11/29/1976MINUTES 6 V -AN ADJOURNED MEETING OF THE CITY COUNCIL OF ROLLING -HILLS -AND THE BOARD OF DIRECTORS OF THE ROLLING HILLS COMMUNITY -ASSOCIATION CITY OF ROLLING HILLS, CALIFORNIA November 29, 1976 An adjourned meetizig of the City Council of the Cit of Rolling Hills and the Board of 'Directors of the Rolling Hills Community Associa- tion was called to order at 7:30 P..M.,Monday, November 29, 1976 by Mayor Rose and President Davidson at the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California. Resident Resident Resident Residents Resident Resident Property Owner Mayor Rose and President Davidson presided at the meeting to dis- cuss informally items of business which are of mutual interest to both bodies. TENNIS COURTS - Joint Jurisdiction 1-1 Mrs. Teena Clifton, City and Association.Manager, was requested to review administrative procedures for filing construction plans with specific focus given to development of a tennis court. She said that .upon initial contact by a property owner, a copy of the Association Building Regulations as well as City Ordinances Nos. 112 and 137 are given to the applicant. The applicant is informed that properly de- signed plans must be approved by the Architectural and Landscape Commit- tees of the Community Association and that a Conditional 1 Use -.Permit is required from the Planning Commission of the City under Ordinance No. 112. Meeting schedules of the Committees and Planner Commission are discussed with time limitations explained by the necessity §'ity for field trips and legal notice publication and mailing. Applicants are advised that there are concerns. -in the community regarding development of November 29, 1976 tennis courts and the effect upon the rural nature of the community. Mayor Rose asked if the Architectural Committee has the power to disapprove of a tennis court if all other requirements -are met. Mrs. Clifton stated that the Committee has that responsibility and has dis- approved tennis court construction in the past with the most recent disapproval:. being on November .15, . 1976. ~President Davidson expressed .a desire.to simplify procedures for residents in filing for swimming pools and tennis courts under Ordinance -No. 112 -and recommended that all matters relating to esthetics including development of tennis courts or other recreational facilities be con- trolled by the-As-sociation through its Architectural and Landscape Committees... He referred to the Basic Philosophy adopted by the Board and- City in 1974 with the Association responsible for controlling and maintaining entrances, roadways-; re-creat,ional-facilities and regulating architectural and land use with the City -responsible for all municipal services. In the discussion the question was raised as to why the Architec- tural Committee instead of the Council couldn't hear applications for tennis courts. Councilwoman.Swanson said that design of structures which are results of architectural creativity by owner and architect should be 1 reviewed and approved by the Architectural Committee; however, she felt that there was nothing architecturally creative about a tennis court, therefore it is strictly a;matter of land use rather than ar- chitectural, and is under the jurisdiction of the Council. Mayor Rose stated that'he saw no conf-lict with the responsibility of each body as def ined in that the City Council is involved with the environmental impact of the adjacent properties and has areas of which it has unique concerns with certain areas of responsibility overlapping between the City and Association. Various methods of administration and guidelines were discussed by C•ouncilmembers, Directors and Nicky Field, Architectural Committee Chair- man. Mr. Davidson suggested that in an effort to further explore the matter in depth and develop a general philosophy, a committee be formed of the Mayor, President of the Board as well as one .other member of the Board and Council. Mayor Rose appointed Councilman Crocker to serve with him on the Committee and Mr. Davidson stated that a member of the Board would be appointed at the next Board meeting. REAL ESTATE BROKER ADVERTISING 1-680 Mayor Rose presented an advertisement in the November 28th issue of the Palos Verdes News listing a home on a 1 -acre parcel as suitable for a tennis court and pool construction and expressed concern that prospective buyers of Rolling Hills property are being misled by erroneous information. The Manager stated that the broker would be contacted immediately concerning the ad with a full report made to the.Council and Board. Mrs. Saffo stated that two meetings have been held with brokers concerning their practices in Rolling.Hills with specific circumstances investigated by the Board and -in one instance a permit to work in the City had been revoked. TENNIS COURTS - COMMERCIAL ACTIVITY 1-780 The City Council and Board members discussed use of 'resident tennis courts with relation to commercial activites and following the discussion, agreed that renting Rolling Hills tennis courts is strictly forbidden by,the City and Association, charitable uses should -2- -39 November 29, 1976 be on an occasional basis only with the privilege not abused and with consideration given to neighbors; adequate parking should be provided for guests and gate security procedures followed by issuance of party passes and lists of guests provided at the gates; tennis lessons to be con9'iPed;;tp;:,Aolling Hills residents except in the . "gray";1.area situation where i the. pro is being utilized .by the. resident .and:-hisguest; it, -"not being the policy of the C ity'and Association to strictly police the, courts; .however,. any violations broiight..'to' the,attenton of the Board and City Council shall be acted upon promptly. ,-Mrs. Saffo .stated that the Bylaws had recently been rewritten after much.study and consideration by a Committee and as the Associa tiiop�;Board represents the property owner, not the resident, the matter was not appropriate for discussion at a public 'Meeting. ,,:President Davidson stated that the Board is responsive to Mayor Rose's comments and that the matter could be discussed at the Board's next meeting on December 2, 1976. ` TRAFFIC CONTROL 1!107:1 Exp.lorin�, Routing, of....uisi.to.rs..Through..Main.Gate Only Mayor Rose reviewed that a public hearing had been held recently concerning traffic problems on Eastfield Drive and one of the suggested solutions to traffic entering Eastfield Gate and passing through the City exiting through Crenshaw Gate was for all guests to be routed through the Main Gate only, exiting through any gate they desired. Opposition to the proposal was expressed by al,l members of the Council and Board with the matter ordered held for further discussion', by the Board of Directors