The Mayor asked that an appropriate Resolution of Appreciation be prepared for .presentation to Mr. Marion Welch, who served the City as Treasurer for ..many years. ,-APPROVAL OF MINUTES A motion to approve the minutes of the meeting of April 22, 1974 as corrected was made by Councilman Crocker, seconded by Councilman Heinsheimer and carried by the following roll call vote: AYES: Councilmen Crocker, Heinsheimer, Le Conte, Rose, Mayor Battaglia NOES: None ABSENT: None May 13, 1974 ,CITY COUNCIL REPORTS -MEETING WITH MAYORS OF PENINSULA CITIES 25 .Mayor.Battaglia announced that an informal meeting wa.s.,re.cently held' in' the Rolling Hills; Administration Building, attended, by ­t -he, -..-,*a or;,,,,, and one Councilman -from each of the Peninsula: cities,.. -.Mayor., pip, L , attended with Mayor Battaglia. _4 Many subjects of mutual interest were discussed, including join't'­! police protection for the Peninsula; traffic arrestor beds near the in- tersection of Palos Verdes Drive North and Hawthorne Boulevard, proposed by the City of Rolling Hills Estates,, and the Paramedic program. Another meeting will be held in approximately six weeks, and Mayor Battaglia said he would continue to advise the Council on, the progress of the meetings. The next meeting will be held at the new City Hall in Rolling Hills Es- tates, and meetings will rotate within the cities. MOTORCYCLES WX Mayor Battaglia asked Councilman Crocker to report on the pro- posed ordinance regarding operation of motorcycles in Rolling Hills. Councilman Crocker said members of the motorcycle committee had met with representatives of the Sheriff's Department and interested residents. The conclusion of the committee, after considering the exist- ing traffic ordinance and the proposed ordinance, was that the provisions in the traffic ordinance regarding motorcycles, if strictly enforced, would be sufficient. Councilman Crocker said he wished to request and recommend that the Sheriff's Department be instructed to issue citations for violations of the ordinance, and that no warning tickets be given, since the warning was contained in information sent to all residents in a recent newsletter. I I Councilman Crocker moved that the motorcycle provisions as contained in Traffic Ordinance No. 116 be strictly enforced, and that the Sheriff's Department be requested to strictly enforce the provisions of the Ordinance. The motion was seconded by Councilman Rose. Councilman Heinsheimer amended Councilman Crocker's motion to I state that provisions of the motion as made remain in effect for a three month trial period, and if it is not effective in that time, more strin- gent measures be,considered, and additional legislation be adopted. The amendment to the motion was seconded by Councilwoman Le Conte. Roger Johnson, Lennox Sheriff's Department, to speak to the Council on the matter, especially on the request that the Sheriff strictly 'enforce the existing ordinance without first issuing warnings. -2- May 13, 1974 n.. Sgt. Johnson advised the Council that it is impossible for a Sheriff's patrol car to follow a motorcycle onto a horse trail, which is where most motorcyclists go when the Sheriff attempts to stop them. Further, he explained that the Sheriff cannot issue a citation. for an incident which he did not observe, therefore cannot act on repeated complaints of residents unless he observes the violation and catches the violator. If the officer does not observe the violation, a resident can call the station and make a complaint, an officer will come to the home and fill out a complaint report which goes to the court for a .f.ormal complaint, in which the complaining party must then go down and .sign a formal complaint before the District Attorney against the offend- ing party, and appear again when the case is called to trial, when the complaining party must appear as a witness. Sgt. Johnson said the pro- cedure is time consuming for citizens. Another method is the citizen's arrest, in which the violator t` is apprehended by a citizen and held until an officer arrives, at which JO time the officer is asked to take the violator into custody for a par - r__4 ticular violation. After being taken to the station. and booked, the ID offender is released on bail, or cited at the station for an appearance Qin court. The complaining party is required to go to court and file the complaint and appear as a witness. These are alternatives avail- able when a deputy sheriff is not present to witness a violation. Councilman Heinsheimer asked Sgt. Johnson to comment on issuing a warning rather than a citation. Sgt. Johnson said there is no set policy, and the matter is left to the descretion of the arresting officer, based on what he has observed, and he considers it impossible to set a policy that every motorcyclist stopped will be cited, since the Sheriff's department can not determine in advance what violations will occur in the street. Councilman Crocker asked Sgt.. Johnson whether the Sheriff would cite every