Go Shultz So Shultz Ke Watts Do Williams APPROVAL OF MINUTES The minutes of the meet�ng of Deeember 11 , 1978 were approved and accepted as corrected on a motion made by Councilman Crocker, seconded by Councilman Heinsheimer and carried by the following ro1T call vote : AYES : Councilmembers Crocker, Heinsheimer, Swanson, Rose NOES : None ABSENT: Mayor Pernell PRESENTATION RE : CTTY' S INSURANCE PROGRAM Nlro Michael Bush of Cal-Surance showed a slide presentation of various types of policies and premiums available to the Cityo Council- mar Crocker said the deductibles recommended were low, and Mro Bush said that based on the City' s record of claims , they could be increasede Following the presentation Councilwoman Swanson moved that the coverage recommended by Cal-Surance be approved and the premz.um paido The motion was seconded by Councilman Crocker and carried unanimously, PAYr'IENT OF BILLS 265 Councilwoman Swanson moved that Demands Noo 7652 through 7699 in the amount of $21 ,503a79 be approved for payment from the General Fundo The motion was seconded by Councilman Crocker and carried by the 166 , January 8 , 1979 following roll call vote : � AYES : Councilmembers Crocker, Heinsheimer, Rose, S�ranson Mayor Pernell NOES : None ¢ .� ABSENT: None AUDIT REPORT 266 Mro L> Do Courtright, City Treasurer, advised the Council that he had reviewed the Audit Report prepared by Cotton and Francisco , and he recommended that it be approved and accepted. The report was approved on a motion by Councilman Heinsheimer , seconded by Coun�i�l�man Crocker and carried b}r the following roll call vote : AYES : Councilmembers Crocker, Heinsheimer, Rose , Swanson Mayor Pernell NOES : None ABSENT: None SUBDIVISION NOo 70, TRACT 33871 , CHACKSFIELD-MERIT HOMES 277 The Mayor opened discussion of Tentative Tr�ct 33871 , Chacksfield- I�Ierit Homeso A letter from South Bay Engineering uras read into the recordo The letter, on behalf of the subdivider, appealed the decision of the Planning Commission on December 13 , 1978 when they approved a map marked Exhibit "A" , and requested that the Council consider the Tentative Tract Map marked Exhibit "B" . A discussion of procedures followed, Mre Kinley read into the record Section 4a12 of Ordinance No, 67 , regarding appeal to the Council for a rehearinge Following the discussion a straw vote of the Council indicated the following: Councilman Rose said he was not certain what was being requested in the letter and he wished clarifi- cation before he would be ready to votee Councilman Heinsheimer said the Council should decide whether to sustain or vacate the Planning Commission' s approval of Exhibit "A" , also their disapproval of Exhibit "B" a Councilwoman Swanson said she agreed with Councilman Hefnsheimero Councilman Crocker said he did not agree , since sus- taining the Planning Commission' s actfons on both "A" and "B" could block the subdivisiono Mayor Pernell said the applicant is asking the Council to attempt to resolve the problem of access , and he thought they should consider that matter before considering the appeala Mro Jim Collis , the subdivider, said the letter of appeal to the Council follows the procedure the engineer was told to follow< Further, Mro Collis said he has approval of one concept by the Board of Directors and app°roval of another concept by the Planning Commission, and he wishe� to have the matter of access resolved, since the size and number of lots remains the same with either plano Councilman Heinsheimer moved that the action of the Planning Com- mission on October 17 and December 13 , 1978 be sustained. Councilwoman Swanson seconded the motion< Councilman Rose asked whether the Council would have an opportunity to consider the tentative tract after sustain- ing the Planning Commission' s decisions and whether they would see both exhibits < Mro Kinley said the tentative tract submitted to the Council � was Exhibit "A" , which was forwarded by the Commission with a recommend- ation for approval , but the Council could ask to see Exhibit "B" alsoo -2- 16� January 8 , 1979 Mrso Carol Hanscom, Chairman of the Planning Commission, advised the Council that in reviewing the tentative tract, the Commission con- sidered problems of drainage and bridle trails , which would have to be solved regardless of which access is ultimately approved, but it was the consensus of the majority of the Commission that the southerly access would be too close� to Chestnut Lane, and would result in the Kuhne property having roads on three sides < Chairman Hanscom said that although Mro Leonard has said the distance from centerline to centerline of the two roads is 280' , the visual distance between the easements was considerably less . The proximity of the access road for the Storm sub- division to Chestnut Lane and