Monday, July 12, 1976 at the Adminis- tration Building, 2 Portuguese Bend Road, Rolling Hills, California. Nahrwold Joan Saffo Roy Sinclair City Manager City Attorney Secretary League of Women Voters Resident It APPROVAL OF MINUTES A motion to approve and accept the minutes of the meeting of June 28, 1976 was made by Councilman Heinsheimer, seconded by Council- woman Swanson and carried by the following roll call vote: AYES: Councilmembers Crocker, Heinsheimer, Swanson NOES: None ABSENT: Mayor Rose ABSTAINED: Councilman Pernell RICHARD Po NAHRWOLD, 74 PORTUGUESE BEND ROAD 1555 In a letter dated June 28, 1976 Mr. Richard P. Nahrwold advised the Council that he and his neighbors, Dr. and Mrs. Richard Hoffman, are very much concerned about the condition of the fire road which divides their properties at the south boundary of the City, because of the trash being dumped. Mr. Nahrwold said it was his understanding that the road is built on his easement and the Hoffmans'; they are willing to permit the continuation of use of the easement for the benefit and protection of the City, and he asked that the City assist in eliminating the offensive condition of the road, Mr. Narhwold appeared at the meeting and advised the Council that another matter of concern is use of the fire road by cars from within the City which often become stuck in the road, causing a great deal of noise and nuisance in getting them free. He said that Dr. and Mrs. Hoffman, who are away on vacation, share his concern. Mr. Nahrwold asked that a stout chain be installed across the road where it leaves Portuguese Bend Road, approximately 300 feet north of the existing fence, so people who walk in the area would not be deterred. Further, Mr. Nahrwold said that if City personnel clear the area, he will con- tinue the maintenance of his portion of the fire road, hiring the necessary people to do the work. Councilman Pernell said that easements are under the jurisdiction of the Rolling Hills Community Association, and the cost of clearing 3 July 12, 1976 the road may not be a reasonable expense for the City. Mrs. Clifton said part of the easement is owned by Palos Verdes Properties, and she would contact them on the matter. Mayor pro tem Crocker said the problem is an administrative matter, and asked the Manager to contact the property owners involved and attempt to reach a solution.to the problem. ROLLING HILLS ESTATES - PALOS VERDES DRIVE NORTH COMMITTEE 1663 A notice dated July 2, 1976 from the City of Rolling Hills Estates was presented to the Council. Mr. Harry R. Peacock, City Manager, advised that the Palos Verdes Drive North Committee would meet on July 14, 1976 at 7:30 P.M. in the City's Council Chambers to review the final report of the consultant pertaining to Los Angeles County's proposal for the widening of Palos Verdes Drive North. Councilman Crocker requested that all residents of the City who live on Palos Verdes Drive North and will be directly affected by the proposed expansion be advised by telephone of the meeting, and said he planned to attend. Councilwoman Swanson said she would attend also. The matter was held on the agenda. EMERGENCY DISASTER PLAN 1701 Councilman Crocker said he had discussed with personnel of Engine Company 56 in the City of Rolling Hills the need for a good emergency disaster plan, and asked whether the Council could do anything to aid the fire department, specifically with an aerial photographic disaster map showing fire hydrants and -other vital information. He was assured that the Fire Department has everything they need in an emergency sit- uation, including reflectorized house numbers and the City's require- ments for spark arrestors, brush and weed clearance and fire retard- ant roofs. Councilman Crocker suggested that a survey of skills be made, so that in an emergency persons with special knowledge of animal handling, as well as young people who could water roofs, could be contacted. The Manager said that a grid plan of the City was developed after the fire in 1973, a blood bank has been started, and she will proceed with the survey of skills. Councilwoman Swanson requested that the matter be held on the agenda, and the Mayor pro tem so ordered. BUDGET, FISCAL 1976/77 1744 Councilman Crocker requested that the revised budget be presented at the next meeting of the Council. SOUTH BAY BURGLARY TEAM 1763 The report of the South Bay Burglary Team for May 1976 was re- ceived and filed. CITY OF DUARTE 1768 A letter dated June 30, 1976 from the City of Duarte, advising that the City Council has unanimously voted to support Councilman Donald Watson as a candidate to fill the vacancy on Corridor 'D', Rapid Transit District, was received and filed. PAYMENT OF BILLS 1886 Councilman Heinsheimer moved that Demand No. 5477 in the amount of $500 be voided until the Council determines whether there is a deficit in monies made by the Bicentennial Committee at the Fourth of July Celebration, and that Demands No. 5471 through 5498, with the -2- July 12, 1976 exception of No. 5477 be paid from the General Fund. The motion was seconded by Councilwoman Swanson and carried by the following roll call vote: AYES- Councilmembers Heinsheimer, Pernell, Swanson Mayor pro tem Crocker ABSENT: Mayor Rose ORDINANCE NO. 112 1937 Mayor pro tem Crocker opened discussion of Ordinance No. 112, passed in November 1972, which has not been enforced, to determine what action the Council should take with regard to validating or in- validating construction for which permits have been issued since the ordinance was adopted, and which are in violation of the ordinance. A letter dated July 9, 1976 from Mr. William Kinley, City Attorney, ;r stating his legal opinion on the matter was presented to the Council. '"Z