11/24/1980442 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL CITY OF ROLLING HILLS, CALIFORNIA November 24, 1980 A regular meeting of the City Council of the City of Rolling Hills was called to order at the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California by Mayor Heinsheimer at 7:30 P.M. Monday, November 24, 1980. Lyle City Manager City Attorney Deputy City Clerk League of Women Voters South Bay Engineering Resident Minutes of the meetings held on October 20, October 27 and November 10, 1980 were approved and adopted as presented on a motion made by Councilman Crocker, seconded by Councilman Rose and carried by the following roll call vote: AYES: Councilmembers Crocker, Rose, Swanson Mayor Heinsheimer NOES: None ABSENT: Councilman Pernell The minutes of the meeting on November 3, 1980 were approved and' accepted as amended on a motion made by Councilman Rose, seconded by Councilman Crocker and carried by the following roll call vote: AYES: Councilmembers Crocker, Rose, Swanson Mayor Heinsheimer NOES: None ABSENT: Councilman Pernell PAYMENT OF BILLS 215 Councilman Crocker moved that Demands No. 9222 and 92230 9226 through 9237, 9239 through 9241, 9246 through 9251 and 9253 through 9256 be approved from payment from the General Fund, that Demands No. 9224 and 9225, 9238, 9242, 9243, 9244 and 9245 be approved for payment from the Fire and Flood Self --Insurance Fund, and that Demand No. 9252 be voided, total payment in the amount of $23,611.44. The motion was seconded by Councilwoman Swanson and carried by the following roll call vote: AYES: Councilmembers Crocker, Rose, Swanson Mayor Heinsheimer NOES: None ABSENT: Councilman Pernell F� co Co O a Q a 443 November 24, 1980 TENTATIVE TRACT 37810, EMMANUEL DAVID, 38 CREST ROAD EAST 227 Mayor Heinsheimer opened discussion of Tentative Tract 37810. The Manager reported that she made a field trip to the site with Councilwoman Swanson and Mr. McHattie, the engineer, to view the drainage in the area in response to concerns expressed. Mrs. Clifton said the drainage problem is an off-site situation.' Mr. McHattie presented a.hydrology study, and advised the Council that development of the new lot will result in 1.6% additional runoff. Mr. McHattie explained that many properties in the area contribute runoff which results in a drainage problem in the area and it appears that a large gunnite channel to contain the water is the only solution. Councilwoman Swanson said the trail going toward Caballeros Road will be straightened and she asked that when the trail is re -graded, the soil be compapted to eliminate erosion. Mayor Heinsheimer asked the Engineer to prepare recommendations for presentation to the Council for consideration of conditions to be incoporated into approval, if the tract is approved. Councilwoman Swanson asked that fencing of the trail north of the David property to separate it from the Washburn pro- perty be included in the recommendations. The Manager recommended that the request be referred to the Community Association, since it applies to the trail easement. Mr. Kinley recommended that the requirements discussed by the Council be included as conditions of approval in ad- dition to the Planning Advisor's Report, and the Mayor asked that the City Attorney and Engineer work together to prepare the presentation for consideration by the Council when considering the tract. Mayor Heinsheimer ordered the matter held on the agenda. PROPOSED ORDINANCE, SIDE YARDS . 342 In a memo to the Council dated November 24, 1980 Jody Murdock, Chairman of the Planning Commission, advised that members of the Plan- ning Commission are of the opinion that a requirement for side yards of not less than twenty five feet in all RAS Zones would impact severe- ly on the RAS -1 Zone. Chairman Murdock requested that the Side Yard requirement in Section 3.07 of Ordinance No. 33 be amended.to require that every lot or parcel in the RAS -2 zone have side yards of not less than twenty five feet, and that every lot or parcel in the RAS -1 zone have side yards of not less than twenty feet. Following discussion Councilman Crocker moved that the ordinance be introduced as amended, as recommended by the Planning Commission Chairman. The motion was seconded by Councilwoman Swanson and carried by the following roll call vote: AYES: Councilmembers Crocker, Swanson, Mayor.Heinsheimer NOES: Councilman Rose ABSENT: Councilman Pernell ORDINANCE NO. 182, TENNIS COURTS, PADDLE TENNIS COURTS, PAVED RECREATION AREA Councilman Rose moved that Ordinance No. 182 entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS, CALIFORNIA AMENDING ORDINANCE NO. 170 WHICH ORDINANCE AMENDS ORDINANCE NO. 150 AND ORDINANCE NO. 33 