Brandt, City Engineer, advised that the installation of the water main system and appurtenances for Tract No. 30605 has been inspected by the City Engineer and fire flow tested to the satisfaction of the Eire Chief, and that work has been completed in accordance with plans and specifications approved by, and in a manner satisfactory 'to, the City Engineer. It was Mr. Br.andt's recommendation that the City Council find that all work has been completed as required by the Subdivision Water System Agreement and release the Subdivision Water System Agreement between the City of Rolling Hills and the Subdivider, and the Bond for Faithful Performance for the tract. A motion to accept the recommendations of the City Engineer and release -the Subdivision Water System Agreement, for A®3C, and Bond No, 3981412 in the amount of $7,000 was made by Councilman Crocker, seconded by Councilwoman Le Conte and carried by the following roll call vote: AYES-. Councilwoman Le Conte said she wished to attend the luncheon and asked that a reservation be made for her. None ABSENT: Mayor Battaglia SOUTH BAY CORRIDOR STUDY STEERING COMMITTEE 725 The Manager presented a letter dated June 1.4, 1974 from South Bay Corridor Study Steering Committee, advising that Alan Mo Voorhees and Associates, a company experienced in transportation planning, had been selected 'to carry out the Phase I part of the South Bay Corridor Study, Councilwoman Le Conte,representative for the City of Rolling Hills on the South Bay Corridor Study Steering Committee, reported that by Council action on January 14, 1974, participation. by the City in the study and approval of a sum not to exceed $175 was voted; therefore, it was in order for the Mayor and City Clerk to execute the agreement, -2- 1 June 27, 1974 and for the Council to approve payment of the bill in the amount of $153000. PALOS VERDES PENINSULA CHAMBER OF COMMERCE 739 Mayor pro tem Heinsheimer asked Mro Hal Requa, Manager of the Palos Verdes Peninsula Chamber of Commerce, to address the Council regarding a letter dated June 14, 1974 inviting the City of Rolling Hills to consider affiliation with the:Peninsula Chamber through an annual allocationo Mr. Requa said that although the City has no commercial business, there are benefits to the community to be derived from membership, and, he said that representatives of Rolling Hills had been. invited.tom gether with representatives of the other Peninsula cities, to attend a reception on Thursday, July 11th honoring the officers of the Palos �,. Verdes Community Arts Association. A goal of the Chamber, Mr. Requa �0 said, is to honor such organizations which benefit the Peninsula as a whole, including Rolling Hills, and asked that a nominal contribution be made in support of such activity. P o P Y Q Following the presentation, Mayor pro tem Heinsheimer thanked Mr. Requa, and said the matter would be referred to the Budget Committee for a recommendation as part of the presentation for the next Fiscal Year's budget. NOTICE OF FILING OF APPLICATION FOR RATE INCREASE, SO. CALIF EDISON 819 A copy of Application No. 54946, in the matter of the application of Southern California Edison Company for authority to increase rates charged by it for electric services was presented to the Council. Councilwoman Le Conte said she would obtain a copy of the application and related exhibits for the Council. TRAFFIC MONITORING AND TRAFFIC SAFETY SYSTEM. 822 Mayor pro tem Heinsheimer said he had no new information on the matter, and ordered it held on the agenda. TRAFFIC OBSTRUCTION BY TREESg_GEORGEFF ROAD, TIBERIO LIZZA PROPERTY 823 Councilman Heinsheimer reported that during his absence from the City he asked Councilwoman Le Conte to view the Tiberio Lizza property on Georgeff Road in connection with a complaint about a traffic hazard, Councilwoman Le Conte said she had visited the property and after inspection she felt the trunks of the pine trees were not hazardous, but the overhanging branches were, and should be trimmed, Further, Council- woman Le Conte said large trees on another property on Georgeff Road is also hazardous, and should be trimmed but not removed. Other properties on Georgeff Road have planting in the easements, although they are not a traffic hazard. It was Councilwoman Le Conte's recom- mendation that the homeowners be advised of the findings, and requested to cooperate with the City by trimming the overhanging branches. In the event the owner declined to do so, Councilwoman Le Conte recommended that the property owners be advised in advance of the date of work to be done by City employees. -3- 204 June 27, 1974 OFF SHORE OIL DRILLING m OUTER CONTINENTAL SHELF 871 Mayor pro tempore Heinsheimer ordered the matter held on the agenda until the next meeting. RAPID TRANSIT DISTRICT 873 Councilwoman Le Conte reported that in testifying at the hearing she had requested