violator rather than issue a warning, and Sgt. Johnson said that every violator observed committing a violation of the ordinance would be cited if caught, if the Council so wishes. Councilman Crocker said he wished to have the Community warned in the Newsletter, and subsequent violators cited. Sgt. Johnson said the difficulty is in being able to catch the violator after observing the violation. Coun- cilwoman Le Conte asked whether a picture of a violation could be used as evidence, and Sgt. Johnson said a picture could be used as a basis for a complaint if the person filing the complaint could identify the motorcycle and the operator. Councilman Rose said he felt more emphasis should be put on, the problem of noise, and Councilman Crocker said an attempt had been made to regulate the decibel rating, but it was determined that it would be possible for an operator to pass a test, then remove the silencer and operate a motorcycle in violation of approved noise levels. Further, Councilman Crocker said he had been advised that the Sheriff issues citations on the basis of disturbance by excessive noise, and it is Councilman Crocker's opinion. that the penalties specified in the ordinance are strict enough for control; however, often the penalties are not imposed by the judges hearing the case. Councilman Heinsheimer said the proposed ordinance was an attempt to eliminate from the City the type of vehicle that causes problems because of use on the trails and excessive noise, and the Council thought it would be more enforceable since it dealt with the nature of the vehicle and would not require a complaint by residents regarding operation. Councilman Heinsheimer recommended that Council- man Crocker and his committee remain active and maintain liaison with the Sheriff for the.next three months, with a report to be made to the Council after that period of time. Mayor Battaglia so ordered. -3- 176 JOINT POLICE PROTECTION May 13, 1974 221 Mayor Battaglia invited Captain Kenneth Hays, Los Angeles County Sheriff's Department, Lennox Station, to speak to the Council on the subject of joint.police protection for cities on the Peninsula. Captain Hays presented copies of a chart of Contract Law Enr. forcemeat based on figures adopted by the Board of Supervisors for services at the present level and services at the proposed level. Captain Hays said that complete agreement had not been reached by the Peninsula cities either with or without the City of Lomita, and it is doubtful that such agreement will be reached before the start of the next fiscal year, July..1, 1974. If Lomita does not join with the Peninsula cities a satisfactory arrangement for law enforcement could be developed; however, Captain Hays said it probably would not be practical for any two of the Peninsula cities -to make a joint arrange- ment without the third city. The idea of regional law enforcement is basically a good one, Captain Hays said, but would have to be run to' the satisfaction of the cities Varticipating, rather than on ideas presented wholly by the Sheriff s Department. Captain Hays explained that the concept being considered is deployment of units on a regional basis, rather than to individual cities, which gives more flexibility for use of personnel and facilities, and has been very successful used out of the Lakewood Station and the Norwalk Station. The Peninsula lends itself ideally to the concept, Captain Hays said, but because of lack.of complete agreement at this time, it was his recommendation that the cities proceed on individual contract basis, at least at the begin- ning of the fiscal year. Mayor Battaglia advised the Council that atthe recent.meeting of the Mayors and representatives. -of the Councils 6f the other Penin- sula cities he had presented a charter for review outlining the goals of the sub -committee with regard to joint police protection, and had recommended that the Committee organize itself towards the submittal of an initial report to the Four Cities Committee in early August 1974. The Mayor thanked Captain. Hays for his presentation. to the Council and said he wished to have a workshop with the Sheriff's Department repre- sentatives and the Council working to develop a program of services that would be financially feasible. PAYMENT OF BILLS 385 A motion to approve Demands No. 3649 through 3653 and Nos. 3655 through 3680 in the amount of $13,742.72, and to disapprove Demand No. 3654 in the amount of $50.00 was made by Councilman Crocker, seconded by Councilwoman Le Conte and carried by the following roll call vote: AYES: Councilmen Crocker, Hein.sheimer, Le Conte, Rose Mayor Battaglia NOES: None ABSENT: None RECESS Mayor Battaglia recessed the meeting at 8:30 P.M. The meeting was reconvened at 8:35 P.M. ANTON B. WEBER, 53 PORTUGUESE BEND ROAD 436 A letter from Anton B. Weber, 53 Portuguese Bend Road, dated April 28, 1974 was presented to the Council. Mr. Weber requested that the requirements of Ordinance No. 117 adopted after the fire in June 1973 and