The motion was seconded by Councilman Pernell and carried by the following roll call vote : AYES : Councilmembers Crocker, Heinsheimer, Pernell, Swanson Mayor Rose NOES : None ABSENTa None DRIVEWAY RELOCATION, CURTISS SCARRITT, 2 EUCALYPTUS LANE 34 Mayor Rose opened discussion of a request by Mr, and Mrs . Curtis Scarritt for relocation of an existing dual driveway on Eucalyptus Lane to a single driveway on Portuguese Bend Road. The matter was held on the agenda from the last meeting to give members of the Council an opportunity to malce a field trip to the site. A sketch of the Scarritt property, showing the present configuration and the proposed drive�ray was displayed, Mrse Scarritt advised that she had brought her parents , Mr. and l�irs . 0' Connor9 who are visiting her, because they agreed with Mr. and Mrs. Scarritt that a dangerous condition exists because of the grade of the driveway and the limited turning area. Mrs . Scarritt said her children9 as well as other children in the neighborhood, ride bicycles � � Q� . October 11 , 1976 and play on the paved area, and she feels that the steep grade of the driveway endangers themo Further, the incline makes it impossible to see Eucalyptus Lane while exiting from the propertye Mrs . 0' Connor said she feels the hazard is � compounded by other children, whom the Scarritts do not know, using the driveway for skateboa'rdinge Mr, 0` Connor said the driveway has a 35% grade, and the combination of -the grade and a retaining� wall .make it .virtually impossible to enter or leave in a large car without making more than one turne Councilman Crocker said he had visited the property, and although he..�agreed that the design of the driveway is poor, he said �the area' of �limited visibility is v�ry small, and the situation could be corrected by trimming, pruning an�d possibly removing some of the large eucalyptus trees , and the result would be safer than creating an additional drive- way on Portuguese Bend Road, The Manager explained �that three families take access from Eucalyptus Laneo Mayor Rose said he had driven through � the Scarritt property in his large car, and he suggested that proper �. placement of a traffic mirror could improve the visibilitye Councilman � Pernell said he was of the opinion that changing the access to the pro- � ,� perty from Eucalyptus Lane to Portuguese Bend Road would exchange a °� limited accident potential for a greater accident potential, and he said � i,t has been the policy of the Planning Commission and City Council to l�.mit the number of portals on major roads , and to discourage addition of more driveways if an alternative could be providede Councilwoman Swanson said she would like to make a field trip to the �site in view of the additional testimony presented about the Scarritts ' concern regarding. safety, Councilman Heinsheimer suggested that a service might be available to the Scarritts by the Automobile Club, to advise on the safety of the present situation, and acceptable alternativeso Mrse Clifton said she would contact the Automobile Club to determine whether the service is available to residents . F:o,llowing the discussion Mayor Rose said it is the consensus of the Council that an additional driveway on Portuguese Bend ,Road would not be acceptableo Councilman Heinsheimer �moved that the Council' s policy against adciitional ingress and egress on Portuguese Bend Road be rein- forced, and that the request be denied< The motion was seconded by Councilman Crocker and carried by the following roll call vote : AYES . Councilmembers Crocker, Heinsheimer, Pernell , Swanson Mayor Rose NOES: None ABSENT: None TRACT 31906 , ROBERT STANDER, 11 SADDLEBACK ROAD 150 The tentative tract map and excerpts from the minutes of the Planning Commission meeting on September 21, 1976 were distributed. Councilman Crocker said a comment in the minutes about concern ex- pressed about the size of the new lot and the requirement that a 50' setback be required on the new lot would have no bearing on approval of the tract, siric'e the lot conforms with requirements for the .RAS-1 Zone in which it is located. The Manager was directed to request .that the 50' set back be shown on all maps presented to ° the Council:o . � Mayor. Rose said a field trip to the site would be held on Sunday, September 17 at 9 : 00 AeM, , and Mro Stander advised that all stakes � required would be in placeo Councilmembers Fernell and Swanson said � they had visited the site as members of the Environmental Quality Board, .and :would not be present, The matter was held on �the agendae -2- h-.. � ' N '� � � � � / f � � October ll, 1976 POLICY, SQUARE FOOTAGE OF TENNIS COURTS 266 Mro Mike Burke, 70 Saddleback Road, advised the Council that he had submitted plans for a tennis court and swimming pool as part of the total .development of hfs property a� 33 Crest Road East to the Planning Cominission for a conditional use permit as required by Ordi- nance Noo 112, and had included computations of lot coverage as re- quired by Ordinan�e Noo 137o In reviewing the plan, Chairman Riegel stated that although the actual