Monday, March 15,. 1976 at.the Administration Building, 2 Portuguese Bend Road, Rolling Hills, in the absence of Mayor Rose, who arrived at 7:55 P.M. - ROLL CALL PRESENT: Councilmembers Crocker., Heinshe.imer, Pernell, Swanson Mayor Rose arrived at 7:55 P.M. Wright Mrs. Louise Zimmerman PROPOSED AMENDMENT TO ANIMAL CONTROL ORDINANCE Mayor pro tempore Crocker explained that the purpose of the ad- journed meeting was to consider Section 1205 and ARTICLE XIII of the Animal Control Ordinance which had been excluded when Ordinance No. 136 was adopted in February. He asked that discussion be limited to those two portions of the ordinance only, and said further that residents who oppose a limit on the number of dogs would be given an opportunity to speak, followed by those who wish a limit on the number of dogs. Resi- dents were also asked to limit their presentations to facts and inform- ation which had not already been presented. March 15, 1976 The following residents spoke in opposition to limiting the number of dogs permitted: Mrs. Velma Matthews, Mrs. Cathy Kelly, Dr. Larry Kelly, Mr. Barry Becker, Mrs. Arlene Lawler, Mr. Howard Jensen, Mrs. Emily Schleissner, Mr. France Raine, Mrs. Harriett Spertus, Mrs. Alice 011a, Eric Pedersen. Mrs. Ruth Shifman said the Council was not giving full attention to the testimony, and asked that they refrain R from reading material before them until after residents had spoken. Dr. David Basque, Mr. D. Wright, Miss Grace Nixon, Mrs, Louise Zimmerman, Mrs, Kip Goldreyer and Mrs. Catherine Partridge spoke in favor of limiting the number of dogs. Mayor pro tem Crocker read into the record a letter from Mrs. Cathy Watts, urging that the issue be decided. Other residents who spoke without stating their position on the matter were Mrs. Carol Hanscom and Mr. Henry Aizpuru. Mr. Anthony du Pont said the proposed ordinance has far reaching implications, and he urged the Council to attempt to find another way to solve the problem rather than limit the number of dogs. Mrs. Betsy Raine said it is management of the dogs rather than the number of dogs which creates problems. Councilman Crocker explained that the Council had held public hearings and developed the new ordinance in response to complaints from some residents. Councilman Heinsheimer read into the record sta- tistics from records of the Animal Control Department, Los Angeles County, which had been presented at the public hearing at La Cresta School on June 23, 1975. The Mayor pro tem thereafter closed the Public Hearing. Mayor Rose arrived at the meeting and was seated. Councilman Heinsheimer moved that Sections 1312, 1313 and 1314 of ARTICLE XIII be deleted. The motion was seconded by Councilman Crocker for purposes of discussion. Following the discussion Council- man Heinsheimer withdrew his motion. Councilman Heinsheimer moved that Section 1313 be deleted. Councilman Crocker seconded the motion for purposes of discussion. Councilman Heinsheimer moved that the motion be amended to include Section 1314, and the motion was restated as a motion to delete Sections 1313 and 1314., The motion as amended by seconded by Council-, man Crocker and filed to carry on the following roll call vote: AYES: Councilman Heinsheimer NOES: Councilmembers Crocker, Pernell, Swanson, Mayor Rose Councilman Crocker moved that Section 1313 be amended to read: "The owner of more than three licensed dogs on August 14, 1975, shall not be required to comply with the provisions of Section 1301 of this ordinance, providing each of said dogs in excess of three is neutered prior to December 31, 1976." The motion was seconded by Councilwoman Swanson and carried by the following roll call vote: AYES: Councilmembers Crocker, Heinsheimer, Pernell, Swanson Mayor Rose Councilman Heinsheimer moved that Section 1314 be deleted in its entirety. The motion was seconded by Mayor Rose and failed to carry on the following roll call vote: AYES: Councilman Heinsheimer, Mayor Rose NOES: Councilmembers Crocker, Pernell, Swanson -2- March 15, 1976 Councilman Heinsheimer moved that Section 1312 be deleted in its entirety. The motion was seconded by Crocker and carried by the following roll call vote: AYES: Councilmembers Crocker, Heinsheimer, Pernell, Swanson Mayor Rose Councilman Pernell moved that Section 1309 be amended to read forty five days, instead of fifteen days. The motion was seconded by Councilman Crocker and carried by the following roll call vote: AYES: Councilmembers Crocker, Pernell, Swanson, Mayor Rose NOES: Councilman Heinsheimer Councilwoman Swanson moved that Section 1205 of ARTICLE XII and ARTICLE XIII be adopted as amended. The motion was seconded by Council- man Pernell and carried by the following roll call vote: AYES: Councilmembers Crocker, Heinsheimer, Pernell, Swanson NOES: Mayor Rose The Mayor asked that the record shaw that he is in favor of limiting the number of dogs, but it is his opinion that the proposed ordinance is not broad enough for future circumstances, and that a general variance statute is needed, therefore he voted against the proposed ordi- nance. RECESS Mayor Rose recessed the meeting at 10:15 P.M. The meeting was reconvened at 10:25 PoMo LETTER FROM ELI MITCHELL, 23 GEORGEFF ROAD 1724 A letter dated March 12, 1976 from Mr. Eli Mitchell was presented to the Council. Mr. Mitchell was advised in a letter from the Mayor on March 9 that his dog was included in a list of "habitual offenders" sent to the City by Mrs. Pat Wright, principal of La Cresta Elementary School, who contacted the Council and asked assistance in keeping dogs away from the school grounds. Mr. Mitchell said he would make every reasonable effort to