requiring fire retardant roofing on all new construction and on additions -exceeding 25% of the residence be waived, and that he be permitted to use cedar shakes on a proposed addition to his home. SM May 13, 1974 Mr.'Weber advised the Council that he had stayed at his home and fought the fire and saved the residence, which has a shake roof, as many others who stayed to fight the fire did. He said that the residents who left their homes lost them. Mr. Weber said further that he has spent a large sum of money complying with County requirements f -or geological studies before his plans for expansion could be approved, and he said he has a life -time roof on his home which was installed 18 years ago and requested permission, to put a similar roof on the proposed addition, which has been approved by the Architectural Committee. Councilman Heinsheimer moved that the Council approve Mr. Weber's request and waive requirements for fire retardant roofing on the proposed addition to his home. The motion was seconded by Council- man Rose for purposes of discussion. and carried by the following roll call vote: C� AYES: Councilmen Le Conte, Heinsheimer, Mayor Battaglia NOES: Councilmen Crocker, Rose r"{ ABSENT: None Q TENTATIVE TRACT 29383, CLIFTON HIX The Manager presented copies of the Planning Advisor's Report dated November 13, 1973 and revised April 15, 1974, and the minutes of the Planning Commission on April 16, 1974 to the City Council. Mr. Roger Meurer, engineer for Mr. Hix, displayed an aerial photograph of the area, and on a colored map showed the proposed road improvement, the building pads and.the grading necessary to accomplish the proposed development. Further, Mr. Meurer explained that there is reluctance to open roads through the City, so the improvement of Buggy Whip to City standards will terminate in a cul de sac south of the northerly boundary of the subdivision, and an all weather road will be graded from the cul de sac to join with Middleridge Lane South for purposes of emergency access. Mr. Meurer explained that the property consists of twenty acres in the two acre zone, and is being divided into six parcels of approx- imately three acres each, and an additional parcel which will be given to the City for a riding ring. Mr. Meurer said it is his intention -to request a time extension to give the Council an opportunity to make.a field trip to the site. Mayor Battaglia asked the Manager whether the Environmental Impact Report on the tract had been prepared for presentation and .Mrs. Clifton said it had not been presented. Mayor Battaglia orderdd the matter held on the agenda until the report has been prepared for presentation, and asked the Manager to advise Mr. Meurer, who had left the meeting, that no further consideration will be given to any sub- division unless the Environmental Impact Report is presented to the Council with the Tentative Tract Map. MIRALESTE HIGH SCHOOL SUMMER SWIMMING SCHOOL PROGRAM 754 Mrs. Marion Ruth advised the Council that she was present to represent the Miraleste Swim Pool Foundation, and to request that the -C ty of Rolling Hills again sponsor the summer swimming pool program as they have in the past three years. Mayor Battaglia suggested that the City of Rancho Palos Verdes be contacted for sponsorship, since the school is located in that city. Mrs. Ruth said that when the City of Rolling Hills originally sponsored the program the school was in unincorporated territory, and it was the intention of the foundation to eventually ask Rancho Palos Verdes to sponsor the program; however, since the new City is inundated with other work at this time, the foundation would prefer Rolling Hills to -5- Ur May 13, 1974 handle the program this year on an hourly basis. Mrs. Ruth introduced Mr. Bruce Edson, treasurer of the pool foundation, and said that Randy Beardsley, Miraleste High School coach, will again handle the pool program. Mr. Edson said that last year the City received the sum of $750 for sponsoring the pool and taking care of details such as adminis- tering the payroll and printing information notices. This year printing of information will be taken care of by the foundation, and Mr. Edson suggested that the sum be reduced to $375 for payroll services for the year. Following discussion Mayor Battaglia advised Mrs. Ruth and Mr. Edson that a decision on the matter would be made at a personnel session to follow the regular meeting, and asked that Mrs. Ruth contact Mrs. Clifton the next orning for a decision. Councilwoman Le Conte asked that Mrs. Ruth be congratulated in the minutes of the City Council meeting for her work and leadership in establishing the pool and operating it for the benefit of the children of Rolling Hills. COUNCIL REPORTS WEED ABATEMENT 899 Councilman Crocker said he had been advised by Chief Schneider that the weed abatement inspection is progressing without problems, and there is cooperation among residents of the City in complying with Fire Department requirements. SENATE BILL 772, PARAMEDIC