battaglia, Heinsheimer, Pearson Hesse PROPOSED ORDINANCE PROVIDING FOR ZONING 465 The City Attorney presented a copy of a proposed ordinance amend- ing Ordinance No. 33 Providing for Zoning and advised the Council that the proposed ordinance, prepared at the request of the Planning Com- mission, is not in conformance with the Declaration of Restrictions of the Rolling Hills Community Association in defining gross areas, espe- cially in the Eastfield area. However, Mr. Kinley said the City is - not obligated to follow the Declaration of Restrictions, but the orig- inal zoning ordinance was put together on the basis that it would follow the Declaration. Following discussion of the proposed ordinance, Councilman Pear- son moved that in Section 3.02, Lot Area, the sentence "The required net area in she RA -S 2 zone shall be 80,000 square feet" be stricken from the ordinance, that the ordinance be adopted, and that reading in full be waived. The motion was seconded by Councilman Battaglia. Councilman Heinsheimer said he felt the Council was whittling away at the ordinance, and questioned whether the Council's goal was to develop better building sites or limit the number of lots in a subdivision. The City Attorney said the number of lots in a subdivision would be deter- mined because everyone would be required to comply with "net area" as defined by the proposed ordinance. Councilman Pearson suggested that "net area" for the one acre zone should be "one acre net" rather than "40,000 square feet". Councilman Battaglia agreed that the more pres- sing problem exists in the one acre zone, since the few large properties in the City are currently being subdivided, and only small parcels in the one acre zone will remain eventually. Following the discussion Councilman Pearson amended his motion to defer discussion of the matter. Councilman Battaglia moved that the item be tabled until the first meeting in February, and reconsidered by the Council at that time. Battaglia, Heinsheimer, Pearson Mayor Bear NOES: None ABSENT: Councilman Hesse PROPOSED ORDINANCE - MOTORCYCLES 014 The City Attorney advised the Council that portions of the Traffic Ordinance No. 116 control use of motorcycles in Rolling Hills; however, if more stringent control is desired, a specific ordinance incorporating all the wishes of the Council could be prepared. Mayor Bear requested that the staff contact Mr, John Heater, 59 East- field Drive and ask him to call Mr. Kinley and discuss a motorcycle ordi- nance with him. t� PROPOSED ORDINANCE - HITCHHIKING 030 ,0 ,..� Councilman Battaglia moved that the subject be removed from the City Council agenda until after election of new Council members in March, 1974. The motion was seconded by Councilman Pearson and carried by,the following roll call vote: AYES: Councilmen Battaglia, Heinsheimer, Pearson Mayor Bear NOES: None ABSENT: Councilman Hesse CITY DEPARTMENTS SHERIFF'S DEPARTMENT REPORT 035 I The report of the Sheriff's Department for the month of August 1973 was presented to the Council. The report was received and filed. FIRE DEPARTMENT REPORT [IT -101 The report of the Fire Department dated September 1973 and the report dated October 1973 were presented to the Council. The reports were received and filed. MATTERS FROM MEMBERS OF THE COUNCIL PLANNING COMMISSION APPOINTMENT 095 Councilman Pearson reminded the Council that Ordinance No.1113 adopted January 8, 1973 provides for reappointment` of Planning Com- mission Chairman and members to fill any vacancies, and that Chairman Godfrey Pernell had teen appointed for one year in January,1973 and Mr.. Sidney Morse had resigned from the Commission, Mayor Bear moved that Chairman Pernell be reappointed for a term of three years, and that Mrs. Carol Hanscom, 12 Williamsburg Lane, be appointed to fill Commissioner Morse's •unexpired term, The motion was seconded.by Councilman Heinsheimer and carried by the following roll call vote: AYES : NOES: ABSENT: Councilmen Battaglia, Mayor Bear None Councilman Hesse -4- Heinsheimer, Pearson December 17, 1973 STATE OF CALIFORNIA,, GOVERNOR'S O'FFICE 110 Mayor Bear presented a copy of a letter from the Governor of Cali- fornia asking for the name -of a young member of the Community under age 19 who might be eligible for the 1972 Young American Medals for Bravery and Service to be submitted by January 1, 19740 The Mayor requested that a copy of the letter be given to Mrs. Joan Saffo for her recommendation. ADJOURNMENT 172 There being no further business to come before the meeting, a motion for adjournment was made at 10:35 P.M. by Councilman Pearson, seconded by Councilman Heinsheimer and carried unanimously.
