At�orney gave his legal opinion regareiing �elease of bonds pos�ed by

he �ras advi�ed by t�e City Manager tha� she had he�ld the $54a300 road
bond because she T,�ranted furth�� info�°mata.on from �he County Road Depart6
ment as to whethe� they had made an inspeetion to determine whethex° the
cul. de sac at the end of Buggy �Thip D�°ive wa� s�zbject to geologieal
�a�a�cdo Mro Kinley sa�.d he discussed �he m�.tter with Mro Bob Smith,
County Er�gineering Geologist, and IKro Smi�h adv�.sed him tha� although
ther� �ras a geolog%cal hazard on L�ot 7 and a portion of Lot 6 , these
area� �rere �lea�ly ma�ked on the final map , and since the County Road
Department had approved and a�cepted the road as construeted, and had
reeo�nended �elease of th� bond, tY�e bond �hould be releaseda

that he ha� been ha�ring �ntermittent p�°oblems with h�,s telephone ser- .

problem is recent , and it i� his opin�on that the restricted or crushed
d�ct �esul°ted fronn relocation of the �nderground utilities in the
v�cir�i�y of h�s home , wh,ere the road grade was changed to pennit devel�
opment of the extension of Buggy Wh�p Driveo �'Iro Ru�herford �eques�ed
that a port�.on of �h,e bond be reta�ned for rep�ir of his telephone serv�i�ee
M�o Smit� said a separate bond for utilities raas pos�ed, and was
rele�sed following inspection and approval by the utility caompanieso He
said that �f �rork done in the area caused the damage, he urill pay for
repairp ho�rever, Mr, Smith said the �oad bond is a separate issue, and
he aslced �hat it be x°eleasedo The City Attorney agreed �hat the bond
being considered by the Council was for road improvement only, and its
release should not be affected by Mro Rutherford' s problema However,
IKro Kinley sa�,d Mre Ru�herford does have cause for action,

about drainage p�°oblems in an area of geologic problems since drainage
at the Caballe�cos ring has been a constant probl,em, anc� it �s her opinion
that similar drainage problems �rill occur in the area of the new9 riding
��.r�g,. Councilwoman Swanson said she would no� be in favor of releas�ng
the bond until. drainage has been elarifiede

management in Rolling Hills in view of �th.e fact that the franchise
ag�eement for the collection of rubbish provides for examination of
Lhe equ�pment used by the Browning Ferris Company for this purposea