LEGISLATION 908 Councilman Rose said he had sent copies of Senate Bill 772 to members of the Council. He explained that the Bill specifies that Paramedics would be trained in a qualified program at a college, which would require a specified number of hours in training, and would work under an authorized hospital, and training would have to be up -dated every two years. Councilman Rose moved that the Ctiy Council endorse the legislation and so advise the State Legislature. The motion was seconded by Councilman Heinsheimer and carried by the following roll call vote: AYES: Councilmen Crocker, Mayor Battaglia NOES: None ABSENT: None MOTOROLA ALERT MONITOR RECEIVER 955 Heinsheimer, Le Conte, Rose Councilman Heinsheimer reported that had reviewed the report prepared following the test of the Motorola Alert Monitor Receiver units on April 19, 20 and 21st. The tests were considered successful by the Committee, and on that basis, Councilman Heinsheimer moved that the units be accepted and distributed to the area leaders, and that the bill be paid. Councilman Crocker seconded the motion for purposes of discussion. Following the discussion the motion failed on the following roll call vote: AYES: Councilman Heinsheimer, Mayor Battaglia NOES: Councilmen Crocker, Le Conte, Rose ABSENT: None ' JOINT POLICE PROTECTION - CITIES ON PALOS VERDES PENINSULA 1013 Councilman Heinsheimer reported that at a recent meeting of 1 1-7:9. May 13, 1974 re.presentatives of the cities on the Palos Verdes Peninsula a joint police force, separate and apart from the Los Angeles County Sheriff's Department was discussed, and an ad hoc committee was formed to study the proposal. Further reports will be made to the Council as the study continues, Councilman. Heinsheimer said. Representatives of three of the Peninsula cities are on the committee, and the City of Palos Verdes Estates, which has its own police department and has declined to join in the study, has offered to provide any information, that may be help- ful to the members of the Committee. Mayor Battaglia asked Coucilman Crocker to represent the City of Rolling Hills on the Committee. The matter was held on the agenda. TRAFFIC MONITORING AND TRAFFIC SAFETY SYSTEM 1052 Councilman Rose requested that absolute speed limits be posted in an effort to more effectively control speed in the City. Mayor Battaglia said that and other matters would be discussed with the 00 Sheriff at the workshop to be held with the Council. Q RAPID TRANSIT DISTRICT 1060 Councilwoman Le Conte reported that a long-range proposal has been presented to South Bay Councilmen's Association by the Rapid Transit District, and is being opposed by many cities in the South Bay Area. Those cities are asking other cities to oppose the 1% sales tax necessary to finance the Rapid Transit District: unless their needs are met. Mayor posal would be for additional RAPID TRANSIT DISTRICT - TRANSPORTATION NEEDS FRAMEWORK Battaglia said he had been advised that a revised pro - presented, and ordered the matter held on. the agenda information. 1118 Councilman Rose reported.on a transportation proposal devel- oped by Supervisor. Schabarum to meet present needs without a fixed rail system. To do this, use of private cars would be discouraged during peak rush hours, and special lighting devices would be installed at freeway entrances that would give priority access to buses and car pool cars. Buses would travel in counter -traffic lanes, and main traf- fic streets in the Los Angeles area would be changed to accommodate the counter traffic lanes handling buses and car pool cars. Council- man Rose said that in his opinion the system would not apply to the South Bay, nor would it solve the problem of the physically handicapped or elderly, since the new buses equipped to help those people would not be used for the proposed system. BALLOT PROPOSEITION NOo 9, .TUNE PRIMARY, ELECTION Mayor Battaglia ordered the matter held on, the agenda. 1" ff May 13, 1974 CITY MANAGER - ITEMS HELD OVER TENTATIVE TRACT 32071, ROBERT DUNN, 2 POPPYTRAIL The Manager presented a letter dated April 23, 1974 from Mr. L. Dene Langford, attorney for. Mr. Robert Dunn., 2 Poppytrail. Mr. Langford stated that the Council's stoppage of contr.uction at 2 Poppy - trail and the imposition of a 60 day moratorium on the building permit violate the right of Mr. Dunn, to the exercise of due process. Mr.. Kin.ley, City Attorney, advised the Council that procedures for stopping work are contained in the Building Code, and construction on a job, especially grading, can, be stopped under Section. 