11/10/1980438 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL CITY OF ROLLING HILLS, CALIFORNIA November 10, 1980 A regular meeting of the City Council of the City of Rolling Hills was called to order at the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California by Mayor Heinsheimer at 7:30,P.M. Monday, November 10, 1980. ROLL CALL PRESENT: ABSENT: ALSO PRESENT: Councilmembers Crocker, Pernell, Rose Mayor Heinsheimer I , Councilwoman Swanson Teena Clifton William Kinley L. D. Treasurer Deputy City Clerk Attorney Architect League of Women Voters Observer Residents The minutes of the regular.meeting on October 27, 1980 and the adjourned meeting on November 3, 1980 were reviewed and amended. The secretary was requested to make the recommended amendments and re- submit both sets of minutes for consideration at the next meeting. PAYMENT OF BILLS Councilman Crocker moved that Demands No. 9181 through 9221 be approved for payment, with the exception of Demand No. 9182, which is void. The City Treasurer advised that Demands No. 9183, 9192, 9201, 9203, 9215, 9219 and 9221 should be paid from the Fire and Flood Self - Insurance Fund, and the balance should be paid from the General Fund. The motion to approve payment was seconded by Councilman Rose and car- ried by the following roll call vote: AYES: Councilmen Crocker, Pernell, Rose, Mayor Heinsheimer NOES: None ABSENT: Councilwoman Swanson TENTATIVE TRACT 37810, EMMANUEL DAVID, 38 CREST ROAD EAST 376 Mayor Heinsheimer ordered consideration of Tentative Tract 37810 deferred until the next regular meeting on November 24, 1980. ZONING CASE NO. 255, DR. MARTIN GOLDBERG, VARIANCE OF GRADING REGULATIONS 381 The City Manager advised that Mr. Neil Palmer, architect for Dr. Goldberg, requested that the matter be held on the agenda for inform- ation regarding geology on the property, and because Dr. Goldberg is out of the country. Consideration of the matter was deferred until the first meeting in December. ZONING CASE NO. 256, DR. MARTIN GOLDBERG, VARIANCE OF FRONT SETBACK 381 The matter was held on the agenda for consideration at the first meeting in December, at the request of the architect for Dr. Goldberg. 439 November 10, 1980 ORDINANCE NO. 181, LOT COVERAGE 411 Councilman Crocker moved that Ordinance No. 181, entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS RELATING TO LOT COVERAGE AND AMENDING ORDINANCE NO. 33 ENTITLED "AN ORDINANCE OF THE CITY OF ROLLING HILLS PROVIDING FOR ZONING IN SAID CITY" be adopted, and that reading in full be waived. The motion was seconded by Council- man Rose and carried by the following roll call vote: AYES: Councilmen Crocker, Pernell, Rose, Mayor Hei.nsheimer NOES: None ABSENT: Councilwoman Swanson PROPOSED ORDINANCE AMENDING ZONING ORDINANCE RE: SIDE YARDS 450 The City Attorney distributed copies of a proposed ordinance which would amend the Zoning Ordinance with regard to side yard requirements, and he explained that the proposed ordinance was changed following the introduction at the last meeting to include co separate requirements for the RAS -1 zone and the RAS -2 zone. O Following discussion the wording was changed to "RAS:zones" Q without specifying RAS -1 or RAS -2, and the proposed ordinance as Q amended was introduced on a motion made by Councilman Rose, seconded by Councilman Crocker and carried by the following roll call vote: AYES: Councilmen Crocker, Rose, Mayor Heinsheimer NOES: None ABSENT: Councilwoman Swanson The Manager was directed to bring the change to the attention of the Planning Commission at the next meeting on November 18, 1980, since the Commission had made the recommendation to the Council that the side yard setback requirement be changed in the RAS -2 zone. PROPOSED ORDINANCE AMENDING ZONING ORDINANCE RE: TENNIS & PADDLE TENNIS COURT_ Mr. Kinley distributed copies of a proposed ordinance which would 522 amend the Zoning Ordinance with regard to tennis courts, paddle tennis courts and would include any other fenced, paved area used for recrea- tional purposes, and explained that the proposed ordinance was changed as requested by the Council at the last meeting. The proposed ordinance, as amended, was introduced on a motion made by Councilman Crocker, seconded by Councilman Rose and carried by the following roll call vote: AYES: Councilmen Crocker, Pernell, Rose, Mayor Heinsheimer NOES: None ABSENT: Councilwoman Swanson RECESS The meeting was recessed at 8:20 P.M. and reconvened at 8:25 P:M. DISCUSSION: LOTS WITH RESTRICTED USE AREAS 554 The Manager displayed a lot prepared by Envicom Corporation for the Seismic Safety Section of the General Plan as a joint project with other cities on the Peninsula. Mrs. Clifton explained that the map was colored to