Monday, July 25, 1977. ROLL CALL PRESENT-'Councilmembers Rose, Swanson, Mayor Crocker APPROVAL OF MINUTES 699 The minutes of the meeting of July 11, 1977 were approved and accepted as corrected on a motion made by Councilwoman Swanson, secon- ded by Mayor Crocker and carried unanimously. PAYMENT OF BILLS 706 Councilman Rose moved that Demands No. 6340 through 636.2 in the amount of $11,863.65 be paid from the General Fund. Mayor Crocker accepted the resignations with regret, and asked that residents be advised in the Newsletter of the;'vacancies, and asked to.submit,resumes for Council consideration.: The'Mayor asked that ars appropriate letter of appreciation be sent to Mrs. Hoffman. COMPLAINT OF DOG NUISANCE - WICKHAM/SILLIKER 723 In a letter dated July 15, 1977 Mr. John Wickham, 34 Chuckwagon Road, appealed the findings of the City Manager with regard to a com- plaint filed on July 1, 1977 by Mrs. Elizabeth Silliker, 28 Chuckwagon Road under Article XII, Section 1204, Ordinance No. 136. Mrs. Joan Wickham addressed the Council and said her dog is very friendly and is not destructive. She suggested that since the Sillikers have an en- closed yard, the Wickhams not be required to confine their dog to protect Mrs. Silliker. Dr. Silliker submitted a statement regarding the matter, and asked that the dog be kept away from his property in order to protect Mrs. Silliker, who has suffered loss of the balance mechanism as a result of illness, and is required to use a walker. The statements filed by the Wickhams, Dr. Silliker, and a letter from Leonard Graff dated July 20, 1977 advising that the Wickhams''dog is docile and obedient, were entered into the file. Councilwoman Swanson said that she is familiar with the case, since she is a neighbor of both families, and it was her opinion that the Wickhams' dog is well cared for, and is sweet and lovable, as..:stated by the Wickhams, but since they are away from home several days of each week, the dog is loose in the neighborhood, and is a nuisance. Councilman Rose moved that Mr and Mrs. Wickham be required to confine their dog to their property until it has been trained to stay away from the Silliker property, and new findings in the case have been made by the City Manager. Councilwoman Swanson seconded the motion. Mrs. Harriett Spertus, 39 Chuckwagon Road, said there, are 24 dogs on Chuckwagon Road, and she said the action taken by the Council was discriminatory with regard to the Wickhams' dog. Mayor Crocker said that people have a higher priority than dogs, and in this case the -Council acted on the basis of a complaint made by Mrs. Sil- liker. The motion was carried by the foll©wing vote: AYES: Councilmembers Rose, Swanson, Mayor Crocker NOES: None ABSENT: Councilmen Heinsheimer, Pernell The Mayor advised Mr. Wickham that when hiAdog has been trained to stay away from the Silliker property, he wished him to so advise the Manager, so that the matter could again be brought before the Council for further consideration of the requirement that the dog be confined. ZONING CASE NO. 195, DR. S. EDWARD TUCKER, 3 PACKSADDLE ROAD WEST 939 Mayor Crocker opened discussion of Zoning Case No. 195, a request by Dr. and Mrs. S. Edward Tucker, 3 Packsaddle Road West, for a con- ditional use permit for construction of a paddle tennis court, which was approved by the Planning Commission on July 19. In a letter dated July 22, Dr. Larry Kelly, 2 Pinto Road, protested the Planning Commis- sion's decision and stated that the procedure to acquire neighborhood input was inadequate. Dr. Kelly addressed the Council and stated that the Planning Commission had a moral obligation to notify residents in the Flying Triangle who could see the paddle tennis court, even though the properties are more than 500 feet from the Tucker property and _2® 1 I. July 25, 1977 notice is not required by law. Dr. Kelly presented 21 snapshots taken from locations in the Flying Triangle. Letters of opposition from Dick Hoffman, 73 Portuguese Bend Road; Kenneth Watts, 1 Wrangler Road; Mr. and Mrs. H. L.'Reeder, 51 Portuguese Bend Road; Kim and Don Borden, 63 Portuguese Bend Road; Grace A Nixon, 58 Portuguese Bend Road; and°a petition signed by 20 residents of the Flying Triangle were entered into the record. Dr. Kelly asked that the Council review the Planning Commission's decision and consider the testimony of residents. Mrs. Gwen Tucker, applicant, advised the Council that the Tuckers had followed all procedures required by the City and Community Associ- ation, and wished to improve their property to provide more space for their family. The proposed paddle tennis court was planned for