April 24, 1978
A regular meeting of the City Council of the City of Rolling
Hills was called to order at the Administration Building, 2 Portu-
guese Bend Road, Rolling Hills, California by Mayor Pernell at
7:30 P.M.Monday, April 24, 1978.

APPROVAL OF MINUTES 2-602
The minutes of the meeting of April 10, 1978 were approved and
accepted as corrected on a motion made by Councilman Crocker, seconded
by Councilwoman Swanson and carried by the following roll call vote:

It was moved further by Councilman Rose and seconded by Council-
man Crocker to incorporate into the minutes of the meeting of April 24
a corrected revision of the motion made at the March 27, 1978 City
Council meeting concerning the annexation of approximately six acres
to the southerly boundary of the City of Rolling Hills in the Flying
Triangle area, as submitted by the City Attorney. The minutes should
state:
"Councilman Rose moved that the staff be instructed to take the
required procedural steps to annex the approximately six -plus acres
of vacant land located along the southwesterly boundary of the City
adjacent to the area designated as "Annexation No. 1", recorded on
November 29, 1972 in the Official Records of Los Angeles County and
April 24, 1978
the map of the City of Rolling Hills as the "Flying Triangle
Extension'.', upon the following express conditions:
1. The City of Rancho Palos Verdes consents to the de -annex-
ation of said land.
2. Palos Verdes Properties, a partnership, owner of record of
said six -plus acres of land, and Palos Verdes Corporation,
a corporation, presently the holder and owner of certain
easements over the private roads and lands in the City of
_Rolling Hills, convey by written instrument in a form ap-
proved by the City Attorney, all of the right, title and
interest in any and all easements or rights of way either
Palos Verdes Properties, a partnership, or Palos Verdes
Corporation, a corporation, now hold or is the record owner
thereof, which provide ingress and egress from any land the
record ownership of which is vested in either Palos Verdes
Properties or Palos Verdes Corporation, over, along or
across any of the private roads or,land located within the
existing boundaries of the City of Rolling Hills or the
land area under the control and jurisdiction of'Rolling
Hills Community Association of Rancho Palos Verdes by
virtue of any declaration of restrictions of record placed
on said land by Palos Verdes Properties or Palos Verdes
Corporation, or by its predecessors in interest, or by any
other claim or'right.
3. The County Engineer, acting as City Engineer of the City of
Rolling Hills, files a written report with the City Manager
stating that said proposed annexation of land is geologically
stable in its present condition and is not located within
any existing slide areas now known or designated on any City
or County map.
In the event any of the above conditions are not complied with
in a reasonable time prior to the commencement of the proceedings to
annex said vacant land to the City of Rolling Hllls, then this motion
shall be rescinded without action on the part of the City Council and
said land shall not be annexed to the City of Rolling Hills.
The motion was seconded by Councilman Heinsheimer and carried by
the following roll call vote:

PAYMENT OF BILLS 2-660
Councilwoman Swanson moved that Demands No. 7005 through 7042 in
the amount of $19,794.80 be approved for payment from the General
Fund, with the exception of Demand No. 7022, which was voided. The
motion was seconded by Councilman Crocker and carried by the following
roll call vote:

Dr. David Basque, 49 Eastfield Drive, was present and said he wished
to voice his complaint about the appearance of the excess of material be -
ng put out for the special trash pickup, He suggested that it be picked
p from the rear of the properties instead of the street.

Jack Bryant, Civil Engineer, requested the reaction of the Council
concerning his consideration of purchasing the Kelso property on Saddle-
back, and subdividing the 3011 acres of land. The CityManager recommended
that he make an appointment with her to discuss the matter, and the Mayor
indicated his approval of that procedure.