show landslides, probable landslides and.major filled graben in the City of Rolling Hills. SKE 440 November 10, 1980 Mrs. Clifton advised the Council that Mr. and Mrs. Joseph Lademan, owners of Lot 9-2-RH, were granted a variance of front yard require- ments for construction of a stable in the front yard and a variance of rear yard requirements approving a rear yard setback of 30 feet instead of the required 50 foot setback because of restrictions on the parcel which was created as part of the Graydon Beeks subdivision in 1969. Because the variances, approved in August 1978, have not been acted on and have expired, the owner wishes to re -apply for variances, and Mrs. Clifton said she was reluctant to accept an application for a property with a known geological hazard and restricted use area. The Manager explained that the County Engineer has approved a plan for construction of a house on caissons, and it was her under- standing that the geology for the property has been approved by the County, and in order to proceed with construction it would be necessary for the owner to again apply to the Planning Commission for variances. In a memorandum to the Council dated November 7, 1980 Mr. Kinley recom- mended that the matter be continued on.the agenda for at least three weeks, during which time the file of the subdivision. could be -researched. After discussing the matter members of the Council agreed that since there is no moratorium in effect, the application should be accepted and the burden placed on the applicant, rather than on.staff. Mr. John Broderick, attorney for the Lademans, advised the Council that he has a check list from the County Engineer for construction of a residence, using shear pins to stabilize the property. Mayor Heins- heimer said it is possible that the Council willrequire a second opinion about the acceptability of the construction in a known restric- ted area. Mr. Broderick said that would be acceptable to the Lademans. Mayor Heinsheimer said information is being collected about geological problems in other areas of the City, and he recommended that Mr. Brod- erick and the Lademans review the information being developed. Mrs. Lademan said the geology for the property was done by Mr. Bruce Lock- wood. Councilman Crocker suggested that Mr. Lockwood's reports be updated before it is submitted to the Council. BUILDING IN FLYING TRIANGLE AREA 720 Mr. Edmund Hollis, owner of Lot 32 -FT located on Portuguese Bend Road in the Flying Triangle area, asked about the status of construc- tion in that area. Air. Kinley said construction has been stopped on the order of the County Engineer. Mrs. Clifton said testing in the area is continuing, and work is being done on Pinto Road as the final step before a report is submitted. REQUEST TO CHANGE STREET NAME - PORTUGUESE BEND ROAD 743 Ina memo dated November 10, 1980 the Board of Directors advised the Council that several requests have been received from residents by members of the Board recommending change of Portuguese Bend Road to Rolling Hills Road to clarify directions into the City, to simplify location of the City for persons unfamiliar with local streets, and because it is easier to spell. Bhe Board unanimously voted to request that the Council consider the name change. Councilman Crocker suggested that the Council take the request under advisement, and ask all residents of Portuguese Bend Road to discuss the proposed name change. ABSENCE FROM COUNCIL MEETINGS 770 Councilman Pernell said he will not be present at the next regular Council meeting on November 24. Councilman Crocker said he would not be present at the first meeting in December; Councilman Rose said he may be away at that time also. MAP OVERLAY Councilmen Crocker and Pernell requested that the City Manager obtain an overlay transparent map defining lot lines to be used in conjunction with the map showing landslide areas, to aid in deter- mining what specific lots have landslides on them. -3- 1. 0 W November 10, 1980 GRADING, 10 POSSUM RIDGE ROAD 810 Councilman Crocker said grading on property on Possum Ridge Road appeared to be contrary to the concept of preserving the canyons, and he asked whether there was a violation of grading regulations. The Manager said the owner of the property, S. M. Weeks, was in' the process of developing an avocado grove on his property at 10 Possum Ridge Road. Mrs. Clifton said the work was being done according to a grading plan which was approved by the Board of Directors 'and the County Engineer. The plan was reviewed by the Council, and the City Attorney was requested to report to the Council at the next meeting on measuresthat can be implemented to prevent further grading and development of roads in canyon areas.