figure for the tennis court was 7 , 010 square feet, for purpo�es of the eomputation of lot coverage, the tennis court would be considered by the Planning Commissfon to be 7 ; 200 square feeto Mro Burke said the eorners of the tennis court had been clipped at the reeommendation of the Architectural Committee, since the Committee stated that the result would be less rigid and more esthetically pleasingo He asked for a clarificati�n regarding the figure used in the computation of lot coverageo Mayor Rose said his interpretation would be that the actual square footage of the tennis court would be the correct figure to use and he aslced the City Attorney to commento Mro Kinley said it was his opinion that the Planning Commission could not arbitrarily consider 7 , 010 square feet to be 7 , 200 square feeto Couneilman Crocker said tennis courts with clipped corners in a eertain eonfigura�ion would be acceptable, but he would be opposed to accepting sub-standard tennis courts so the applicant could be within the approved l�mit of lot coverageo Couneilman Pernell agreed, and said a specification for minimum dimension for a tennis court should be determined, since fenees 10 or 12 feet high are approved only for tennis courts9 and a specification for a minimum design which is acceptable to all bodies �onsidering the plan should be developedo Council`aoman Swanson suggested that as part of the study requested by the Council for presentation by December 1, the Planning Commission be asked to establish a definitian o�' a regulation tennis court o Council- man Pernell suggested that in addition the Planning Commission be asked to make recommendations regarding the limi.� of fence height surrounding p�.ved areas other than tennis courts , such as areas used for handball, badminton, bas`ket ball practice9 roller skating, etco , and also the limitat�ons on sueh paved areas , should they be submittedo Mayor Rose asked that the Planning Commission be providecl with copies of the Council' s discussion at their next regular meeting on October 190 Councilwoman Swanson said she would be out of town on the Planning Commission meeting date , and would miss the meeting, as well as a special meeting the Chairman advised her might be scheduledo Councilman Crocker said he would attend one of the meetings , and Council- man Pernell said he would be available to attend the other meeting if needeci o T"ITLE I, PUBLIC jnTORKS ENIPLOYMENT AC� OF 1976 454 The Manager reportecl that she wishes to file a notifi�ation of appl�cation for F°ederal funds under the Public Works Employment Act of 1976 recen�ly �igned into law by the president for drainage lines and �truetures in the Cityo The Manager was authorized to proceed, and wa� asked to keeg the Council informed on the mattere APPOINTMENT TO SOUTH COAST AIR QUALITY MANAGEMENT BOARD 484 Mayor Rose and other members of the Council congratulated Coune�lman Heinsheimer on his appointment to the newly formed South Coast Air Quality Management Boardo Councilwoman Swanson said s.he was present at the meeting of the City Selection Committee of the League of California Citfes' at which the appointment was made by acclamationo � _3� � � �� . October 11, 1976 FORMATION OF° A NEW SOUTH BAY COUNTY 508 Councilwoman Swanson reporteci that at a recent meeting of the South Bay Cities Association she had advised that she was authorized as representative from Rolling Hills to vote to participate in a feasibility study regardir�g formation of a new county if she deter- m�ned that the study would be an unbiased study conducted by an objec- tive, non-par�isan source at reasonable costo Mrso Swanson said she was advised that the feasibiTity study was eompleted about one year ago by Coun�ilmen John Anderson of Rolling Hills Estates , Gunther Buerk of Rancho Palos Verdes and Hank Doerfling of Hermosa Beach, and a copy was sent to Rolling Hills at that timeo Councilman Swanson reported further that no vote was taken at the meetingo She explafned that representatives of six beach cities would begin collecting signatures on October 18 for a petition, and Torrance and Palos Verdes Estates have indicated that they would join in that efforto Other South Bay cities are considering � similar action, and a committee under Rancho Palos Verdes Counci�man M� Robert Ryan has proposed forming a county consisting of the three contraet � cities on the Peninsula; Rolling Hills , Rolling Hills Estates and Rancho '� Palos Verdese Copies of a letter from Councilman Ryan were distributed �` to the Councile �� Mayor Rose thanked Couneilwoman Swanson for her report, ancl sug- gested that the Council observe the effor�ts of Canyon County which, if successful, will encounter all the problems involved in forming a new countya F"urther, Mayor Rose said he would recommend that the Council eontinue to abstain in the matter of forming a new county, and should join in the effort only if there is strong evidence that a substantial reduct�on in taxes would resulta Councilman Heinsheimer said there would be more local control, but no aetual saving of money. He �aid more time and effort