Monday, March 10, 1975 at the Adminis- tration Building, 2 Portuguese Bend Road, Rolling Hills, California. Martin Gould, Co-chairmen on Monday, March 17, and a report will next regular meeting on March 24. BUDGET PROCESS & POLICY DECISIONS 390 plans to meet with Mr. Vernon of the Emergency Action. Committee be made to the Council at the 395 The Mayor announced that the Budget Committee consisting of representatives of both the City and Community Association had met and developed the proposed time schedule for presentation. of the Budget as follows: first submittal, April 14; Council review, April 28; Public Hearing May 12 or 28; Budget discussion, June 9; adoption June 23. The Manager explained that policy decisions will be made and the preliminary budget will be adopted in June; the final budget will be adopted by a resolution of the Council after final assessed valuation figures have been received from the County in August. Councilman Crocker asked that the policy decisions made at the meeting be typed and distributed to members of the Council. REVIEW OF ORDINANCE GOVERNING COMPOSITION OF ENVIRONMENTAL QUALITY BOARD Councilman Crocker suggested that the Council consider amending the ordinance which now requires a member of the Council, Planning Commission, Architectural. Committee, Board of Directors and a resident who is not a member of any Committee, Council, Commission or Board. It was Councilman. Crocker°s suggestion that the Council consider changing the ordinance to require that a representative of those committees or their designee be appointed to the Environmental Quality Board, since if `a 719 March 10, 1975 residents who are not members of any of the bodies specified have indi- cated an interest in serving. The matter was held on the agenda for further discussion. PROPOSED RESOLUTION: ODD/EVEN GASOLINE ALLOCATION 461 Councilwoman Le Conte reported that Supervisor James Hayes met in Washington, D.C. with representatives of the energy administration, and will return next week for further conferences on the subject of gasoline all.ocation. Councilwoman Le Conte submitted a proposed reso- lution supporting allocation and distribution of gasoline, and requested support of the Council. Councilman. Crocker moved that Resolution No. 334 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS ENDORSING A PROGRAM OF ALLOCATION AND DISTRIBUTION OF GASOLINE be adopted, and �• that reading in full be waived. The motion was seconded by Council - 00 womanILe Conte and carried by the following roll call vote: AYES: Councilmembers Crocker, Le Conte, Pernell Q Mayor Heinsheimer ABSENT: Councilman Rose REQUEST BY .CABALLEROS FOR PERMANENT BARRICADE AT END OF CRENSHAW BLVD. Mrs. Clifton, reported that she had been contacted by Mr. Harry Peacock; City Manager of Rolling Hills Estates, who opposed blocking Crenshaw Boulevard, since it provides the only equestrian access from Rolling..Hills Estates to the ocean. Mr. Leonard Wood, City Manager of Rancho Palos Verdes in which that portion of Crenshaw Boulevard is lo- cated, said that if the matter was pursued by the Rolling Hills Council a member of their City staff would meet with a Rolling Hills represent- ative to discuss the request. Councilman Crocker said he felt it would be an inappropriate request by the City Council, and asked Mrs. Clifton to advise Cabal- leros` that such a request would have to come from individual citizens or from Caballeros as a group. Councilwoman Le Conte agreed, and the Mayor so ordered. PAYMENT..OF BILLS 555 A motion to approve Demands No. 4334 through 4370 in the amount of $19,894.13 for payment from the General Fund was made by Councilman Crocker) seconded by Councilman. Pernell and carried by the following roll call vote: AYES- Councilmembers Crocker, Le Conte, Pernell Mayor Heinsheimer ABSENT: Councilman Rose SOUTH BAY CORRIDOR STUDY STEERING COMMITTEE 578 Councilwoman Le Conte reported that there is a balance of funds available from Phase I which could be applied to the cost of preparatory 1work'for Phase -II. In order for the County and State to allocate their monies, an authorization approving expenditure of the City's balance in the.amount 017$9.00 - $12.00 is necessary. Councilwoman Le