Further, Mr. Kinley advised the Council that it was his recommendation :7) that they instruct the Planning Commission to hold hearings as soon as possible, and in one evening grant conditional use permits for those tennis courts, swimming pools and riding rings for which conditional use permits had not been obtained as required by Ordinance No. 112. Mayor pro tem Crocker asked whether the Council has the authority to grant blanket approval of the construction, and Mr. Kinley said he has been unable to find authority by which- the Council could go so far as to take such action by curative act. An ordinance could be passed which would rescind Ordinance No. 112 in whole or in part, to take care of future cases, but some action is necessary to cover cases where permits were not obtained as required by ordinance. Councilman Heinsheimer asked whether a special hearing, properly noticed, could be held to cover cases, past and pending, on a list supplied by the Architectural Secretary of the Rolling Hills Community Association, and Mr. Kinley said such a special hearing could be held, and could include pending cases, including Mr. and Mrs. C. E. Gregory, who ad- vised in a letter dated July 10, 1976 that.their loan commitment with California Federal Savings Association is binding through July 30, 1976 and action is imperative before that time so that they can obtain their building permits and complete the loan transaction. Councilman Heins- heimer said the persons who have completed their construction should be relieved of requirement for paying a fee, and Mayor pro tem Crocker agreed, since the City did not enforce the ordinance, and residents proceeded because they understood that they were in compliance with all requirements. The City Attorney asked that the record show that the fee will be waived in specific cases where the improvement has already been made, and where there was no need for other conditional use permit. Further, Mr. Kinley asked that his legal opinion on the matter of Ordi- nance No. 112.in his letter dated July 9, 1976 be forwarded to the Planning Commission. .. Following the discussion Councilman Heinsheimer moved that the Planning Commission be asked to meet as soon as administratively pos- sible to review all permits issued in accordance with a memo dated July 9, 1976 from Peggy Minor, Architectural Secretary in -the following categories: Tennis Courts, Riding Rings, Pools; with the exception of the last swimming pool listing, Fieger, for which no Association permit has been issued, and further excluding pending tennis courts and pending pools; that the Planning Commission review all those cases, including cases for which Conditional Use Permits have been issued for other reasons, correct the record at.the earliest possible date without re- quiring payment of any fees or additional fees by the parties involved.. The motion was seconded by Councilman Pernell and carried by the -3- 163 y `D July 12, 1976 following roll call vote: AYES: Councilmembers Heinsheimer, Pernell, Swanson Mayor pro tem Crocker NOES: None ABSENT: Mayor Rose Councilwoman Swanson said she would attend the next regular meeting of the Planning Commission on Tuesday, July 20. With regard to enforcement of Ordinance No, 112, Mayor pro tem Crocker said that"a public hearing should be scheduled for the first meeting at which all members of the Council expect to be present, prob- ably in late August or during September, and he ordered that the matter be held on the agenda. Mr. Kinley said he would prepare a memorandum on the constitutionality of specific requirements in certain ordinances of the City of Rolling Hills. In the matter of the request by Mr. and Mrs. Gregory, Councilman Heinsheimer.sugges•ted that.the Planning Commission be asked to hear the matter before August 1 and render an immediate decision if possible. Councilwoman Swanson suggested that the Commission be asked to make a field trip before the hearing, in view of the critical date. Mayor pro tem Crocker asked the Council whether they would be willing to recommend to the Planning Commission that -they consider the matter with the same urgency and consideration as they would in considering-- swimming pools and tennis courts which have already been built. Councilwoman Swanson said she would. Councilman Pernell said the Council should call their attention to the time limitation, without stressing the urgency.. Coun- cilman Heinsheimer said the Gregorys' letter should be sent to the Plan- ning Commission and they should be urged to have the meeting as soon as possible, but special instructions in this case could affect other pend- ing cases. Mayor pro tem Crocker agreed that the Commission should con- sider the factual question of whether the proposed tennis court would have an adverse effect on the Community. Mr. Gregory advised the Council that he and Mrs. Gregory have delayed departure on their,vacation, and plan to leave on July 13 and return the 27. Councilman Pernell said that given legal requirements for giving the notice, the special meeting could be held on the 27. TRAFFIC AND SPEED CONTROL 186(2) Councilman Crocker asked that the Manager contact the Automobile Club and determine when the meeting with representatives of Rolling Hills can be held in connection with the Auto Club's proposed study of traffic and speed control in Rolling Hills, and he asked that the meeting be scheduled before the end of the month, if possible. TREES ON CREST ROAD 190 Mrs. Clifton explained that when the Council expressed concern about the size of the holes which would result from use of a 14" auger, she determined that a 6" auger was available, but it is hand driven and sould not be practical for the use intended. The Manager said