A regular meeting of the City Council was called to order by Mayor
Battaglia at 7:30 P.M. Monday, April. 22, 1974 at the Administration Build-
ing, 2 Porthuguese Bend Road., Rolling Hills, California.

WEED ABATEMENT 665
The Mayor opened a discussion of a proposed ordinance developed by
Councilman Crocker. The proposed ordinance would adopt the Uniform Fire:
Code of the County of Los Angeles, and would require clearing of improv®tl
and unimproved properties.
The following residents spoke in support of the proposed ordinancol.'
Mr. Kenneth Watts, 1 Wrangler Road; Mr. John Stern, 29 Crest Road East.
Mr. F.:S. Hummel, 7 Chesterfield, advised the Council that at the meet-
ing of April 8, 1974 he had expressed opposition to the proposed ordi-'
nance, which he said would constitute "overkill"; he wished to advise
the Council that after reviewing the proposed ordinance he found it tot..,;,
be reasonable, and said he had no objection, and felt it should be
passed., A letter from Mr. and Mrs. Gordon Potter, 7 Outrider Road, in
support of.the ordinance was read into the record.

,..{ Mrs. Velma Matthews, 11 Cinchring Road, said she was opposed to
the ordinance, since it would be impossible to clear slope areas. Dr.
wi James Roberts, 15 Portuguese Bend Road, said he objected to the "emer-
gency", and questioned whether the City needs another ordinance. Mayor. -
Battaglia read comments from Mr. A. E. Esser, 71 Crest Road East and
Mr. William Stringfellow, 85 Crest Road East, expressing concern about
erosion into the record of the hearing. Mayor Battaglia thereafter
closed the Public Hearing.
In the discussion that followed certain additions, deletions and
changes were incorporated in the proposed ordinance, and the City..Attor-
ney was directed to amend the proposed ordinance. Councilman Crocker
moved that the ordinance be�adopted as amended, and the motion was
seconded by C6unc�ilman Heinsheimer.
Councilman Heinsheimer moved that the last word in line 30, page 39
the entire line 31 and the first three words in line 32 be deleted..The:
motion was seconded by Mayor Battaglia and carried by the following
roll call`. vote :

Mayor Battaglia asked the City Attorney to read the entire ordi
nance as amended, Ordinance U-34, and following reading of the ordinance

MOTOROLA ALERT MONITOR RECEIVER 1501
Dr. Martin Gould, 7 Williamsburg Lane, Co-chairman of the Disaster
Pla.tin- ng Committee advised that the Motorola Alert Monitor Receivers
hada eeYi on test for three days, and the results were satisfactory.
Units had been placed at each gate house, with periodic testing by the
guards on duty. Test procedures were written by Mr. Robert McDonald,
Chief Security Officer, and Dr. Gould presented test result sheets for
Council review. It was Dr. Gould's recommendation that the Council go
forward with acceptance of the equipment and authorize payment.

Councilman Heinsheimer requested that the Council authorize him ,
and Councilman Crocker to review the final test results prior to
authorizing payment for the equipment, which have been included in..
the budget,.

to discuss the Engineering plans of the 1970 Flood Control Bond Issue
and had:established priorities as follows: 1) Line B on Middleridge
Lane'South proceeding to theintersection of Middleridge Lanes North
and South and Middleridge road: 2) Line C in the Pheasant Lane area
of Portuguese Bend Road, and 3) Line D, the extension of an existing
line of the 1964 Flood Control Bond Issue project near the bend of
Poppytrail Road.

GASOLINE` ALLOCATION 1640
Councilwoman Le Conte presented a letter dated April 12, 194.
from the City of Lawndale advising that the Federal Energy Office on
April"11;:.1974 approved application for assignment of the Los Angeles
-County Consolidated Fire Protec tion'District as permanent supplier..of
gasoline to cities which had been receiving gasoline from that source.
Further, Councilwoman Le Conte said she had been advised that suffi-
cient gasoline is -available to meet the demands of the cities.
COSY HEALTH SERVICE FUNDING ON ALCOHOLISM 1647
Councilwoman Le Conte presented a resolution adopted by the City
of Hermosa Beach requesting county health service funding on alcohol-
ism be -extended to the South Bay; and recommended that a similar reso-
lution be adopted by the City of Rolling Hills.

would enable Mr. Dunn's engineer to do "as built" grading drawings,

will not -be available until the drawings have been completed; final

Mrs.*Clifton reported that the Environmental Impact Report on the
Rolling' -Hills Fashion Center prepared by the City of Rolling Hills Es-
tates was in the office for review by members of the Council. Council-

prepared by the City of Rancho Palos Verdes be obtained for reference.

