ORDINANCE NO. 180 022
Councilwoman Swanson moved that a proposed ordinance entitled AN
ORDINANCE OF THE CITY OF ROLLING HILLS , CALIFORNIA A�dENDING ORDINANCE
NO. 36 , "AN ORDINANCE OF THE CITY OF ROLLING HILLS PROVIDING FOR THE
FENCING OF STALLIONS AND JACKS" be adopted, and that reading in full be
waived. The motion was seconded by Councilman Pernell and carried by

TRAFFIC STUDY, SADDLEBACK ROAD NEAR HILLSIDE LANE 038
� A traffic study of Saddleback Road near Hillside Lane, prepared
� at the request of the Council following recommendation by the Traffic
� Commission, was presented to the Council . The report, dated October
� 17; 1980, was prepared by Edward Rugel, Los Angeles County Traffic
a Engineer.

PUBLIC INFORMATIONAL MEETING RE. LANDSLIDE, OCTOBER 29, . 1980 046
Discussion was held regarding the landslide activity in the Flying
Triangle area and the upcoming city-wide meeting at the South Coast
Botanical Gardens on Wednesday, October 29, 1980. Councilwoman Swanson
voiced concern that the City's consultant , Dr. Ehlig, would not be in
attendance. The D.4anager stated he is not available, and that his role is to
critique the finished report.; howeyer, the County geologists will be at
the meeting. She further informed the Council that the slope indicators
would be installed on Thursday, that permission has been received from
Dr. Tokita to go over his property , that permission to install the slope
indicators had been obtained from Mr. and Mrs. Evans, . and that arranger�ents
for grading a road had been made. The flyovers from Metrex Corp, covering
a 3 ,000 x 3,000 ft. area, were mad� , and old topos for comparison have
been received from the Water Company. A slide presentation will be made
at the meeting by the County Geologists. Mayor Heinsheimer clarified
that the meeting is not an official City Council meeting, but an informa-
tional one to brief the residents, with no decisions made. Discussion
followed regarding work and financial arrangements for remedial work.

Doug McHattie presented a map marked Exhibit A for the property at
38 Crest Road East. The Manager stated there had been no objections to
the plan , but the Planning Commission requested that a small corner of
the property across Caballeros Road be cleared up. A quit claim agreement
has been made between Mr. David and l�r. Occipinti . Mr, b4cHattie said the
existing traiZ is to be retained, and the easement along Caballeros was
increased from 30 ' to 40 ' to accommodate the trail . Councilman Crocker
questioned the existing telephone poles and the underground requirement ;
the subdiv�sion ordinance was referenced and confirmed the requirement.
Drainage was discussed with attention given to the impact it would have
on �the possible washout of the trail that extends along the easterly .
property line. Doug McHattie was directed to explore the effect the
drainage would have on the adjacent area of the two lots and what might be
done about it . The matter was held on the agenda for two weeks, pending
the report .

�i�ould change Section 3. 04 with regard to riet lot coverage from 25o to
20% for main buildings, accessory buildings, structures, tennis courts,
swimming pools, service yards and stables, and from 50�o to 35o tY�z areas,
in addi�ion to the above described improvements, included within drive-
ways, parking space, �vallis, patios, decks and asp:halt or concrete paving
of any kind exceptirig roads maintained by the Rolling Hills Comr.iunity
Association . _',ir. Norr�an '�iller, � Chesterfield Road, expressed concern
that adoption of the amendment might preclude his
pool on his property. He was advised that the varpanceng a swimmin�
be available to him, and he was advised to consult with thecCityel;4anager.