that alternatives, such as drilling the large hole and filling it with gravel rather than with mulch, are being considered. Councilman Heinsheimer suggested that a few test holes be made and observed. SOUTHERN CALIFORNIA RAPID TRANSIT DISTRICT 200 Councilwoman Swanson reported that unofficial information related to her indicates that the buses are used extensively by young people -4- July 12,1976 on the Peninsula. Councilwoman Swanson and Mrs. Dorothy Le Conte are working ont-;a,s°implified schedule for residents, showing ways .to get around th6-pen-i sults by bus•-i'usingg ,transfers, and the schedule and transfer information would be sent to all residents in the near future, Councilwoman Swanson said. ,BICEIITENNIAL,'CELE-BRATION,-LIABILITY INSURANCE 211.1, A letter fromrCal-Surance regarding insurance coverage or the, Bicentennial Cehebratiyon:was :received and ifiled, -and the -it -em was removed from the agenda. ANIMAL, -SERVICES -AGREEMENT .219 The City Attorney reported that in the absence of objections by members of %the Council prior to the time limit set at the last meeting, the Animal._"Services Agreement -had .been executed :and returned to the County. MRS.*VIRGINIA GIBSON, 3 MEADOWLARK LANE 235 Mrs. Gibson addressed the Council on the subject of property taxes and'lcommunity­serviceg,. -Since.-the cost of many services such as electidn requirements -and health' services are being borne..by the - property owners, Mrs. Gibson:�said a: broader base: is.,necessary than is .- . being.provided by property taxes, and she asked whether anything can be done or is being done by the.Council to keep property.taxes;from accelerating. .i.. i CouncilmanHeinsheimer said -that Cotinci.lwoman;::Swanson:participated in local -efforts to appear. before the Board,: of-: Sup.ervis.ors to- protest the rise. in.. 16ca-1 property taxes, but there has been: -no , relief in. the tax rate; in, spite: of assurances by the Board .of , Supervisors._; that of forts would be made to control the taxes. Councilman Crocker said responses.to'a recent.questionnaire indicate that residents are inter- ested in holding down expenditures, and he thanked Mrs. Gibson for her appearance before the Council. R. E. HALL, 16 OUTRIDER ROAD 28.2 Mr. Hall advised the Council that he recently was stopped in a long line of traffic on Palos Verdes Drive North at Eastfield Drive, and was endangered by a driver who approached the rear of his car at high speed. Mr. Hall requested that the Council look into the possi- bility of installing a left turn lane on Palos Verdes Drive East. Mrs. Clifton explained that funds available to the City of Rolling Hills had recently been allocated to the City of Rancho Palos Verdes for construction of a left turn lane in that location. Councilwoman Swanson_ said�she would be meeting with the Mayor of Rancho Palos Verdes, and -would pursue the matter and advise Mr. Hall. LOITERING AND CURFEW ORbINA.NCE 323 Mayor.:.pro.tem Crocker said he was called by the Sheriff late Saturday evening regarding a large number of people who entered the City without proper invitation, and were gathering at the location of a party,�which was in progress. The Sheriff suggested, and Councilman Crocker proposed, that the Council consider adopting an ordinance to -5- July 12, 1976 control loitering and impose a curfew, to be implemented when no other ordinance,is being violated. Councilman Pernell said he felt such occurrences are rare, and he would be against more legislation. Councilwoman Swanson agreed that the Sheriff should be able to control such instances. BLEARING OF EASEMENTS, DR. W. 'D.' BASQUE, iASTFIELD DRIVE- + 353 Councilman.�Crocker. 'said•,that 'Dr. Basque had appeared at :the last Council meeting to request that other easemerit§ in.the City be cleared the way Eastfield Drive easement was cleared last year, and he asked for recommendations-from'the Council. Councilwoman Swanson asked that Chuckwagon Road be considered, and Councilman.Crocker said he felt that Southfield Drive could also be considered, and possibly both easements could be cleared, using -funds; -remaining in,the budget, in addition to funds to be allocated this next-- fiscal,- year. Mrs. Clifton said she plans to meet with Mr. Forrest Riegel, Trails Chairman and Mr. Joe 011a, President of Caballeros, and would discuss the request with them, as well as with the Board of Directors at their next meeting on,Thursday. ABSENCE FROM COUNCIL 365 Councilwoman Swanson said she would not be present at the next meeting of the Council in July, and Councilman Heinsheimet said he may be out of'the City at that time. Mr. Kinley said he would not be present at the next meeting,. and Councilman Crocker said he will be away during August, and would not be at the first meeting of the Council. CITY TREASURER 370 The Manager was asked to have a plaque, appropriately engraved, prepared for present4tion at the next meeting to Mr, Douglas Rogers, who is resigning as City Treasurer.. CRENSHAW GATE IMPROVEMENT '375 In a letter dated July 8, 1976, Mr. John G. Davidson, -President of the Board,-of.Directors pf the Rolling Hills Community Association advised the Council that the Board received results of a community survey conducted with regard to installation of a third entry 'lane at :;"the Crenshaw Gate. The survey indicated that a majority of residents do not wish to have another entry lane, and the Board has returned funds advanced by the Women's Community Club for the project. Further, Mr. Davidson said that the gatehouse is badly -in need of repair, and bids are -currently being received to refurbish the building and beauti- fy the area. PERSONNEL; SESSION 396 The meeting was adjourned at 9:30 P.M. to a Personnel Session to discuss -salari-es .