A letter dated April 9, 1974 from Ken Miller, Mayor of Torrance
was presented.to the Council.
Mayor Miller advised that the Southern California Rapid Transit
District would present their Phase III report at a public hearing in
Torrance'on Wednesday, April 24, 1974 at 7:30 P.M.

REGIONAL PLANNING COMMISSION 60
Notice of a Public Hearing before the Board of Supervisors on
proposed amendments to the ordinance regarding keeping of horses and
other equine in County area was presented to the Council for informa-
tion. The notice was received and filed.
HORSE SHOW, ST.JOHN FISHER SCHOOL. 69
Notice of a horse show to be held at the Empty Saddle Club on
May 19, 1974 for the benefit of St. .John Fisher School was presented

CITY ATTORNEY
CALIFORNIA CONTRACT CITIES ASSOCIATION 97
The City Attorney said he had nothing new to report on the suit
between the City of Los Angeles and the County of Los Angeles, Superior
Court Case No. C-76041. Although the City of Rolling Hills is a named
defendant, the City has not yet been served.
CITY OF BALDWIN PARK - SALES TAX LITIGATION 99
Mr. Kinley said he had talked with the City of Baldwin Park about
'their proposed 'litigation against the State of California to declare
the Sales Tax Act unconstitutional, and he was advised that a firm
figure not to exceed $30,000 has been arrived at for attorneys' fees
an:d court costs to take the matter through the trial court and to a_-,:.
final disposition in a court of appeal, and with the assistance of`
cities to be named plaintiffs in the litigation, the cost should be
about 3(,% per capita. The Mayor ordered the -matter held on the agenda.
CONFLICT OF INTEREST AND DISCLOSURE OF ASSETS ACTS 106
The City Attorney presented a proposed resolution prepared at the
request of the Council regarding conflict of interest.
In the discussion that followed Councilman Rose suggested that.
"public" official be changed to "City" official. Mr. Richard Scheide,
29 Chuckwagon Road, asked whether the City Attorney would be included,
and was advised that the City Attorney and City Manager would be in-
c -luded in the requirements set forth in the resolution.
RECESS
Mayor Battaglia called a five minute recess at 10:35 P.M. for
Councilwoman Le Conte 'to review the penalty section of the Government
Code. The meeting was reconvened at 10:40 P.M,
RESOLUTION NO. 312
Councilman Rose moved that Resolution No. 312, entitled A
'RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA
REGARDING CONFLICT OF INTEREST be adopted, and that reading in full be
waived.
The motion was seconded by Councilman. Crocker and carried by the
following roll call vote:

ORDINANCE NO, 122 170
Councilman Crocker said his committee plans to have another meet-
ing to consider the ordinance which amends Ordinance No. 116 with
respect to operation of motorcycles in the City, and a public hearing
can be scheduled after that date. Mayor Battaglia said that two public
hearings have already been held on the matter, and it may not be neces-
sary to have an additional public hearing.
Councilman Crocker urged members of the Council to convey their
comments on the proposed ordinance to him, and Mayor Battaglia ordered
the matter held on, the agenda for further discussion at the next meet-
ing of the Council.
CITY .DEPARTMENTS
SHERIFF'S REPORT' 230
Councilman Crocker suggested that the Sheriff be asked to enforce
the existing ordinances regarding motorcycles during the next month to
determine whether the ordinances in existence or th.e ordinances under
consideration can be effectively enforced. Mayor Battaglia said the
matter. will be discussed with the Sheriff's Department representative
at the next meeting. Further, Mayor Battaglia asked Councilman Heins-
heimer to report at the next meeting on the cost, feasibility and ad-
visability of forming a traffic monitoring and traffic safety system
within the City of Rolling Hills, separate from the Sheriff's Depart-
ment and apart from the joint police force for the entire Peninsula
now under consideration and discussion.
MATTERS FROM THE COUNCIL
CATCH BASIN ON CREST ROAD
Councilman Rose said there is a catch basin in the vicinity of
35 Crest Road West that does not effectively carry off rain water and
as a result there is a mosquito breeding problem in the area. The
Manager said she would have the Health Department check for the mos-
quitoes immediately. Further. she said she was aware of the problem
of the undersized drain, and has two estimates for installation of a
new catch basin an.d' drainagd pipe for i stallation, before next winter
to be included in the budget of the Rolling Hills Community Association.
FENCE IN EASEMENT - CREST ROAD EAST
Councilwoman Le Conte asked on. whose authorization the fence was
installed in the easement on. Crest Road East. Mayor Battaglia ex-
plained that the Board of Directors of the -'Rolling'H:ills Community
Association. had directed that the fence be installed on the recommend-
ation of the Caballeros, following a serious horse accident in the
area. Councilwoman Le Conte said it was her opinion the City Council
should have been advised of the matter'. since it was also a problem
of traffic safety.