Councilman Donald Crocker moved that a proposed ordinance enti.tled
"AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS AMENDING
ORDINANCE N0. 33 ENTITLED "AN ORDINANCE OF THE CITY OF ROLLING HILLS
PROVIDING FOR ZONING IN SAID CITY" be introduced and that reading in
full be waived. The motion was seconded bv Councilman Pernell . After
discussion of the amendment , which increases the side yard setback from
20 feet to 25 feet on RAS-2 lots, the motion was carried by the following
roll call vote:

Councilwoman Swanson moved that the ordinance entitled "AN ORDINANCE
OF THE CITY OF ROLLING HILLS, CALIFORNIA APdENDING ORDINANCE N0. 170 tiYHICH
ORDINANCE AMENDS ORDINANCE NO. 150 AND OR�INANCE NO. 33, ENTITLED "AN
ORDINANCE OF THE CITY OF ROLLING HILLS, CALIFORNIA, PROVIDING FOR ZONING
IN SAID CITY" be in�roduced, and that readin� in full be waived. The
motion was seconded by Councilman Crocker. After discussion the Council
directed that the following changes be made : No. 3 (c) (iii) delete ��r:
further study and consideration at neat meeting�; 3='(c j � (�rYii) �deTete,-�vor
"court" and add word "property" ; 3 (c) (x) referred to the City Attorney
for revised wording. An amended motion was made by Councilman Crocker,
and seconded by Councilman Pernell . Councilwoman Swanson stated that
since she would not be at the next meeting, she wished the record to show
that she would like item 3-c ( iii) left in the ordinance. The ar:�ended

1�Iayor Heinsheimer opened a hearing on an appeal of the Planning
Commission ' s action at the September 30, 1980 meeting recommending
that the tentative map not be approved; filed in a letter dated Octo-
ber 8, 1980 by �Ir. Douglas r�IcHattie , South Bay Engineering Corporation.
Mr. McHattie advised the Council that the total. acreage of the
tract is 19. 87 acres; eight lots are planned, with the smallest lot
2 . 00 acres net , and the largest lot 2.44 acres net . D4r. McHattie
said all grading would be within the requirement of 2 : 1 , and no
import or export of soil would be necessary. The Council reviewed
the Planning Advisor.' s Report dated September 25, 1980 the Negative .
Declaration Environmental Impact Report dated August 11 , 1980 and a
letter dated October 22 , 1980 from Sherman A. Silverman, attorney
for D4rs. Dorothy Kuhne, 6 Johns Canyon Road. Members of the audience
speaking in favor of the. subdivision were James Collis, the subdivider,
his attorney tiYilliam tiVillens, and tiVilliam Peters , 11 Johns Canyon �oad.

overrule the Planning Commission' s decision of September 30, 1980.

Ths City Attorney was directed to prepare formal findin�s and to
put the motion" in writing. Councilman Rose moved to table the vote on

Requests for variances of grading regulations and front setback
requirements. on Lot 92-2-RH, Pine Tree Lane, approved by the Planning
Commission on October 21, 1980, were referred to the Council .
Councilman Crocker moved that the Council take jurisdiction of
Zoning Cases No. 255 and No. 256 , Dr . Martin Goldberg. The motion
was seconded by Councilwoman Swanson and carried by the following roll

The County Engineer' s letter of approval of Tract 33248 dated October
22 , 1980 , was submitted to the Council . The Manager stated all the bonding
had been received and there were no problems involvec�. Council.man Crocker
made the motion that Tract 33248 be approved and that the Council accept
the right to restrict or prohibit the erection of bu�ldings or other
structures , as offered for dedication on said map,• reject the private
streets ; and make findings that the project is in conformity with the
General P1an of the City of Rollin� Hills an.d is not in violation of the
Environmental Quality Act of the State o� California. The motion was
seconded by Councilman Pernell, and carried on the following roll call vo e:

FLYING TRIANGLE LANDSLIDE 070
The Manager briefed the Council on the progress of the work being
done in the landslide area. Discussion folTowed regarding the areas of
responsibility between the City and the Association, and financial �
possibilities .
Themeetir�; was adjourned to a litigation session.
The Council reconvened after the litigation session to report that during
the litigation session they discussed the potentials of litigation that
might be involved in the landslide situation, and, for the purpose of the
tabled motion earlier in the evening, determined to adjourn to Monday,
November 3, 1980 at 7 : 30 P.�•Z.