7000.4 of the Building Code. Further, the City Attorney advised that the. City Engineer and the geologist representing Mr. Dunn had advised the Council that the site was sound, and buttressing would solve the problem of slippage on Poppytrail Road. Mr. Kinley suggested that the City Engineer be asked to make a written report on. the matter to the Council. Councilman Crocker suggested that the matter be held on. the agenda for receipt of the report, and Mayor Battaglia so ordered. R.H.C.A, BOARD OF DIRECTORS 1.390 A letter dated May 2, 1974 from Joan, Saffo, President of the Board of Directors was presented to the Council. Mrs. Saffo said the Board of Directors had been advised by the Manager of the objections of the City Council regarding fence construc- tion on Crest Road East in the area of 12 Crest Road East. Mrs. Saffo requested the cooperation of the Council for a three month trial per- iod for the fence to remain, and also asked the City Council to make recommendations concerning the location of a horse trail crossing.prior to that time. Councilman Hein.sheimer said that the matter is one of traffic safety, and agreed that the City Council should cooperate for the three month period. Councilman Crocker said the solution should be arrived at by discussion with the Board, not confrontation., and suggested that a joint meeting between the Board and Council be scheduled. Mayor Battaglia agreed that such a meeting would be mutually beneficial, and ordered the matter held on the agenda. PUBLIC UTILITIES COMMISSION, APPLICATION NO. 54649 Mayor Battaglia ordered the notification of a bus far increase granted by the Public Utilities Commission to California Sightseeing Tours, Inc. for buses serving the Palos Verdes School District received and filed. THE DAILY BREEZE - PENINSULA PANORAMA EDITION Councilman Crocker moved that the City Council not participate in the Peninsula Panorama Edition on May 30, 1974. The Manageradvised that an amount had been included in the budget for the item, and that the City of Rolling Hills had always participated in the special issue. Because of an increase cost of approximately $30 overthe amount budgeted for the current year, the matter had been included on the agenda "for information. The motion died for lack of a second. Councilman Heinsheimer moved that the Council participate in. the Peninsula Panorama Edition, and that the extra cost be authorized. The letter was received CALIFORNIA CONTRACT CITIES ASSOCIATION Mr. Kinley advised that he had no additional information to present on the suit between the Cityof Los Angeles vs County of Los Angeles over charges for Sheriff's services, The matter was held on the agenda. CONFLICT OF INTEREST AND DISCLOSURE OF ASSETS ACTS ' The City Attorney suggested that nothing further be done until after the primary election.; if Proposition 9 is defeated, to wait. to see what the Supreme Court does, and asked that the matter be removed from the agenda until after the election on June 4, 1974. CITY DEPARTMENTS DEPARTMENT OF COUNTY ENGINEER 1.590 A letter dated April 26, 1974 from the Department of County -Engineer relative to security provisions was presented to the Council. Mr. Arnold F. Graham, District Engineer, advised that the re- quirements of Chapter 67 of the Building Code empowers the Sheriff to determine devices or methods of construction to provide security on construction, and it was his recommendation that the chapter be re- tained in the City Code as written. Mayor Battaglia ordered the matter held on. the agenda for discussion with the Sheriff at the works op session, and said Captain Hays would be asked to submit in. writing the procedure to be followed when a request is received to waive the requirement for deadbolts. FIRE DEPARTMENT 1592 ORDINANCE NO. 122 Councilman. Further, she said she had been advised by Chief Schneider that adoption of the ordinance will qualify the City of Rolling Hills for approximately $6,000 more in revenue sharing funds. DEPARTMENT OF ANIMAL CONTROL 1646 A notice of the rabies vaccination clinic at Dapplegray School on August 8, 1974 was presentd to the Council. The Manager said the information had been included in the Newsletter to residents. The notice was received and filed. MATTERS FROM THE CITY COUNCIL NET VS GROSS STUDY, COUNCILMAN CROCKER Councilman Crocker asked that the reports of the Planning Com- mission on net vs gross be made available to members of the City Council, and said he would work with the Planning Commission on the matter. Mayor Battaglia said he would ask Chairman Pernell to appear before the present Council to make the recommendations of the Planning Commission. MATTERS FROM CITY OFFICERS SCAFFOLDING - TENNIS COURT The Manager requested authorization to rent scaffolding to be used to install the light sheilds ordered by the Tennis Club on the tennis court lights. Cost of the scaffolding rental is $21.50 per day, or $62.50 per week. Councilman Rose moved that the Manager be authorized to spend a sum not to exceed $150.00, and that the money be lent to the Tennis Club, with the understanding that it be paid back to the City. The motion was seconded by Councilman Crocker and carried by the following roll call vote: AYES: Councilmen Crocker, Heinsheimer, Le Conte, Rose Mayor Battaglia NOES: None ABSENT: None ADJOURNMENT There being no further business to come before the meeting, Mayor Battaglia recessed the session to a personnel session.