con- struction on an existing pad, and Mrs. Tucker said opposition should have been expressed at the public hearing held by the Planning Commis- sion on June 29. "Z Forrest Riegel, Planning Commission Chairman, said the Commission "Z considered visibility from 'the Flying Triangle when they made their field trip to the site, and as a condition of their approval, the Commission required bonding for landscaping. He agreed that the noti- fication procedures should be improved. Councilwoman Swanson said there was no irregularity about notification, and in the future all residents will be notified in the Newsletter about hearings before the Planning Commission to request a conditional use permit or variance. The City Attorney advised the Council that the Planning Commission operates under parliamentary law, and the Council has no jurisdiction over the matter unless an appeal was filed by a resident who received a notice'of the public hearing, and who entered an objection to the request for conditional use permit. Mayor Crocker said the -matter would be referred back to the Planning Commission, and they would have an opportunity to reconsider the matter if requested to do so by one of the three Commission members who voted in favor of granting the con- ditional use permit. COMMENTS ON GRADING, CLARK LEONARD 1275 The. Mayor requested that a report entitled Comments on Grading prepared by Clark Leonard be retyped and distributed to members of the Board of Directors, Planning Commission, Architectural Committee, City Council, also to residents who request a copy. ' Mr. Riegel advised the Council that the Planning Commission would hold a special meeting on Tuesday, August 2, 1977 to consider the re- port and would forward their recommendations to the Council prior to expiration of the moratorium on grading in excess of 201 which has been extended to August 9, 1977. The Mayor asked that the record show that Mr. William Stringfellow has been appointed as Board member to work with the Council on the matter of grading. Copies of a letter dated July 17, 1977 from A. E. Esser, 71 Crest Road East, were distributed to the Council. Mr. Esser was advised that if grading requirements were amended, he would be required to follow the procedures established for applications for a variance. Mr. Richard Linde, architect, advised the Council that he has obtained building per- mits for a residence in Rolling Hills, but the grading has not been approved. Mayor Crocker said the Council is attempting to -deal with the problem as expeditiously as possible. Mr. Joseph Abdo advised the Council that work has been delayed on his new residence at 0 Buggy Whip and he asked whether it would be possible to have requirements waived on his property. Mayor Crocker asked Mr. Abdo to submit his request in writing for the next Council meeting. -3- 082 July 25, 1977 RIDING RING, BUGGY WHIP DRIVE 1424 Mayor Crocker asked Mr. Charles Meurer of Meurer Engineering to report on the status of the riding ring on Buggy Whip Drive which was given to the City by Clifton Hix as a condition of: approval when he subdivided,his property. The Mayor said the City has CETA help avail- able to work on the ring. Mr. Meurer said completion has been delayed by a disagreement between the developer and engineer about payment for work done on the ring. The Mayor directed that staff review the matter and take necessary steps to prevent further work in development of the properties until the dispute concerning the ring is resolved, REQUEST FOR BUILDING PERMIT, ROGER MEURER, 10 BLACKWATER CANYON ROAD In a letter dated July 14, 1977 Mr, Roger Meurer advised that the Board of Directors had approved his request to begin grading and con- structing the new residence at 10 Blackwater Canyon Road on the new site created by subdividing his property consisting of seven acres. Mr. Kinley advised that the modification agreement has been duly exe- cuted, and Mr. Meurer was required to post a $3,000 bond for removal of the extra residence in the event the subdivision was not completed and approved by the City. Copies of minutes of the meeting of the Board of Directors on May 5, 1977 and July 7, 1977 were presented to the Council. Councilman Rose moved that Mr. Meurer's request that the City give similar approval be granted, and that the City Attorney be re- quested to prepare an appropriate agreement. The motion was seconded by Councilwoman Swanson. Mr. Riegel advised that the Planning Commission has approved Mr. Meurer's tentative map subject to improvement of Blackwater Canyon Road, including obtaining slope easements from owners of property across from the Meurer