the southerly access easement was another consideration. Chairman Hanscom said the new residences on Johns Canyon Road were oriented away from the road, and the Peters residence has a pool in the front yard surrounded by a high wall , so traffic on Johns Canyon Road would not affect the occupants . She said, further, that when the tenta- � tive tract was presented to; �he Subdivision Committee of Regional Plan- (� ning, only a southerly access was shown, and their recommendation of � approval was based on that road easement. After the Planning Commission a requested that the engineer show an alternate access , the plan showing the northerly access was referred to the Road Department for review, a and their report stated that the northerly access was preferablea A Q new set of conditions of approval was `prepared, based on that recom- mendation, she saido Another factor which influenced the decision of the Commission was that any future development of the Shultz property would require extension of the cul de sac of Johns Canyon Roado Chair- man Hanseom said it was the Commission' s opinion that in the interest of good planning the northerly° access should be � developed at this time, since Johns Canyon Road might not remain a cul de sac road. Mayor Pernell recom.mended that the Council postpone any action on the appeal and refer the matter to the City Attorney for his adviceo Councilwoman Swanson asked about the time limit for an appeal , and Mre Kinley� said .the Subdivision Ordinance does not specify a time limit< Further, he said the Council can approve, conditionally approve or disapprove the tentative map , or specify changes required to make the map conform to the Subdivfsion Ordinanceo Councilman Crocker moved that action on the appeal be postponed until after the Council makes a field trip to the sitea The motion was seconded for purposes of discussion by Mayor Pernell, and failed to carry on the following roll call vote : AYES : Councilman Crocker, Mayor Pernell NOES : Councilmembers Heinsheimer, Rose, Swanson ABSENT: None Mayor Pernell invited comments from the flooro Mre Clark Leonard asked to have the maps , Exhibit "A" and Exhibit "B" displayedo Mr. Leonard said the southerly access would be preferable because the road at that location is at grade, and minimum grading would be requirede He said the Kuhne house is approximately six feet above the roade The ortherly access would require a nine foot cut , he said, and further , development of the southerly access would require removal of fewer trees nd there would be 30 feet of paving in an easement that is 72 1/2 feet ide, plus slope easements . I�ro Gordon Shultz, 17 Johns Canyon Road, advised the Council that when his tract was recorded he opposed dedication of the northerly easement, and it was given only to provide for circulation for through � traffic to the adjoining property, which was zoned RAS-1 at that timee Nlre Shultz said that the present RAS-2 zoning wfll result in less -3- � 16� January 8 , 1979 densitye Mr. Steven Shultz , 14 Johns Canyon Road, and Mre William Peters , 11 Johns Canyon Road, also expressed opposition to the north- erly accesso Mro Don Williams , 9 Johns Canyon Road, advised the Council that he was aware of the existence of the� southerly road ease- ment when he purchased his lot, and his home was designed so lights from traffic on the road would not be a problem iff the easement was developedo Mro Williams `said he has no objection� to either access . � �ro Collis said that both concepts have merits , but it was his � opinion that Exhibit "B" provides for better lot design, and the sharp curve in the road which would be necessary in Exhibit "A" is undesireable< Councilman Crocker asked whether a third access could be considered as a compromise, and he asked about the possibility of developing the easement between the Speranza and Steve Shultz propertieso He was ad- vised that the Speranza home was located away from the existing southerly road easement, and would be too close to a road easement between the two properties . . Mro Gordon Shultz said one. possible alternative would be to get all the traffic off of Johns Canyon Road, and he said he does not want traf- fic near his home, so he would strongly support development of an access from Crenshaw Boulevard to serve the new subdivision onlyo Mro Shultz said a control gate could be developed which would permit access to that land only, with access to the rest of the City closed offo Councilman Rose moved that further discussion of the tract be post- poned until after the Council has had an opportunity to make a field trip to the siteo The motion was seconded by Councilman Crocker and carried by the following roll call vote : AYES : Councilmembers Crocker, Heinsheimer, Rose, Swanson Mayor Pernell NOES : None ABSENT : None Councilman Crocker said a master plan should be developed for the area, expanding Johns Canyon Road to a safe dimension, but he did not think approval of the tract should be delayed for the study< Council- man Heinsheimer said he thought there should be a study of traffic control in the area. Councilman Rose said a study should be made of the entire area, since approval of the Storm subdivision and possible approval of the Chacksfield-Merit subdivision would put a burden on Johns Canyon Road. Mrse Clifton said Johns Canyon Road would have to be improved to handle the traffic generated by development of the sub- divisions , and she said further that such a study should be coordinated with the Rolling Hills Community Association> The Manager was directed to ascertain possible costs for an overall traffic study in the areae Mayor Pernell scheduled a field trip for Sunday, January 21 , at 9 :00 A.M. , and he asked that the engineer have the property staked to show both access easements , with other appropriate staking of lot locatfons , The matter was held on the agenda with the consent of the subdividero SUBDTVISION NOo 71 , TR.ACT 33693 , BEATRICE MORRIS 1619 The matter was held on the agenda at the request of the engineer, RESOLUTION NOe 406 Councilman Rose moved that Resolution Noo 406, entitled A RESOLUTION OF THE CITY COUNCTL OF THE CITY OF ROLLING HILLS APPROVING THE APPLICATION FOR GRANT FUNDS UNDER THE STATE LITTER CONTROL, RECYCLING AND RESOURCE -4- 169 January 8, 1979 RECOVERY FUNDS be adopted, and that reading in full be waived. The correspondence was received and filed. -5- 1�0 January 8 , 1979 COUNTY OF LOS ANGELES , DEPARTMENT OF COUNTY ENGINEER-FACILITIES 1693 r In a letter dated December 28 , 1978 the County Engineer advised that a Certificate of Consent to Self Insure or a Certificate of Worker' s Compensation Insurance is required beforr�e a building permit is issued, subject to certain exceptionso Mra Ki;nley said he had made an inquiry to the County Engineer about the requiremente The letter was received and filed. , RIDING RING GRADING ON BUGGY WHIP ROAD 1718 Mrso Clifton reported that she had a written report from Dro Richard Merriam about the proposed riding ring on Buggy Whip Road. Copfes of Dro Merriam' s letter offering two solutions were given to the Council , and the Manager was authorized to obtain estimates for Proposal (b) , The matter was held on the agenda. LEAGUE OF WOMEN VOTERS 1740 In a letter dated December 14, 1978 'Lyn Stevenson, President of the League of Women Voters of Palos Verdes Peninsula requested permis- sion to conduct a door to door survey in February and Marcho The Council agreed that they would be opposed to such a survey, and they directed that the League be advised to limit their contact to mail or telephoneo LOS ANGELES COUNTY CITY SELECTION COMMITTEE 1760 With the Council' s consent Mayor Pernell designated Councilman Heinsheimer as delegate, authorized to vote at the meeting of the City Selection Committee. The Mayor said he would serve as alternate . CITY ATTORNEY 1776 Mre Kinley advised the Council that he had discussed the matter of a. cross complaint in the Wolinsky litigation with the Counsel for the City' s insurance carrier and ���� had recommended against filing a cross complaint . Mr, Kinley asked that the matter be removed from the agenda, and the Mayor so orderede MATTERS FROM THE COUNCIL 1796 POLICIES AND PROCEDURES : CONDITIONS USE PERMITS AND VARIANCE RECONSIDER.ATION Mayor Pernell ordered the matter, which was referred to Councilmen Crocker and Heinsheimer for a report, held on the agenda, ABSENCE FROM CITY Councilman Crocker, personnel officer, said there is an overlap of vacation time which would result in the City Clerk and Deputy Clerk both being away from the City for one daye The City Attorney said that the Mayor is requi�°ed to designate one member of the Council as acting City Clerk at any time this occurs , and it was his recommendation that a Couneil member be sworn in by appropriate oath to be available on February 13 . MATTERS FROM THE STAFF WORKER' S COMFENSATION CLAIM 1802 The Manager advised that the employee who filed a claim for Worker' s Compensation has been authorized to return to duty on January 12e e6_. l�l January 8 , 1979 RESOLUTION, CITY_ OF INGLEWOQD Mrso Clifton said a resolution was received from the City of Inglewood urging that the legislature provide information regarding allocatiori of 'Proposition 13 bail-out funds in time for budgetary consideratione She recommended that the City of Rolling Hills take similar action either by `letter or resolutione VANDALISM Mrs . Clifton reported that the Sheriff had taken six juveniles into custody over the weekend for vandalism in Rolling Hills , both on City property and private property.