Eastfield; Mr, and Mrs. Scott Robinson, 12 Bowie;
and Barbara Evenson, 44 Eastfield.
Mayor. Pernell invited comments in favor of or in opposition to pool
fencing. Mrs. Suzane Thornton, 7 Williamsburg, gave statistics regarding
the number of drownings and near drownings and the number of pools in r
the City. She said that with the increased population of children in
the area the responsibility of pool fencing should be a concern of every
resident. She recommended forming a committee to study the situation.
Mrs. Louise Zimmerman, 12 Cinchring, spoke in opposition to fencing,
aying that her own child fell into her home pool, enclosed with a four
foot fence. She said that in order to make fenced pools safe, the fence
would have to be unclimbable, and that is not always practical.
Mrs. Peggy Stoker, 25 Caballeros, spoke in favor of fencing. She
stated she thinks the fencing should be an appropriate type and approved
by the County of Los Angeles. She said the City is too concerned with
esthetics, and more emphasis should be put on the safety and welfare of
the children.
Charles Thornton, 7 Willimsburg Lane, spoke in favor of fencing and
suggested that a committee be appointed to investigate further the cost
and esthetic aspects of the problem.
Dr. Michael Weller, 3 Flying Mane, spoke in favor of forming a
committee to study the fencing problem. He stated that cost and esthet-
ics were probably the biggest deterrent to residential approval of
fencing.
Dr. William Taylor, 46 Eastfield, spoke in opposition to mandatory
fencing, stating that he does not think fencing every pool in the City
would prevent drownings.
Mrs. Cathy Kelly, 2 Pinto, spoke in opposition to fencing. She
aid that teaching a child to swim at an early age is the best preven-
ive method against drowning.
Robert Foulk, 9 Williamsburg Lane, spoke in opposition to fencing,
saying that he feels parents should be responsible for making sure the
child can swim.
Mrs. William Taylor, 46 Eastfield, spoke in opposition to fencing
and said it is each person's responsibility to protect his own property.

Dr. Ken Miller, 27 Eastfield, spoke in opposition to fencing. He
stated his concern that even though, a fence is installed, a child could
climb over, and he felt that another system such as an alarm would be
more effective.
Mrs. Joyce Grubs, 1 Hackamore Road, spoke in opposition to fencing,
stating that she feels that children should be taught to swim.
Edward Kunda, 1 Blackwater Canyon Road, spoke, saying he feels that
prospective buyers in the City should be warned that there is no fencing
required for pools,
Sandra Stein, 27 Caballeros Road, spoke in opposition to fencing.
She said that if a pool is fenced the fence should be one that can be
seen through.
Maria Valencia, 11 Outrider Road, spoke in opposition to fencing,
saying that she thinks high risk areas with pools should possibly be
treated differently than low risk areas,
A discussion by the Council followed. Councilman Crocker observed
that probably 80% of existing pools do not comply with the County ordi-
nance, and it was his feeling that any future plan should deal with
those fences which do not comply with the County ordinance.
Mayor Pernell raised the question of what is an acceptable risk
with regard to swimming pools,, economics, public responsibility for the
neighbor and the neighbor's safety, how safety features would be applied
evenly across the community, alternatives for safety features, and the
esthetics of pool fencing.
Councilman Rose moved that a citizen's committee be appointed of
interested persons to consider the pool fencing matter and report back
to the Council. The motion was seconded by Councilman Crocker. Mayor
Pernell denied the motion, -stating -`that it was out of order. Coun-
cilman Rose appealed from the decision kf thf chair, and the ruling of
the chair was -upheld.. The motion failed to carry on the following roll
call vote:
AYES: Councilman Rose
NOES: Councilmembers Crocker, Swanson, Mayor Pernell
ABSENT: Councilman Heinsheimer.
Councilwoman Swanson spoke regarding her concerns about appointing
a committee. She observed that the only three drownings in the com-
munity were in pools which had fencing, and she said that teaching a
child to swim is a better safety factor than fencing a pool.
Motion was made by Councilman Rose and seconded by Councilman
Crocker that the Council appoint a committee of citizens who wish to
serve and report their recommendations concerning the requirement of
or absence of requirement for pool fences,
Councilwoman Swanson requested that an announcement be put in the
Newsletter asking interested parties to submit a short resume to the
Council. Mayor Pernell suggested that a sign-up sheet be passed among
the audience for any interested person to sign who would be willing to
serve on the committee. The Mayor stated it was his intention to
appoint Councilwoman Swanson as a sub -committee chairperson to screen
applications for the committee.
The motion was carried by the following roll call vote:

The meeting was recessed at 9:30 and reconvened.at 9:40 P.M.
PROPOSED WILLIAMSBURG LANE TRAFFIC ORDINANCE 2-1487
Mrs. Clifton reported that the Traffic Commission recommended that
e Council pass the traffic ordinance. The Mayor noted for the record
t a letter had been received from Mrs. Carol Hanscom favoring the
Irninance.
Councilman Rose read the ordinance entitled "AN ORDINANCE OF THE
CITY OF ROLLING HILLS AMENDING ORDINANCE NO. 116 ENTITLED "AN ORDINANCE
OF THE CITY OF ROLLING HILLS REGULATING TRAFFIC WITHIN SAID CITY AND
REPEALING ORDINANCES 1 AND 16 AND ALL OTHER ORDINANCES IN CONFLICT
THEREWITH", and moved that the ordinance be introduced, and than reading
Len full be waived. The motion was seconded by Councilman Crocker.
CO Mr. Robert Foulk, 9 Williamsburg Lane, said he thought the ordinance
®as a good one. Mr. Foulk said he thought there should be a provision
or limited parking if an ordinance is passed, and that length of time
or limited parking is an important factor.
Q Mrs. Cynthia Doughty, 8 Williamsburg Lane, spoke in favor of the
ordinance, saying she felt that when cars are parked on the street she
does not have the visibility to see a child or dog. Mr. Robert Doughty
expressed his concern that the residents on Williamsburg Land had not
been made aware that the Traffic Commission was studying a parking
problem on the street, He said that a no -parking ordinance for the
street would not be realistic because of all the delivery trucks and
trucks of construction workers, plumbers, etc. He is more concerned
ith residents on Williamsburg Lane using the street for parking instead
f using their driveways.
Mr. Charles Thornton, 7 Williamsburg Lane., spoke in opposition to
the ordinance, saying it is not realistic, and that it should focus
more on the problem of limiting vehicles during the -day. He suggested
that the ordinance be redrafted.
Mrs. Candy Peterson, 3 Williamsburg Lane, spoke in opposition to
the ordinances She stated that: she has room for only one vehicle in
her driveway, and any guests she has would have to park in the street.
Mr. Robert Schmitt, 5 Williamsburg, said he does not feel an ordi-
nance is necessary, and that the overnight parking on the street: could
be eliminated by means of each resident receivii:g a letter re arding
the parking problem.
Mrs. Kim Sawyer, 6 Williamsburg, spoke about her concern for
emergency parking. SLrr said she would like to see more coo-:perative,
voluntary effort on the part of the residents on Williamsburg Lane to
alleviate the parking problem,
Councilman Rose requested that his motion be tabled and referred
to the Traffic Commission. Council recommended that Councilman Heins-
eimer, who is the Traffic Commission liaison, meet with residents of
illiamsburg Lane to study the matters further and make recommendations
o the Traffic Committee. Mrs. Cynth1a Doughty offered her home for

Mr. Kinley requested authorization to attend the City Attorney's
Symposium in San Diego on May 3, 4 and 5, and the request was approved.

O Mayor Pernell reported that the "Sunday Work" Ordinance is creating
problem at the gates because of excluding workmen on Sunday. He said
e intent of the ordinance was to eliminate noise and to provide some
N:Kace and quiet on Sundays, but the orders and the ordinance under which
ey operate exclude everybody. Mayor Pernell asked the City Attorney
to investigate the ordinance with regard to perfecting .the intent.
Mayor Pernell stated that he has the minutes from the last Planning.,
Commission ,point meeting, and he asked the City Manager to announce the
vacancy on the Planning'Commission. The Manager said it would be -,in. -.the
next Newsletter.
Mayor Pernell announced a Mayor's meeting on May 12, 1978 for the
yors of the four cities, and he asked the Council for any items appro-
iate to bring up at the meeting.

MATTERS FROM THE CITY MANAGER 1-256
The City Manager submitted a letter to the Council from the County
Los Angeles Office of the Assessor regarding field procedures for
raining building diagrams.
Mrs. Clifton submitted a report by the S and S Construction Co.
supporting the position of Rancho Palos Verdes concerning the subdi-
vision next to the radar site, which had been held due to possible
radiation hazard from the radar.s.it.e. The report was approved by the
Planning Commission and will be going to the City Council on the May 2
agenda for their review. .

Mrs. Clifton informed the Council that the:p'].ans for the wall at
4 Ringbit Road West had been submitted.to the Ar::ct% tectural Committee
for approval. The Council recommended the owners be required to do
whatever was necessary for safety, but should provide landscaping ap-
proved by the Architectural Committee to cover the wall.

Pernell adjourned the meeting at. 11:20 P.M. to meet on Monday, May 15,
1978 at 7:30 P.M.
