accepted as corrected on a motion made by Councilwoman Swanson, seconded

� Copies of documents submitted by Mrs , ilelma I�Iatthews , 11 Cinchring
Road, certifying to the death of one dog and neutering of another dog
were presented to the Councilo Tn a memorandum to the Council dated
January 9 , 1978 the Manager adv�,sed that Mx°so Matthews would be in
compliance with Ordinance Noo 143 if the �ouncil relaxed the �°equire-
ments of Article XIII with regard to time limit, and the Deputy District
Attorney had advised Mrs > Clifton that he would not prosecu�e Mrso Matthews

if she had met al� other requirements of the ordin�ncea The Manager
rpported further that Mro Barry Becke�, 10 Portuguese Bend Road, had
advised the District Attorney that he would comply with requirements
of the ordinance and would advise him of h�s act�on in January,
Mrsa Clifton was a�ked to report fur�her on the �a�ter of Mra
Becker' s non-complianceo

Mrso Clifton introduced Mro Ken LaBarge, Wes�ern Sales Manage� of
Browning Fer�is Industries , who had come fro� San Jose �o attend the
meetingo The Manager reporte� that she had met �ith Counci�men Ro�e
and Heinsheimer and N1so LaBarge and two othe� rep�esentatives o� B��
prior to the Council meeting to discuss problems wi�h the new service
whi�h began in �he City on October 1, 19�7 �
Councilman Rose said it was determined in the discussion that one
of the major problems was caused by lack of pi�k-up on Monday holidays9
and since the landfill is closed six Monday� during the yeary BFI has '
agreed to pick up extra material on the next regular pick up days for .
residents affected, so that the total weekly pick up �auld be made in
one trip during those specific weekso Coun�ilman Rose said man� other
compla�nts concerned the location where trash is stored on individual
prop�rties and th� time of collection, and he said residents should be
reminded again that trash will be collected from proper locations onlyo
Councilman Heinsheimer said that all complaint� made to the City office
had been recorded, and were reviewed, and i� was apparent that although
there were many legitimate complafntsa some complaints were minor in
nature, and an attempt would be made to make the neeessary adjustments ,
but residents should be advised of circumstances �hich could not be
changedo
M�e Russell Chase, 2 Ringbit Road East, said he did not consider
�he tone of the report of the brief ineeting an accurate reflection of
the problems encountered by residents during the first three months of
the �ervice by BFI< Mre Chase said service had been erra�ic, undepend-,
able and incomplete, and rhe facts have been made known to �he staff in
City Hall, Further, he said that inadequate in�o�ma�ion about the mee�-
ing with representatives of BFI resulted in poor representation of resi-
dents at the meetingo In the first three mon�h� of the se�vice, Mro
Chase said his resfdence was missed 50% of the time; on one oceasion
he followed the collector and was assured that a pickup would be made ,
but when he returned home he found that the tra�h had not been pic�ed
upo On another occa�ion an over-loaded truck picked up his trash, and
damage was done to his d�iveway by s�ainingo The t�ucks are too large,
Mro Chase said, and a large truck has done damage to his landscapingo
Mro Chase asked whether the Council was aware that final word on com-
plaints came from Houston Texas , and he sugges�ed that re��den�s be given
interst4te and intrastate representatfono Tn some cases , Mro Chase said,
residents were asked to assist in lifting cans wh2ch the BFI employees
considered to be over weighto �inally, Mro Chase asked �hat financial
restitution in �he form of tax relief be made to residents who have
suffered damage and lack of service since the f�anchise became effectiveo
Mrso Jan Bierbaunn, 6 Middleridge Lane South, said she is not as
satisfied with the present service as she was with the former service> ,
Mrso Bierbaum said she signed a contract for a bin and paid three month�
in advance as required, but the material in the bin was not collected
until she made several callso Futher Mrs Bierbaum. said �he called and
requested a special pick up for w�ich an additional charge was made, and
she was assu�ed �hat the item �ould be picked up9 but it was noto
Mro LaBarge advised that he is the Western Sale� Manager in the San
Jose office, and he introduced Mra Bill Fatjo, the new General Manage�o