should be devoted to correcting the problems in the existing countye � LETTER FROM MRSe Fo Bo ANDRANIGIAN, PACKSADDLE ROAD EAST 589 Mrsa Clifton reported that she had discussed with Mrs < Andranigian a letter she wrote to the Council and Mrse Andranigian requested that no action be taken at this time> Mayor Rose said he had been advised that a tennis court on East- ffeld Drive is being used commerciallyo The Manager said she had re- ceived complaints a few years ago , and had discussed the matter with the resident and the problem had been resolved. New reports and com- plaints have been received recently, she saido The Manager was directed to contact the resident and advise tha� renta.l of a tennis court , whether to residents or non-residen�s , fs not permitted, and will not be tolerated by the Councila Councilwoman Swanson said she had been told that there is a traffic problem in the area being discussede The Mayor directed that the Sheriff be asked to patrol the area and issue citations if the law is being broken by cars being parked on trails and easementso QUARRYING AND SE�LING ROCK 627 Councilman Heinsheimer asked whether sale of rock unearthed during construction was in violation of the ordinance whieh prohibits commer- cial activityo The City Attorney said it was his opinfon that one transaction does not constitute commercial activity, and sale of rock uncovered in the process of excavation for eonstructit5n would not be in violation of the intent of the ordinancee PAYMENT OF BIZLS 735 Councilman Crocker moved that Demands Noo 5671 through 5717 , with the exception of Demand Noo 5703, which is void, be paid from the General Fund in the amount of $23 , 918072o The motion was seconded by m4_ �� � � October and make a report to the Councilo The Manager was directed to send copies of the report to the Sheriff and Fire Department, and ask for their comments , and to advise resi- dents that a copy of the report is available for review in the office. l�Irso Clifton said Mro Gary Foxen, Automobile Club representative , would attend the next Council meeting, and would make a slide presen- tation as part of his report to the Councilo The Manager was in- structed to include a notiee of the meeting in the next Newsletter to residentso PUBLIC UTILITIES COMMISSION HEARING 842 Mrse Clifton reported that a Public Utilities Commission hearing on a request by California Water Service Company tor an increase in rates was held in the Council Chambers of the Rolling Hills City Hall on Wednesday, Oetober 6e Presentations were made by City Attor- ney Richard Terzian of the City of Rolling Hills Estates , Councilman Robert Ryan of Rancho Palos Verdes and Mrso Cliftono The Manager x°eported that she had reviewed the material furnished by the Public Utilities Commission, and had advised at the hearing that the information was not in a form easily understood by laymen, and she requested that in the future exhibits and information be made available prior to the hearingo Mayor Rose asked that the record show that the Council recommends that in the future presentations be put into summ�ry form by legisla- tive analysts , so they ean be readily unclerstoodo Councilman Pernell suggested that letters be sent to the Public Utilities Commission, SCAG, the Governor, and to cities which had representatives at the hearingo Mayor Rose directed the Manager to send an appropriate letter9 since she was at the meetingo R�,PID TRANSIT DISTRICT 927 Couneilwoman Swanson reported that there has been a decline in use of buses since the reeent strike, and she said efforts will be made to promote the serviee through the press and other meanso ADDITIONA`L TENNIS COURTS 944 Councilwoman Swanson said she had been advised that the Tennis Club is considering, purchase of additional land for tennis courts , and she asked that the City Attorney prepare info�:mation for the Couneil outlining the Council' s responsibilityes in the matter, and the methods of financing available< Mayor Rose said he had attendecl meetings on the mattery and several alternatives for financing have been considered, PROPOSAL Mayor Rose said he had been advised that Caballeros Plan for expenditures for capital improvements is being finalized for presen- tation to the Planning Commission and City Councilo � RESOLUTIONS FOR LEAGUE OF CALIFORNIA CITIES MEETING 1036 � , �� Councilwoman Swanson reported that 83 resolutions have been a prepared for presentation at the annual League of California Cities �� eonvention in San Diego October 17-20o A brief summary of resolutions of interest to the Council was provided and Councilwoman Swanson asked members of the Cotxncil to call her if they wished to comment on any of the resolut�onso Mayor Rose asked the City Attorney whether he would advise that Council�roman Swanson be authorized to vote on behalf of the Council in matters involving expenditure of funds , and the City Attorney said he would recommend that Councilwoman Swanson be authorized to vote on behalf of the Council, but that on matters involving commitment of money, she be required to consult with the Councfl first.