keep his dog away from the school. The letter was received and filed, and the Manager was directed to acknowledge Mr. Mitchell's letter. CLIFTON HIX SUBDIVISION, TRACT 29383 1764 Councilman Heinsheimer said he had recently learned of a poten- tial geology problem on the Hix subdivision which might prevent grading for a riding ring on a parcel of land Mr. Hix has proposed as a gift to the City. He requested a review of records on the tract before the Council approves the final map. Mrs. Clifton said she would ask Mr. Roger Meurer, engineer for Mr. Hix, to appear at the next meeting to -3- 7 March 15, 1976 answer the Council's questions on the matter. MATTERS FROM MEMBERS OF THE COUNCIL TOWN HALL TIME 81 (2) Councilman Pernell distributed copies of a memorandum to members of the Council requesting that a portion of each Council meeting be devoted to a "Town Hall Time" at a specified time, and that time for each resident to speak be limited to five minutes, with the entire portion of the meeting limited to a total of thirty minutes. Further recommendations are that residents would not be required to request an appearance before the Council,- the appearance would be non -noticed, and the Council would not be bound to act, just receive testimony. If more time is needed the matter would be placed on a future agendas Councilman Heinsheimer said that the agenda is sent to all residents in the Newsletter, and residents who wish to speak on any matter can ask to be placed on the agenda. Further, there is a portion of the agenda reserved for Matters From the Audience. Councilman Pernell said residents had expressed frustration about'the need'to wait until the end of the meeting to be heard, and it is his wish to minimize obstacles to accessibility of officials to residents. Following the discussion the Council agreed to try the recom- mendation for a period of time, with the procudure evaluated by the Council before final adoptions Mayor Rose asked that residents be advised in the Newsletter that the period from 8030 to 9:00 P.M. will be reserved for Town Hall Time, to be evaluated after two sessions. Further, he asked that residents be advised of the procedure to be followed by residents who wish to be placed on the regular agenda of the City Council. PARKING SPACE FOR HANDICAPPED PERSONS 85 Mayor Rose asked that the parking space at the southwest corner of the parking lot in the rear of the Administration Building be re- served for handicapped parking and painted the appropriate blue to so indicate. The Mayor said that space is wide anough to accommodate a fully opened car door and a wheel chair and is closest to the walk leading to the front door. The Manager said she would have the space painted and marked immediately. The Mayor also asked that rear door of the Administration. lip, be raised so the -'rear door BARRIER. STRIPS IN PARKING LOT a section of the walk leading to the Building, which has"dropped; forming a will also be accessible to wheel chairs. 233 The Manager reported that since the parking spaces were reassigned with staff parking across the rear of the lot and residents parking near the building, difficulty has been experienced because tesidenfs pull across the sidewalk, limiting access to the building. She asked authorization for installation of cement strips to be installed as barriers in individual parking spaces to control parking and eliminate the problems Mrs. Clifton said the total cost of the barriers would be approximately $100. Authorization to proceed was given, and the Council agreed to approve the expenditure when submitted on the list of demands. FIRE RETARDANT ROOFING REQUIREMENTS 257 The Manager reported that because of increasing requests for clarification of requirements for fire retardant roofing, and because of confusion in interpreting Resolution No. 331, she and Planning Commission Chairman Forrest Riegel had gone to the office of the Los -4- March 15, 1976 Angeles County Engineer, Department of Building and Safety, in Lomita, to discuss the matter. The regional engineer said he would attend the meeting of the Planning Commission on Tuesday, March 16 to discuss the matter with the Commission. 'The Council asked to be advised of the recommendations made by the County Engineer on the matter, and further, they asked that the Fire Marshal be consulted, and asked to comment in writing to the Council - ENVIRONMENTAL QUALITY BOARD REVIEW 295 Councilman Pernell, Chairman of the Environmental Quality Board, advised the Council that when the Board was established, consideration of single family residences was exempted from review by the Board be- cause of stringent architectural control which exists,'and subdivisions and other ecological problems were reviewed by the Board. As existing oc buildable lots have decreased in the City, the remaining lots require modifications to accomodate residences, specifically extensive grading, and Chairman Pernell said it is the consensus'of"the Environmental Quality Board that some of these plans should be reviewed by them. The City Attorney was asked to review the guidelines under which the Board operates and make recommendations regarding broader consider- ation of development in the city. Councilwoman Swanson advised the Council that since she has been elected to the Council, she wished to resign as member at large of the Environmental Quality Board, Councilman Pernell suggested that Mrs. Kip Goldreyer be appointed, and the Mayor so order, provided that Mrs. Goldreyer agreed to accept the appointment. CITY COUNCIL APPOINTMENTS 322 The Mayor said committee appointments of Council members would be announced at the next meeting.