ENTITLED "AN ORDINANCE OF THE CITY OF ROLLING HILLS, CALIFORNIA PROVIDING FOR ZONING IN SAID CITY" be adopted, and that reading in full be waived. The motion was seconded by Councilman Crocker and carried by the follow- ing roll call vote: AYES: Councilmembers Crocker, Rose, Swanson, Mayor Heinsheimer NOES: None ABSENT: Councilman Pernell Mr. Gerald Katell, 27 Crest Road West and Mr. Ed Lyle, 36 Portuguese Bend Road, were referred to staff for clarification and discussion of specific questions about consideration of tennis courts for their pro- perties. -2- 444 November 24, 1980 WALL CONSTRUCTION, 68 PORTUGUESE BEND ROAD 534 The Manager reported that Dr. Jonathan Po, 68 Portuguese Bend Road, requested that discussion of the.matter be deferred. The Mayor so ordered. CONTROL OF LITTERING - REVI,EW OF ADEQUACY OF ORDINANCE 538 Mayor Heinsheimer said he is concerned about the possible increase in littering that.may result from closure of the local landfill. Ex- cerpts from the City Code with reference to manure accumulation, litter- ing and rodent and pest infestation were distributed. The Manager said she had discussed the matter with weed abatement personnel, and they said they would be working with cities to control the problems. Mayor Heinsheimer suggested that the City staff join with .Community Association staff.to develop an educational program for residents through the Newsletter, and that a community transfer facility be considered, with residents paying for use of such a local transfer facility. The Manager was asked to remind residents in the Newsletter of the closure of the landfill at the end of the year. PROPOSED ORDINANCE ADOPTING MUNICIPAL CODE 620 The City Attorney distributed copies of a proposed ordinance and said it would be necessary to hold a public hearing, before adopting the Municipal Code. Councilman Rose moved that the proposed ordinance entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS ADOPTING THE ROLLING HILLS MUNICIPAL CODE AS THE MUNICIPAL CODE OF THE CITY OF ROLLING HILLS AND MAKING SUBSEQUENTLY ADOPTED ORDINANCES A PART OF SAID CODE be introduced, and -that reading in full be waived. The motion was seconded by Councilman Crocker and carried by the following roll call vote: AYES: Councilmembers Crocker, Rose, Swanson, Mayor Heinsheimer NOES None ABSENT: Councilman Pernell Mayor Heinsheimer set the public hearing for the first meeting in January, 1981. L. A. COUNTY FIRE DEPARTMENT - BLOOD PRESSURE TESTS The Manager advised that effective December 6, 1980 blood pressure tests will be available at all Los Angeles County Fire Stations on Saturdays, 9 a.m. to noon and on Wednesdays from 4 p.m. to 8 p.m. The notice was received for the file. WATER MAIN BREAK - RANCHERO ROAD 630 The Manager reported that in addition to two prior breaks in 4" water lines on Ranchero Road, there has been a break in the 6" main. Mrs. Clifton said the 4" line provides domestic service; the 6" main is for fire flow. The corporate office of California Water Service has requested a map of the area delineating the slide area for use in a plan to install the lines above ground. Mrs. Clifton said she will meet with the County Geologists in a few days and the report addressing the Council's concerns and making specific recommendations, including cost estimates, will be presented in preliminary form. Mayor Heinsheimer asked that the preliminary report be presented to him and to Councilman Crocker for review before publication. -3- 445 November 24, 1980 CITY INSURANCE PROGRAM 666 The insurance program for the policy period November 26, 1980 to November 26, 1981 prepared by Cal-Surance Association was presented to the Council. The Manager reported that the program includes earthquake insurance for the City Hall and the Maintenance Building, and an increase in coverage for the buildings based on an appraisal last summer, and the premium is approximately $4,000 less than the previous premium. Councilman Crocker asked whether there was any coverage for slide liability, or for possible defective corrective work. Councilwoman Swanson asked whether additional coverage would be required for the Dial -A -Ride taxi. Mrs. Clifton said Cal-Surance asked to be notified when the service starts; Mr. Kinley said the City should be named as an additional insured on the carrier's policy. Mr. Kinley was asked to review the coverage. REGIONAL SHERIFF SERVICE MEETING 695 Co Councilman Rose reported that he and the City Manager attended a Co meeting with representatives of the cities participating in Regional O Sheriff Service. From the statistics presented it appears that Rolling Q Hills is getting more service than originally allocated, and more than was received