Conte moved that the City of Rolling Hills ap- prove application Of funds due to the City of Rolling Hills from Phase I to preparation of Phase II, and that the South Bay Corridor Study Steer- ing Committee 'be so advised. Mayor Heinshe>; stated that approval of the allocation does not imply support of Phaf;gAt'..' SUBDIVISION NO. 60, 'TRACT 30345, DR. JERRY GREENHUT 619 Mayor Heinsheimer opened discussion of Tract 30345, Dr. Greenhut, 13 Blackwater Canyon Road, which was approved by the Gity� ;y. Council on February 24. At that meeting Mrs. Josephine Woodley, ®wne; of property at 11 Blackwater Canyon Road which has also been submitted; for subdivision, agreed in concept to a proposal for development of a`, .joint access to the two properties, on condition that the proposed_ driveway be reviewed and approved by her engineer, Mr. Stephen Malone;.'. South Bay Engineering Corporation. Mrs. Clifton advised the Counc';;`4 that Mrs. Woodley called her the following day and said she wished discuss the matter further, and at a meeting with Mrs-. Woodley, M,r.. Maloney Mrs. Clifton and Mr. Roger Meurer, engineer for Dr. Greenhut''.y•: Mrs. Woodley asked that a proposal approved by her be presented to City Council. A tract map marked "Exhibit A, Revised March 10, 1975'''.::'._t" was submitted 'by Mr. Meurer, and a tract map incorporating Mrs. Wood.'-,," `'`: -,s ley's proposal was submitted by Mr. Maloney. Mr. Maloney advised the Council that when he reviewed the mag :::..:`' he determined that the tentative map approved by the Council was rest, and that the eucalyptus trees are actually on Dr. Greenhut's property line and not five feet from the line as shown on the map. Therefore, if the driveway is constructed to the north of the trees,' the first 150 feet would be entirely within the easement on Mrs. W904,-. ley's property, instead of five feet on Dr. Greenhut's easement and ,:i'_; _. fifteen feet on Mrs. Woodley's easement as shown on Exhibit "A" ap= proved by the Council on February 24. Mr. Maloney reported that Mra;:Y.:°�':, �''::: Woodley has indicated that she will not be a party to the agreement,:.::,;;,::' Councilman Crockersaid he had visited the property and it.,was" ` his opinion that the trees act as a windbreak and should not be reioe> since they are valuable for other reasons besides landscaping and p3 r1 .y:; Mayor Heinsheimer asked the City Attorney to comment on the present legal status of the subdivision, inasmuch as the Council has approved the tentative map. Mr. Kinley said that unless the Council''-,.. takes an.action to reconsider the subdivision and/or rescind the approval, the approval stands. Further, Mr. Kinley said there is a 25 easement on each side of the common boundary, and the easements ; are reserved for ingress and egress as well as bridle trails, and the Rolling Hills Community Association has already approved the use of the easement. Councilman Rose moved that the Council re&'dit, si.der Tentative Tract 30345. The motion was seconded by Cogncilman:'� _0 Crocker and carried by the following roll call vote: AYES: Councilmembers Crocker, Le Conte, Pernell, Rose NOES: Mayor Heinsheimer -3- March 10, 1975 Dr. Greenhut advised the Council that in his discussion with Mrs. Woodley on February 24 the following concessions were made by him: 1)_ That the entrance to the joint access would be entirely on his property to provide a 900 intersection with Blackwater Canyon Road; 2) The lower 2/3 of the road would be developed on Dr. Greenhut's .property;` -and would serve Lot 2 in the Woodley subdivision, and 3)_ Dr-;�t--Greenhut agreed to pay 2/3 of the cost of the road, since he wd1dl,d_:havd onemorelot taking access than Mrs. Woodley would. Dr. Greenhut asked the Council to approve construction of the driveway entirely on his property since Mrs. Woodley has stated that she no longer wishes to be a party to the agreement, and in the event that she eventually wishes to take access from the -driveway to her prop- erty, an agreement could subsequently be -worked out. Dr. Greenhut again,:as,,ked-that IYis subdivision not be delayed further to accommo- date.,the-.