property. Mr. Riegel asked that completion of improvements on Blackwater Canyon Road be guaranteed. Mr. Charles Meurer said he had discussed requirements with the property owners concerned, and had been assured of their willingness to cooperate by granting the necessary easements. Mr. Meurer said he would agree to provide whatever documents the City needs to assure improvement of the road. The City Attorney asked that Mr. Meurer provide a document granting the necessary easements from Mr. John Farrow, 12 Blackwater Canyon Road and Mr. Dr. Gary Hathaway and Mr. Frank Kredel, owners of property at 8 Blackwater Canyon Road, in a form satisfactory to the City Attorney. Mr. Meurer indicated that he would be willing to make the improvements on the road and to obtain the consent of the owners to be submitted to the Attorney and the Council. Following the discussion Councilman Rose withdrew his motion to approve the request for a building permit. Councilwoman Swanson with- drew her second, and Mr. Meurer was directed to provide the necessary documents at the next meeting of the Council. The matter was held on the agenda. R. Co SCHRANK, MIDDLERIDGE LANE SOUTH 1834 Mr. Robert Schrank, owner of property on Middleridge Lane South, advised the Council that there is a drainage problem on the property which became evident when he prepared to make road improvements in connection with development of the property, After discussing the matter with the City Manager, Mrs. Clifton suggested that the matter be presented to the Council. Mr. Schrank explained that to correct the problem he wished permission to install a 12" pipe under the bridle trail to diverty the water, also he wished to install a metal catch basin and an energy dissipatoro Mayor Crocker said it was his opinion that the matter should be resolved by staff, working with 1EM �l July 25, 1977 experts, and staff recommendation whould be referred to the Council for approvals Mr. Schrank said the contractor is ready to pave the road and he had the plan for the proposed correction prepared by Mr. Ron Mc - Alpin of South Bay Engineering Corporation, Mr. McAlpin showed a map of the property, also property immediately adjacent which was subdivided in 1968, Tract 26113° Following the presentation by Mr. McAlpin, Coun- cilman Rose moved that the Council approve the plan, subject to approval by the County. The motion was seconded by Mayor Crocker, Mr. Kinley recommended that a drainage easement be reserved across Lot 2 of Tract 31873, Mr. Schrank's propoertyo Councilman Rose amended his motion to reflect the City Attorney's recommendation. SAM WOLINSKY, 8 REATA LANE 4-2 Mr. Kinley advised the Council that he is waiting for drawings of the easements on the Wolinsky property from Title Insurance and Trust, and when they are received he will complete his opinion of the matter and request that it be scheduled as an agend item. Mayor Crocker said he had visited the site and agreed with Dr. Wolinsky that it is a dangerous condition. The matter was held for additional information from the City Attorney. RESOLUTION, INSTALLATION OF FIRE PROOF ROOFING ON ADDITIONS 104 The City Attorney requested that the matter be held on the agenda for presentation at the next meeting. The Mayor so ordered, CITY OF LAKEWOOD 110 7 In a letter dated July 13, 1977 from the City of Lakewood, Mr. John Todd, Chairman of the Special Committee of City Attorneys in litigation relative to the City of Los Angeles vs. County of Los Angeles, Cities of Artesia et al, requested that the City remit one- tenth of one percent (1/10th of 1%) of the 1976-77 Sheriff's budget to the Special Committee. Councilman Rose moved that the request for the financial allo- cation, not to exceed $100, be approved. The motion was seconded by Councilwoman Swanson and carried by the following roll call vote: AYES: Councilmembers Rose, Swanson, Mayor Crocker NOES: None ABSENT: Councilmen Heinsheimer, Pernell -5- July 25, 1977 PROPOSED ORDINANCE NO. 152 123 The City Attorney presented a proposed ordinance prepared at the Mayor's request, providing for an appeal from the decision of the Plan- ning Commission when requested by affirmative vote of two members of the Council. In discussing the matter, the proposed ordinance was amended to require vote of three Council members. Councilwoman Swanson moved that the proposed ordinance as amended, titled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS AMENDING ORDINANCE NO. 33 ENTITLED "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS PROVIDING FOR ZONING IN SAID CITY" be introduced, and that reading in full be waived, The motion was seconded by Councilman Rose and carried