he said that supervisors rode all routes in the Ci�y on Monda.ya Januar� 9

that he has liv�ed in the City for seven months , and in that �ime the
peacock populatfon in his a�ea has tripledo In a memorandum to the
Council Mro Cutlex said that on behalf of five familes in the South
and North 1�Iiddleridge Lane area, the Cutlery Lohns , Bierbau.ms , Ca�.nes .
and Boyds , he requested that the City Council insti�cute an i�mnediate
_ control to attempt to reduce the number of peacocks o�° maintain a
nominal number of birdso In the absence of such control9 he a�ked
that homeowners be advised in writing what tY�eir rights are regarding
' shooting and/or trapping peacock� on their own propertyo
Councilman Heinshefemer said it appeared the peacocks were pre-
senting a problem similar to the coys in impact on residentso Coun�
cilman Pernell recommended that Miss Grace Nixon, 58 Portuguese Bend
Road, be asked to malce a profession.al �°e�ommendation regarding �he
problemo I�Iayor Crocker requested that the N[anager attempt �o obtain
a practical answer for contx�ol of the problem, and d�rected that the
matter be placed on the next agendao
COUNTY FORMATION REVIEW CONIl�IISSION FOR PROPOSED PENINSULA COUNTY 274
Mayor Crocker advised that Councilman Heinsheimer would �epresent
the City of Rolling Hills at a meeting to discuss the proposed Penin-
�ula County on Januax�y 16 , 1978 and asked that he report to �he Council
at the next meetinga
PENTNSULA CENTER MASTER PI�AN STUDY 354
In a letter to the City Manager dated Decembe� 29 , 1977 , Mro Harry
Peacock, City Manager of Rolling Hills Es�ate� , advised tha� they are
in the process of completing a Nlaster Plan Stuciy of Peninsula Centero
After assessing the various aspects of the Draft Master Plan Study as
amended by the Rolling Hills Estates Planning Commission9 it was detere-
rnined by the Environmental Review Committee that an Env�ironmental Impact
Report should be prepared on the prop�sed am�nd�ent to �he Ci�y General
Plan,� and Mro Peacock �aid the staff invited consultation on the Draft
EoloRa
Councilman Pernell recommended �hat the matter be referred to the
Environmental Quality Board for their revier�r and co�ncnents , and the Mayor
so orderedo

the existing Electrical Code. There being no comment from the audie�ce ,

APPOINTMENT TO ENVIRONMENTAL QUALITY BOARD 452
With the concurrence of the Chairman of the Environmental Quality
Board, Mayor Crocker appointed Mrso Alice Miller, 1 Wagon Lane to se�ve
on the Environmental Quality Board as a representative of the Architec-
tural Committee , to replace Mrs , Nicky Field, who, has retired from the
Committee and the Board<

Councilman Rose moved that the Council agree to share the cost of
a gardener for the City grounds , as requested by the Board of Directors
of the Rolling Hills Community Associationo The motion was seconded by
Councilwoman Swanson. Councilman Heinsheimer offered a substitute motion
that a decision be deferred until the Budget Hearing, so that an allo-
cation could be made fo� the expenditureo The motion was ruled out of
ordero Councilman Pernell moved that the matter be �abledo The motion
was seconded by Councilman Heinsheimer and carried unanimouslyo
Councilman Heinsheimer suggested that a letter be written �o the
Board of Directors advising them of the Council' s decision. Mayor Crocker
said he felt a verbal communication would be preferable, and said he would

Councilwoman Swanson said she had discussed the Audit Report with
Mr, Larry Courtright , City Treasurer, and at his request a correc�ed copy
was provided by the auditor,
The Audit Report dated June 30 , 1977 , as corrected and approved by
the City Treasurer, was approved and accepted on a motion made by Council-
woman Swanson, seconded by Councilman Rose and carried by the following

The Manager reported that the Rolling Hills Women° s Community Club
has scheduled their annual Membership Coffee for Tuesday, May 9 at the
