2/24/1958MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALIFORNIA The regular meeting of the City Council of the City of Rolling Hills was held at 7:30 p.m. Monday, 24 February 1958, in the City Hall. The meeting was called to order at 7:30 p.m. by Mayor Goodman. ROLL CALL Present: Councilmen Bullard, Elliott, Tourtelot, Weitzel and Mayor Goodman Others Present: City Clerk Gilbert Myers, Deputy City Clerk -Phyllis Stockdale, City Attorney NTilliam Kinley, Mrs. Margaret Orcutt, Mrs. Vernal Tyler, Dr. -Donald Franks, Messrs. Cole MINUTES_9 MEETING OF 10 FEBRUARY 1958 It was moved by Councilman Elliott, seconded by Councilman Tourtelot, and unanimously carried that the minutes of.the meeting held 10 February 1958.be approved as written. CORRESPONDENCE The City Clerk presented: a. Two letters dated January 280 1958 from the California State Department of Public Works stating that.the quarterly allocation of gas tax funds to Rolling Hills for the period ending December 319 1957 is $1,637.59, and that the 1958-59 estimate of gas tax funds is 6,300.00. b. A report from the Los Angeles County Municipal Court of the.South Bay Judicial District showing distribution of fines_ and .forfeitures for the month of January, 1958. A check for $4.45 has been deposited in the General Fund. c. A communication from the California Disaster Office, Region 1, dated January 29, 1958 requesting :Civil Defense information. d. A letter from the State Department' of Public Health dated February 8, 1958 stating that the City's contract with the Los Angeles County Pound Department constitutes compliance .with the provisions of State Law regarding rabies. CITY BILLS The City Clerk read the register of bills to be allowed. It was moved by Councilman Bullard, seconded.by Councilman Weitzel,; and, on roll call vote by the City Clerk, unanimously carried that Demands 110 through 129 as audited and approved by the City Manager be paid as follows: M Demand No._119 OBrion, Russell and Company Gilbert B. Lambie, County Engr. 25.12 Demand No. 128 Anchor Press 19.07 Demand No. 129 Jack Wood, Plumbing 7.00 Total $-l.,035-19 Mayor Goodman then asked the Council what action it desired to take on Demand No. 130 -in the sum of $2,343.58 representing the money purported to be due and owing to Rolling Hills Community Association from the City of Rolling Hills for the cost of operating the gates for the month of January, 1958 as agreed by the terms of the letter of agreement of the 17th day of December, 1957. Councilman Bullard then moved that Demand No, 130 in the sum of $2,343.58 be approved for. payment. The motion was seconded by Councilman Elliott, In the discussion that followed the City Manager advised the Council that the demand had been audited and was a correct statement of the amount due from the City of Rolling Hills to the Rolling Hills Community Association as per the letter agreement of the 17th day of December, 1957, but that he refused to approve and recommend payment of Demand No. 130 as he was of the opinion that the pay- ment thereof would be an invalid and improper expenditure of the public funds of the City of Rolling Hills. There being no further discussion, Demand No. 130 was unanimously approved for payment on a roll call.vote. Thereafter, the City Treasurer stated to the Council that he would not sign or execute a warrant for the pay- ment of Demand No. 130 in the sum of $2,343.58 or any other sum as he was of the opinion that payment of said demand would be an invalid expenditure of the public funds of the City of Rolling Hills. The City Attorney commented that in view of the fact that the City Treasurer did not intend to pay .Demand No. 130 eventually litigation would result from his refusal, with the Rolling Hills Community Association as plaintiff in that litigation. Mr. Kinley further stated that since he had been counsel for the Rolling Hills Community Association for the past six years he would be unable to represent the City Treasurer and requested that special counsel be retained. The Council decided to act upon this matter at the next meeting. INTRODUCTION OF ORDINANCE NO, 16 A proposed ordinance entitled "An Ordinance of the, City of Rolling Hills, California, Regulating Traffic Within Said City and.Repealing Ordinance No. 1 and All Other Ordinances in'Conflict Therewith" was introduced by Councilman Elliott, who also moved that the reading in full of the ordinance be waived. The motion was seconded by Councilman Bullard and unanimously carried, PERSONAL APPEARANCES - MRS. ORCUTT, MRS. TYLER AND MR. BOOMER Mrs. Orcutt, Mrs. Tyler and Mr. Boomer appeared before the Council to request that Flying Mane Lane be designated as a road'in the proposed traffic ordinance. Mayor Goodman advised them that the ordinance defined a road as a way or place within the City of Rolling Hills maintained without expenditure of public funds by the Rolling Hills Community Association. Further discussion brought out the fact that Flying Mane Lane was not shown on the subdivision map of Southfield and that the Rolling Hills Community Association had not assumed its maintenance by written instrument. Accordingly, the Mayor suggested that the matter be presented to the Rolling Hills Community Association. TRIPLE LANE GATE Mayor Goodman reported that the latest plan for the proposed triple lane gate has been submitted to Mr. Hanson of Palos Verdes Properties and that it would be studied by the companyts traffic engineers. PROPOSED ORDINANCE RE CITY PURCHASING - The City Attorney advised the Council that the 1957 State Legislature had decided that all local agencies should adopt uniform purchasing rules and ordinances. Mr. Kinley said that he had received from the League of California Cities two proposed forms to cover this subject and that he would have a draft ordinance prepared for the next meeting. RESOLUTION N0,._ 50 Thereupon, after discussion in which all Councilmen participated, and, after approval by the City Attorney, Resolution No. 50 entitled 'A Resolution of the City of Rolling Hills, County of Los Angeles, State of California, Endorsing the Statements of Principles with Respect to State Wide Nater Development Adopted by the Feather River Project Association and the Southern California Nater Coordinating Council" was, on motion made by Mayor Goodman, seconded by Councilman Weitzel, and, on roll call vote by the City Clerk, unanimously adopted, Resolution No. 50 is set forth in full in the Book of Resolutions. ADJOURNMENT There being no further business -to come before the meeting, it was moved by Councilman Elliott, seconded by Councilman Bullard, and unanimously carried that the meeting be adjourned at 8:50 p.m. City Clerk APPROVED* Mayor 1