in an effort to tighten security at the gates. It was suggested that possibly additional security officers could be assigned to the gates during peak hours of 7 to 9 A.M. and 3 to 5'P.M. utilizing the new communication system to check on cars passing through Rolling Hills. Speed Limits 1-1224 The Mayor discussed a report completed by AAA, recommending that a speed limit study be made on Rolling Hills roads. The Manager stated that she had recently met with Robert.Kerr to.study the speed limit. -3- The Board and City Council both affirmed the,policy to not be responsive to unsigned letters. The City Attorney recommended that a' condition of use bez.attached to approval of a conditional use permit by the Plann ng,Comm scion that the court shall not be rented commercially. Following discussion by the Council members, Mr..Kinley was directed to prepare a draft of the resolution for consideration by the Council. I;President Davidson Spoke, for members�of -the Board,'stating that tike hoard had`nq'c'ompl'aints regarding established speed limits. Side Road Striping; 1v 1312 Striping on the outside of roads was discussed and ordered held on the agendas of the Board and City Council for further study with the Manager to provide recommendations of selective areas'to the Council and Board. Reflectors 1-1320 All members of the Board and Council agreed that road reflectors were excellent and should be used wherever possible. PARCELS WITHOUT BUILDING SITES 1-1345 ..... ....... Mayor Rose stated that an applicant had recently applied directly to the City Council for a Certificate of Compliance for a residence and parcel; the parcel and residence being contiguous to an unimproved par- cel under the same ownership. The certificate sought would provide that the parcel with the residence should be decided as a lawful divided parcel without the benefit of subdivision and would further provide that the steep unimproved parcel with no access by road, to be a land- locked building site. The Mayor said that the request was rejected by the Council on the basis that the matter had not gone through the Planning Commission as well as the Association under the established subdivision requirements. Mr. -William Kinley, City Attorney, stated that effective January 1, 1977, an amendment of the Subdivision Map Act provides that miscel- laneous parcels that have been created but not subdivided that were deeded out separately will be automatically considered as lawfully divided parcels and no longer subject to the subdivision act requirements. The Board and Council affirmed the policy that parcels not be created in the future that are not buildable sites. RURAL CHARACTER OF ROLLINGHILLS 1-1412 The Board and Council reaffirmed the position that canyon areas be preserved in a natural. undisturbed condition. Councilman Pernell reported that an.Ordinance is being proposed to prevent the disturbance of more than 4,000 square feet of lot area without a grading permit. Mayor Rose stated that the matter would be further discussed by the Council at its next meeting. ANNUAL ROLIDAY PARTY 1�-1500 President Davidson extended a warm invitation to the official Rolling Hills "Family" party at his home on'December 19, 1976. -4- SALVATION ARMY BAND - CAROLS November 29, 1976 1-1580 The Manager reported that she had been contacted by Mrs. Ed Lyle of the Rolling Hills Tennis Club requesting permission to have the Salvation Army Band play holiday music at the Main Gate area on the evening of December 22, 1976 beginning at 8:00 for approximately two hours. Following discussion, Councilman Pernell expressed the only opposition to the proposal, stating that he did not believe it is a good policy to bring in an outside entertainment or welfare organiza- tion as there is a lot of competition in the area.of-Christmas with regard to jurisdictional disputes. SPECIAL PRESENTATION - A. E. HANSiON 1-1585 Mrs. Clifton stated that Mr. -A. E. Hanson, the former general manager of the Palos Verdes Corporation at the time Rolling Hills was developed has written a history of Rolling Hills for the period from �1-4 February 1930 through December 7, 1941. She presented the only copy of the book which included many photographs, stating that Mr -Hanson requests that if it is the wish of the Board or City to publish the book, the copyright be retained in his name to preserve it for his grandchildren. Mayor Rose and President Davidson directed that a letter express- ing the deep appreciation and gratitude of the Board and Council be sent Mr. Hanson for preserving the history of the community as only he could have. It'was further suggested that a plaque be presented to him and that a satellite park might be named in his honor. Mayor Rose requested that the price be explored for printing the booklet for distribution in the community. NEIGHBORHOOD MEETINGS 1-1691' Mrs. Saffo reported that the Women's Club will again coordinate neighborhood meetings beginning the second Thursday in February with the first meeting scheduled for the Crest Road/Buggy Whip area. Mayor Rose stated that he thought the meetings were very benefi- cial and asked to be called the day before the meetings. LIGHTED TENNIS COURTS 1-1731 Councilman Crocker expressed concern that residents could provide portable lights for their tennis courts by plugging them into their electrical system in their homes and asked that the City and Association be prepared to deal with the problem as more tennis courts are construct- ed in the community. COMMUNITY RECREATIONAL FACILITY EXPANSION 1=1753 Councilman Pernell stated that he had been contacted by many residents concerning tennis court construction in the community and suggested that a joint discussion regarding expanding community tennis courts might be beneficial. Mayor Rose stated that it was his under- standing that the Tennis Club would be makinga proposal -soon and -5- Acis dSzi it November 29, 1976 recommended that the matter be discussed at another joint meeting in February. BUDGETARY ALLOCATION FOR PROFESSIONAL CONSULTING SERVICES Councilwoman Swanson stated that she believed that the City Council had acted hastily on November 22, 1976 and set a dangerous precedent by voting to expend up to $5,000 for professional consulting services in the matter of the Howard Slusher conditional use permit request under consideration by the Planning Commission. Stating that she had voted in favor of the motion, she moved that the motion be reconsidered. Councilman Heinsheimer seconded the motion which was defeated by the following roll call vote: Ayes: Councilmembers Swanson, Heinsheimer Noes: Councilmembers Crocker, Pernell, Mayor Rose The Council directed the City Attorney to proceed with issuance of contracts for the professional services deemed necessary by the Planning Commission.