that the Rapid Transit District adopt a program which would include the South Bay; on June 21st a plan was adopted that included the 140 miles originally planned, plus an additional ten miles, for a total.of 150 miles in the area. Following adoption further action was deferred until the plan was presented to the Board of Supervisors, Meanwhile, Mr, Io L. Morhar, Road Commissioner has made a negative recommendation to the Board of Supervisors, Councilwoman Le Conte reported, and the findings of the Board of Supervisors will determine whether the issue will be on the ballot in November to provide funds for Rapid Transit. Councilwoman Le Conte reported that telegrams had been sent to Congressman Glenn Anderson and Congresswoman Yvonne Burke regarding Federal Legislation, and had requested that additional funds be allocated to Los Angeles County for Rapid Transit. A massive effort would be necessary in Washington, Councilwoman Le Conte said, and she asked authorization of the Council to pursue the matter, Councilman Crocker said he would be in favor of Councilwoman Le Conte°s support and she asked other members of the Council to contact her on the matter. COMMERCIAL USE OF PROPERTY IN ROLLING HILLS 872 Councilwoman Le Conte requested that the matter be held on the agenda for a report at a later date, PROPOSED BUDGET, FISCAL YEAR 1974 ® 75 1288 Councilman Crocker reported that he and Mr. Rogers, City Treasurer, had met with representatives of the Board of Directors to develop a budget for Fiscal Year 1974 m 75 for the City and the Association. As a preliminary step, a budget philosophy was developed, and Councilman Crocker said the budget in tentative form would be ready for presentation to the Council shortly. Councilman Crocker, Heinsheimer, Le Conte, Rose, Mayor Battaglia NOES: None ABSENT: None PROPOSED ORDINANCE - Civil Defense and Disaster 1141 Councilman Crocker moved that a proposed ordinance entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS, CALIFORNIA RELATING TO EMERGENCY ORGANI7ATION.AND FUNCTIONS be introduced, and that reading in full be waived. The motion was seconded by Councilman Rose for purposes of discussion. Councilwoman Le Conte suggested revisions of the ordinance provided by the Civil Defense Planning Board, specifically that the City Manager be appointed Director of Emergency Services, and that the Mayor, rather than the Director, be empowered to request the Governor to proclaim a. "state of emergency", and further that the wording of the ordinance be changed to include the feminine gender as well as the masculine gender. The Mayor directed that --the suggestions be incorporated in the ordinance, and ordered the matter tabled until the next regular meeting of the Council. NOES: None ABSENT: None RESOLUTION NO. 314 1365 The City Attorney presented a resolution providing for meetings,d�f the Environmental Quality Board, and setting fees for appearance before the Board. Mr. Kinley said the figures were arbitrarily arrived at, and were open for discussion. Councilman Rose moved that the resolution, entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS FIXING THE TIME AND PLACE FOR THE REGULAR MEETINGS OF THE ENVIRONMENTAL QUALITY BOARD OF SAID CITY, AND FEES TO BE PAID TO THE CITY OF ROLLING HILLS FOR FILING AN ENVIRONMENTAL IMPACT REPORT AND APPEALING FROM A DECISION OF.THE -6- 1 1 June 27,'1974 ENVIRONMENTAL QUALITY`BOARD, AS -REQUIRED BY SECTIONS 8, 17 and -19 OF ORDINANCE NO. DEPARTMENT REPORTS.. .1550 The reports of the Sheriff°s January,.February and March 1974 reports..were received and filed. 'MATTERS FROM THE AUDIENCE Department -for December 1973, were presented to the Council. The Mr. Hank Peralez, Deputy to Supervisor James Hayes, advised the Council that he had recently been assigned to the San Pedro office, and would be at that location except for a few hours each week. Mr. Peralez asked members of the Council to contact him on matters con- cerning County services. Mayor Battaglia thanked Mr. Peralez for his. appearance before the Council. MATTERS FROM THE COUNCIL Councilman Rose-. Modification of Restrooms 1580 Councilman Rose reported that following the last meeting of the City Council he had made a survey of the restroom facilities in the Administration Building, and he said the toilet facilities were in violation of the United States Constitution, since they are inaccessible_ to physically handicapped persons.; Councilman Rose moved that the Council approve an expenditure up to $1,000 for appropriate modifica- tions of both restrooms to accommodate physically handicapped persons. -7- X0 8 June 27, 1974 Councilman Rose explained that it would be necessary to widen the entry to accommodate a wheelchair, purchase a wider door and lower the mirrors. Government Code regulations, adopted in 1968, require such accommoda- tions, and Councilman Rose recommended that buildings