-Owners in their attempt to agree on the access. Dr. Green- .hut'said..,.that if the Council agrees to construction of a driveway entirely lon-,his.propert y, the trees would remain and the driveway p- would--be-constructed on the south side of the trees. ::-Councilman Pernell suggested that the Council could approve the tentative map without specifying the actual location of the access -,driveway, and could require a document guaranteeing the location of the,`.drive to be submittiad at_;fhe time the final map'. is presented to the'Co"b'ninil. ' Councilman Crocker requested that "Exhibit A as revised March 1.0.,:'1975" be referred to Caballeros for review of the trail, which crosses the driveway. .,'...Councilman Rose moved that the tentative map marked "Exhibit A revis'ed.'March 10, 1975" be substituted and approved by the Council. Councilwoman Le Conte seconded the motion. Councilman Rose said that in approving subdivisions the Council should act in the best interest lof'the :City to ensure the orderly development of the area regardless of the. - wishes of individual owners, and Councilwoman Le Conte expressed a wish for the Council to be as fair as possible to both property owners, while making every effot to preserve the trees, and said that by Council's : reaffirming their previous action, the -owner's would have an opportunity.to agree on a joint access and Dr. Greenhut would also 'be given the option of developing the access totally on his property if thez.owners cannot agree. Councilman Crocker suggested that Mrs. Woodleybe granted a specific time period of thirty days to agree, ano."G63neilwoman Le Conte agreed that a specified time period should be granted. ;Gouncilman Rose restated his motion as follows: that "Exhibit A revised,,March 10, 1975" be approved with the additional provision that Dr. Greenhut be granted the option of locating the driveway on the south side of.the trees if Mrs. Woodley does not agree to the joint access within thirty days from the date of approval, and that if the driveway is located on the south side of the trees, the bridle trail will be developed,on'the north side of the trees. The motion was seconded by Counclilman-Crocker and carried by the following roll call vote: Councilmembers Crocker, Le Conte, Pernell, Rose Mayor Heinsheimer Mr. John -Farrow, 12 Blackwater Canyon Road, advised the Council I that there is a serious problem on the trail adjacent to his property wherejt­joins-Blackwater Canyon Road. Councilman Crocker suggested ­that ,the­--matterbe referred to Caballeros. Mr. Farrow said he had wr - itten.-to the Board of Directors about the trail and a fence on adja- cent property, and Mrs. Clifton said the matter will be on the next meeting agenda, and she asked Mr. Farrow to attend the meeting of the Board of Directors. -4- 4S March 10, 1975 USE OF HORSE TRAIL EASEMENTS FOR EMERGENCY ACCESS 1450 Councilman Crocker reported that Chief Schneider had again said that requiring clearing of all easements surrounding properties would be of minimum benefit from a fire hazard standpoint, since to clear all easements would not be of any benefit to the Fire Department in fighting a fire. Councilman Rose suggested that residents be re- quested to keep cleared easements presently used for horse trails clear of weeds to cut down on the fire hazard and to make the trails available for use by wheeled vehicles in an emergency. Further, Councilman Rose said it was his intention to shift the burden of weed abatement to the resident on whose property the trail is located, as part of the fire ordinance. Councilman Pernell said such action might deter residents from dedicating equestrian trails across their properties and suggested that emphasis be placed on the no smoking rule on the trails. FEDERAL FLOOD INSURANCE REQUIREMENTS 1550 The City Attorney reported that he is preparing a resolution in the required form, and asked that the matter be held on the agenda. The Mayor so ordered. CITY DEPARTMENTS 1555 SHERIFF'S DEPARTMENT The Sheriff's Department Report for the month of October 1974 was presented to the Council. The report was received and filed. FIRE DEPARTMENT The Reports of the Fire Department for December 1974 and ,January 1975 were presented to the Council. The reports were received and filed. PARAMEDIC PROGRAM