under the single city plan. Mrs. Clifton said she thinks Q the regional plan is working well for.Rolling Hills, and dur.ing.the Q recent period of extremely low humidity, two unmarked arson cars were located in Rolling Hills. PALOS VERDES PENINSULA UNIFIED SCHOOL DISTRICT 715 Mayor Heinsheimer distributed copies of a letter dated November 17 1980 from Ann Hinchliffe, president of the Board of Education, Palos Verdes Peninsula Unified School District. Mrs. Hinchliffe said the District wishes to cooperate with the City to ensure that -legitimate concerns in connection with use of the La Cresta School site by Harbor College are resolved. The Mayor said he discussed the matter with Mrs. Hinchliffe, and he considers the request a reasonable one. Councilman Crocker suggested that one member of the Council and one member of the Planning Commission be asked to meet with the school board. Council- man Rose suggested that a copy of the.letter be sent to the Rolling Hills Community Association for information, with a memorandum out- lining the Council's response. VANDALISM 793 The Mayor said he has been advised that there is vandalism on Crest Road East in the vicinity of the Saffo home on weekends, involv- ing moving of large rocks into the road, and he asked that the Sheriff be advised of the problem. LETTER FROM ARCHITECTURAL COMMITTEE 795 Mayor Heinsheimer said the Architectural Committee is preparing a letter to the Council regarding plans submitted to the Committee for construction on difficult.building sites. MANAGEMENT REVIEW 815 The City Council discussed the two manager system which --has been been in operation for the City and Community Association for the past year. Following the discussion by the .Council of the management plan for staffing of the City and Rolling Hills Community Association, the Council asked that the City Manager write a report auditing the per= formance of the over all staff without regard to the distinction between the City and Association, and to include recommendations for future actions which could be implemented jointly to assure cost- effective performance. After review by the Council the report will be submitted to the Board of Directors for consideration. Im 446 November 24, 1980 PLANNING COMMISSION APPROVAL 840. In a memorandum dated November 24, 1980, the Council was advised that at a regular meeting on Tuesday, November 18, 1980 the Planning Commission approved a request for a variance of front setback require- ments for Charles Ramsdell, Lot 37-RH, 8 Williamsburg Lane. With the concurrence of the Council,. Mayor Heinsheimer ordered the correspondence received for the file, with no action to be taken by the Council. OFFICE CLOSURE The City Attorney advised the Council that his office will be closed until December 8, but he will be available to the staff by telephone. RESTRICTED USE AREA, TRACT 22083 870 Mr. Kinley displayed a tract map for Tract 22083, recorded in 1969, and defined the area in which seepage pits are prohibited, and the area in which there is a geological hazard. Mr. Kinley said the owner of Lot 2 plans to build a home on the property, and his appli- cation for a variance will be considered by the Planning Commission at the next meeting. Mr. Kinley said the restricted use areas are noted on the final map, and he recommended that the County be asked to have the matter reviewed by an independent engineer. The Manager was directed to advise the County Engineer that no building permit is to be issued until the matter has been resolved. MODIFICATION OF ARCHITECTURAL ROOM 976 In a memo dated November 24, 1980 the Association Manager advised the Council that the Board of Directors has authorized an expenditure not to exceed $800 to modify the Architectural Room by partitioning a section for use by the Association Manager, subject to approval by the City Council. The modification was approved in a motion made by Councilman Rose, seconded by Councilman Crocker and carried by the following roll call vote: AYES: Councilmembers Crocker, Rose, Swanson, Mayor Heinsheimer NOES: None ABSENT: Councilman Perne.11 BILL FOR LITIGATION, D. KUHNE 1075 Councilwoman Swanson requested a breakdown of costs on the state- ment submitted by the City Attorney for litigation filed by Dorothy Kuhne. Mr. Kinley itemized the charges for the Council. PUBLIC HEARING, ROLLING HILLS ESTATES 1097 The City Manager advised that the City of Rolling Hills Estates will hold a public hearing on Tuesday, November 25 to consider requir- ing fire retardant roofing material in that city. Mrs. Clifton was authorized to appear on behalf of the Rolling Hills City Council and to urge that Rolling Hills Estates require fire retardant roofs.