built before that date be modified to conform. -Councilwoman Le Conte asked that a wider shelf be installed in the Ladies' Restroom,' The motion to approve modification of restr°ooms was 'sec'on'ded Eby Councilman Crocker and carried by the following roll call vote: - AYES: Councilmen Crocker, Heinsheimer, Le Conte, Rose NOES: Mayor Battaglia ABSENT: None Councilwoman Le Conte: Fire on Outrider Road 1653 Councilwoman Le Conte asked for a report of the recent fire on Outrider Road, and asked whether the Emergency system had been activated, Mrs. Clifton said a grass fire had been started by youths behind Miraleste High School, and had been extinguished quickly before it was necessary to activate any of the disaster equipment. Department of Animal Control - New Fees 1672 Councilwoman Le Conte asked whether it was the intention of the Council to accept the recommendations to the Board of Supervisors by the Department of Animal Control revising fees for services. Mrs. Clifton said she had been advised that the recommendation was adopted by the Board of Supervisors on June 17, 1974, and a sample ordinance would be sent to the City; when it arrives it will be referred to the City Attorney for review and his recommendation. View Obstruction m Packsaddle Road 1692 Councilwoman Le Conte said she had received a complaint about a fence on Packsaddle Road intended to restrain four German shepherd dogs, and which also obstructs the view of one of the homes, and is an eyesore, Mayor Battaglia asked that the matter be referred to the Board of Directors of the Rolling Hills Community Association, Councilman Crocker said he was of the opinion that stronger legislation should be considered to enforce prosecution of violations in the City, since the architectural liens placed on properties by the Association are ignored by the residents and are generally ineffective, Mayor Battaglia asked Councilman Crocker to work with the City Attorney in preparing an ordinance which would be effective in enforcing restrictions and pro- secuting violations. C.ouncilman4 Crockero Motorcycles 1820 . Councilman Crocker asked whether the other members of the Council thought there had been a change in the number of complaints about motorcycles since the recent study of the problem. Councilwoman MIM 1 June 27, 1974 Le Conte said.she had not observed any violations recently, and also thought the skateboard problem had abated.after Council action on the matter. MAYOR BATTAGLIA JOINT'MEETING OF PENINSULA MAYORS 1920 Mayor Battaglia reported that at a recent meeting of the Mayors of the Four Peninsula Cities arrestor beds for Hawthorne Boulevard in the vicinity of Palos Verdes Drive North were again discussed, The Mayor said that at the request of Mayor Joseph Lehman of Rolling Hills Estates, and as directed by the Council, he had written to Supervisor James Hayes and had supported installation of arrestor beds as a traffic safety measure, and had received an acknowledgment of his letter, stating that Supervisor Hayes was also in favor of the installation.. Subsequently, it was announced that the arrestor beds would be installed, using funds previously allocated to beautification of that portion of Hawthorne Boulevard in Rancho Palos Verdes. The City of Rancho Palos Verdes has expressed support of the arrestor bed installation, but not at the expense of landscaping in their City, and support of the four mayors is again being sought for -installation of arrestor beds on that portion of Hawthorne Boulevard in Rolling Hills Estates, and appropriate landscaping on that portion of Hawthorne Boulevard in Rancho Palos.Verdes. MATTERS FROM CITY OFFICERS City Attorney re: .City of Los Angeles vs County. of Los Angeles 1829 Mr. Kinley reported that he had received a communication in con- nection with the lawsuit between the.City of Los Angeles and the County of Los Angeles regarding Sheriff Contract Services, and had been advised that the fee for contract cities participating in the suit would be 1/10 of 1`/0 of the 197374 Budget for Sheriff Contract Services, plus $13.00 for filing an answer. The City Attorney requested that the Manager be authorized to have an appropriate check prepared for John S. Todd, Trustee,. Special Committee. Mr. Todd is City Attorney for the City of Lakewood. A motion to authorize payment of the fee was made by Councilman Rose, seconded by Councilman Crocker and carried by the following roll call vote: AYES:- Councilmen Crocker, Heinsheimer, Le Conte, Rose, Mayor Battaglia NOES: None ABSENT: None COLLECTION OF FEES FOR COLLECTION OF GARBAGE BY CITY 1845 Mr. Kinley said he had prepared for the Budget Committee a summary of regulations of the Health and Safety Code which became effective after entering a five year Franchise with regard to collection of fees 2 0'3 June 27, 1974 for collection of garbage in the City. Two years of the franchise