by the following roll call vote: AYES: Councilmembers Rose, Swanson, Mayor Crocker NOES: None ABSENT: Councilmen Heinsheimer, Pernell PROPOSED ORDINANCE NO. 152 221 The City Attorney presented a proposed ordinance prepared at the Mayor's request, which in addition to providing for an appeal from the decision of the Planning Commission when requested by arrirmative vote of three members of the Council, would add Section 6021° Review by the City Council. In the discussion of the proposed ordinance, minor changes were made with regard to lime limits. Following the discussion, Councilwoman Swanson moved that the proposed ordinance as amended, titled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS AMENDING ORDINANCE NO. 33 ENTITLED "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS PROVIDING FOR ZONING IN SAID CITY" be introduced, and that reading in full be waived. The motion was seconded by Councilman Rose and carried by the following roll call vote: AYES: Councilmembers Rose, Swanson, Mayor Crocker NOES: None ABSENT: Councilmen Heinsheimer, Pernell REHABILITATION, 88 SADDLEBACK ROAD 263 Mr. Kinley reported that he visited the property at 88 Saddleback Road, and following his inspection he called Mr. Walter Anderson, at- torney for the owner. Mr. Anderson called Mr. Kinley later in the day and advised him that the owner had informed him that he planned to move into the residence within the next week, and would resume rehabilitation. of the property. Mr. Kinley said condemnation procedures initiated by the City were proceeding, and he would submit a proposed ordinance appointing a Building Pehabilitation Appeals Board for Council consid- eration at the next meeting. Copies of the Rehabilitation Procedure schedule provided by the Building and Safety Division of the Department of County Engineer were distributed to the Council. MATTERS FROM THE COUNCIL APPOINTMENTS, COUNCILWOMAN SWANSON Councilwoman Swanson advised the Council that she had been elected Secretary -Treasurer of the South Bay Steering Committee, Phase III, and was appointed to the Criminal Justice Council by Attorney John van de Kamp. 3 85 WATER WELLS R. July 25, 1977 S:n 341 Councilwoman Swanson said she was contacted by a resident who wished to construct a water well for use for irrigation and in his stable. The City Attorney advised that the City has an ordinance which prohibits digging of wells without approval of the Council, and Mayor Crocker said if is further prohibited by the Metropolitan Water District. Councilman Rose requested that Councilwoman Swanson refer the resident to him for further discussion and information. WEEKEND SERVICE - RTD 348 Councilwoman Swanson reported that the matter of weekend service will be reconsidered by the RTD Board of Directors at the request of the public in an effort to provide some weekend RTD service with minor changes in the schedules. 00 VIEW EASEMENTS 356 CIZ 6'111.11 Mayor Crocker said he requested that the City Attorney prepare '-J;an ordinance to protect view easements for Council review. AGREEMENT, ADVANCED ELECTRONICS 361 Mr. Kinley reported that he had sent a letter to Mr. Robert Mohr, Advanced Electronics, confirming Council approval of his request to install an overhead power line across Crest Road East to an existing pole for a period of eighteen months. AMPLIFICATION OF SOUND SYSTEM IN COUNCIL CHAMBER 363 Mayor Crocker directed that the City Manager be requested to obtain additional estimates for amplifying the sound system in the Council chambers for consideration by the Council. SOLID WASTE MANAGEMENT 365 Mr. Kinley reported that as directed by the Council, he had ad- vised the State Solid Waste Management Manager that it was the opinion of the Council that since Rolling Hills has no solid waste management facility, the requirement to designate an Enforcement Agency did not apply to the City. Mr. Kinley said he received a reply which advised him that the minimum standards contain sections which apply to refuse storage practices, containers, bins, frequency of collection, solid waste removal, collection equipment and collection of refuse; there- fore the Solid Waste Control Act applies to the City of Rolling Hills. Mr. Kinley was directed to advise the Solid Waste Management Manager that the City of Rolling Hills contracts for private service for solid waste handling, and wishes the city to be designated as the agency for its solid waste management program. PERSONNEL SESSION 376 Mayor Crocker recessed the meeting to a personnel session at 10a40PMo ADJOURNMENT The meeting was reconvened by the Mayor at 11:00 P.M. and adjourned to the next regular meeting.