Mrs. Clifton advised the Council that she had been advised that the matter of funding for continuation of the Paramedic program on the Peninsula is being considered. The Mayor directed that a letter to Chief Houts in support of the program be prepared for his signature. POSTING OF HOUSE NUMBERS Councilman Crocker asked that the matter of posting a house number at each residence as requested by the Fire Chief be scheduled for further discussion at the next meeting of the Council. MATTERS FROM CITY OFFICERS 1626 ICMA PLANNING CONFERENCE Mrs. Clifton presented a written report to the Council on her a'£tendance at the planning conference for the International City Manager Association conference recently held in Washington, D.C. Mrs. Clifton said the conference will be held in Seattle in September. RUBBERIZED ASPHALT PAVING Mrs. Clifton said she will present a report to the Board and Council on a new rubber -asphalt paving material. Representatives and Managers of several cities including Lawndale, Lomita and Peninsula cities have met to discuss the concept, and the material will be used in the City of Lomita and on Palos Verdes Drive North within the City -5- 38 VY March 10, 1975 of Rolling Hills Estates. The Manager reported that it will also be used in Rolling Hills. CALIFORNIA CONTRACT CITIES The Manager said information on the Annual Seminar of the California Contract Cities in Palm Springs on April 10-13 had been sent'to members of the Council. Mrs. Clifton said the conference is a budgeted item for members of the Council and City Officers. CITY ATTORNEY'S CONFERENCE Mr. Kinley advised the Council that he wishes to attend the City Attorney's Conference at South Lake Tahoe April 30 and May 1. A motion to authorize the City Attorney to attend the meeting was made by Councilwoman Le Conte, seconded by Councilman Crocker and carried by the following roll call vote: tr 'JO AYES: Councilmembers Crocker, Le Conte, Pernell, Rose Mayor Heinsheimer Q MATTERS FROM THE COUNCIL COUNCILMAN PERNELL CALIFORNIA CONTRACT CITIE'S�14ONTHLY MEETING Councilman Pernell said he plans to attend the monthly meeting of California Contract Cities on Wednesday, March 19 if possible, and Mr. Kinley said he would try to attend also. Mr. Kinley said reappor- tionment of the sales tax on the basis of population is a matteY of interest to Rolling Hills, and was discussed at the City Attorney's Conference last year. It was his suggestion that the matter be brought up at a meeting of the Contract Cities Association. COUNCILMAN CROCKER LANDSCAPING AT ZILA PROPERTY, CREST ROAD WEST 1686 Councilman Crocker reported that he had been unable to arrange to meet personally with Mr. Frank Zila, 39 Crest Road West to discuss his landscaping with him, but had telephoned Mr. Zila and told him that the present pruning effort was satisfactory to the Council, and empha- sized that it must be maintained constantly to conform to requirements for traffic safety. REPORT TO THE COMMUNITY 1880 Councilman Crocker said that since all residents receive -the City Council agenda in the Newsletter, they should be advised of major actions by the Council. Councilwoman Le Conte agreed. COUNCILMAN ROSE o MEETING OF COMMITTEE RE: AMENDING ANIMAL CONTROL ORDINANCE 1701 Councilman Rose reported that he attended a meeting of the committee to study the animal control ordinance and make recommendations Ito the'Council at the home of Mrs. Velma Matthews, 11 Cinchring Road. The meeting was well attended, and the committee is attempting to: 1) Identify the problems; 2) Come up with recommendations for one or more solutions; 3) Produce an information pamphlet to be included in the Rolling Hills information booklet, covering control of animals, including dogs. Councilman Rose said the committee will report to the Council on April 14. The matter was held on the agenda. g March 10, 1975 Mrs. Clifton advised the Council that she had been notified by the Department of Animal Control that licensing of dogs in Rolling Hills must be suspended until the Council amends the ordinance with regard to increase in license fees. Mayor Heinsheimer directed the City Attorney to prepare an appropriate ordinance for presentation to the Council at the next meeting.