period have passed, and the third year will begin in November, 19740 Mr. Kinley said he would make copies of the memorandum available to the Council, but suggested that they consider all implications of rising prices before taking any -action. Under present Health and Safety Code regulations the City would be empowered to collect charges for the collection of garbage and rubbish; and to make a separate charge therefor; further, the fee could be charged on the County tax bill in addition to the city tax. Previous to 1972 this charge could pot be added; the proposed procedure was not available at the time the Franchise was negotiated, Mr. Kinley said. 1974 PARK BOND ACT REQUIREMENTS 1900 Mr, Kinley reported that he had reviewed a letter dated June 24, 1974, from Department of Parks and Recreation, Los Angeles County, at the request of the City MaiiagEr; regarding application for project grants for F/Y 1974-75 from the 1974 Park Bond Act, and advised the Council that careful consideration of obligations to residents outside of Rolling Hills be given before accepting funds. Councilman Rose suggested that the Council take a conservative approach aimed at not accepting the funds, then attempt to determine any reasons why the funds might be accepted, Mayor Battaglia asked the City Attorney to study the matter and report further to the Council. JOINT TRAFFIC COMMITTEE _ PENINSULA CITIES (Side 2, 008) Mayor Battaglia said the.Mayors had named representatives of their cities to attend meetings for the purpose of developing a joint traffic committee, and he had delegated Councilman Crocker to attend as a representative of Rolling Hills, The cities of Rancho Palos Verdes and- Rolling Hills Estates will also have representatives, and the City of Palos Verdes Estates, which has its own police force, has offered to cooperate by having a representative available for guidance. The next meeting of the Mayors has been scheduled for September, and it is their wish to have a report of the Joint Traffic Committee at that time. NIKE SITE 015 The City of Rancho Palos Verdes reported that one of the prime interests in the Nike Site has emanated from the Palos Verdes Peninsula Unified School District. Mayor Battaglia said he would contact the School District to try to determine what their plans are for the site within the City of Rolling Hills if the Administrative Offices are moved to another site, Councilwoman Le Conte said she had discussed the matter with members of the School Board, and they had indicated an interest in meeting with the Mayor and Council for a discussion of the site in Rolling Hills. Mayor Battaglia asked that the City Manager schedule a meeting be- tween the School Board and the City Council for the purpose of discussing possible vacation of the site within the City, and also manning re- quirements for the school within the City, and other items of mutual interest. ®10® 1 SHERIFF'S SERVICE 043 June 27, 1974 The Manager reported that she had been advised by Captain Kenneth Hays that the agreement between the City of Rolling Hills and the Sheriff had been modified slightly by substituting a one-man car rather than a two-man car on the P.M. shift, resulting in a substantial reduction of costs to Rolling Hills in the amount of $10,675 for the Fiscal Year. Mrs. Clifton reported that she had confirmed the change in a letter to the Sheriff's Department, as she was advised of Captain Hays' transfer effective July 7th. Mayor Battaglia asked that the revised proposal be made in writing by the Sheriff's Department, since the original proposal had been adopted by Council action as presented in written form. A moi ion to accept the revision of Sheriff's services as presented 00 ,.4 by the Manager was made by Councilman Rose, seconded by Councilman Heinsheimer and carried by the following roll call vote: AYES: Councilmen Crocker, Heinsheimer, Rose NOES: Mayor Battaglia ABSENT: None ABSTAIN: Councilwoman Le Conte Mayor Battaglia asked that the record show that his objection was based on lack of a written revision presented by the Sheriff, and because he felt that the Sheriff's recommendation was in fact a decision made by the Sheriff for the Council. MATTERS FROM CITY OFFICERS City Manager: Dog Kennels 093 The Manager read the section from Ordinance No. 79 defining Dog Kennel, and reported that it has come to her attention that many residents in Rolling Hills own more than three dogs, and therefore are in violation of the Ordinance which requires that owners of four or more dogs must obtain a kennel license, which is illegal in Rolling Hills. Mayor Battaglia -said the matter ties in with commercial activity in the City, and referred it to the Committee for inclusion in their report. ADJOURNMENT There being no further business to come before the Council, Mayor Battaglia recessed the session to a Personnel session at 10:20 P.M.
