"'RESIGNATION FROM CITY COUNCIL 1358
Mayor Heinsheimer announced that the purpose of the special meeting
was to consider a letter dated December 15, 1975 from Councilwoman Dorothy
Le Conte, advising that family needs would require her resignation from
the Council at an early date.- Mrs. Le Conte stated that inasmuch as
filing is now open for the regular election in March, she was submitting
her resignation from the Council effective December 15, 1975° The Mayor
said it would be necessary for the Council to act on the matter, and they
ou

ld consider an appointment to fill the vacancy for the balance of the
nepired term; or they could call a Special Election to be held at the
ame time as the General Municipal Election.
Councilman.Rose moved that the Council accept Mrs. Le Conte's
resignation from the Council with regret and expression of appreciation
for her service as a member of the Rolling Hills Council. The motion
was seconded by Councilman Crocker and carried by the following roll
call vote:
AYES: Councilmen Crocker, Pernell, Rose, Mayor Heinsheimer
NOES- None
ABSENT- None
Mr. Paul Marshall, representing Martin and Chapman, election suppliers
for Rolling Hills, advised the Council that a special election could be
held at the same time as the General Municipal Election, and that candi-
dates who file must specify on their Nominatf:on,:P.aper"s.:�whether they are
filing for the full term, which will expire in March, 1980, or for a
short term to fill the vacancy, which will expire in March, 19780
Mrs. Kip Goldreyer, 3 Quail Ridge Road North, asked that the Council
consider making an appointment to the Council, and Councilman Pernell
agreed that the Council should consider such action. Councilman Rose
aid an appointment.was made when -Mayor Battaglia resigned from the
ouncil and Councilman Pernell was appointed to fill the vacancy until
xpiration of the term, At that time an appointment was considered the
ost expedient and satisfactory method to fill the vacancy; however, in
view of the closeness of the next election, Councilman Rose said he con-
sidered it more appropriate to. give the electors an opportunity to fill
the vacancy by election.

Councilman Rose moved that Resolution No. 355 entitled A RESOLUTION

OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA, CALLING
AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE
HELD IN SAID CITY ON TUESDAY, THE 2ND DAY OF MARCH, 1976 FOR THE ELECTION
OF A MEMBER OF THE CITY COUNCIL OF SAID CITY AS REQUIRED BY THE PROVISIONS
OF THE LAWS OF THE STATE OF CALIFORNIARRELATING TO GENERAL LAW CITIES AND
ORDERING THE CONSOLIDATION OF SAID ELECTION WITH THE GENERAL MUNICIPAL
ELECTION TO BE HELD ON MARCH 2, 1976 be adopted, and that reading in full
be waived. The motion was seconded by Councilman Crocker and carried by
the following roll call vote:
AYES: Councilmembers Crocker, Pernell, Rose, Mayor Heinsheimer
CLOSE OF FILING 1508
Councilman Pernell asked if there was any way to extend the filing
period to give more residents an opportunity to consider filing for the
office, in view of the vacancy left by resignation. Mr. Marshall said
the filing period could be extended only if an incumbent failed to file;
however, both incumbents have taken out papers, and since both cannot
fail to file within the specified period, the filing date cannot be
extended beyond December 24. Further, Mr. Marshall said that because
the City of Rolling Hills has adopted a resolution which specifies that
the City Hall close at noon on Christmas Eve, that will be the time of
the close of filing. Mr. Kinley explained that the election law which
defines the period for filing specifies that the period can be'shortened,
but not extended, and based on that, Mr. Kinley has determined that
filing will close in the City of Rolling Hills at noon Wednesday,

The Manager was directed to issue a special Newsletter advising
residents of the vacancy on the Council, and Mrs. Clifton advised the
Council that she had already contacted the Superintendent of Mails and
was assured that any printed bulk mail delivered to the Post Office by
noon Friday would be delivered to Rolling Hills residents on Saturday,

There being no further business to come before the Council, the
meeting was adjourned at 9:15 P.M.
