A regular meeting of the City Council of the City of Rolling Hills
was called to order at the Administration Building, 2 Portuguese Bend
Road, Rolling Hills, California by Mayor Heinsheimer at 7:30 P.M.

Minutes of the meeting held on November 24, 1.980 were approved and
accepted as amended on a motion made by Councilman Rose, seconded by
Councilwoman Swanson and carried unanimously.
The Manager requested that the minutes of the November 24 meeting
reflect t.hat the ManagementReview and request for an audit of perform-
ance of staff wereinitiated by.the Council, and not on the recommenda-
tion of the City .Manager: The Mayor so: ordered.
PAYMENT OF BILLS
Councilman Pernell moved that Demands No. 9257 through 9270,
9273 through 9276, 9279, 9281 through 9288, 9290 through 9297.and
9300 be paid from the General Fund in the amount of $12,505.50; that
Demands No.. 9271, 9272, 9280 and 9289.be voided, and that Demands No.
9277, 9278, 9298 and 9299 in the amount of $6,014.34 be paid from
the Fire and Flood Self -Insurance Fund.
ORDINANCE NO. 183 945
Councilman Pernell moved that Ordinance No. 183 entitled AN.
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS AMENDING
ORDINANCE NO. 33 ENTITLED "AN ORDINANCE OF THE CITY OF ROLLING HILLS
PROVIDING FOR ZONING IN SAID CITY" be adopted and that reading in
full be waived. The motion was seconded by Councilwoman Swanson and
carried by the following roll call vote:
AYES: Councilmembers Pernell, Swanson, Mayor Heinsheimer
NOES: Councilman Rose
ABSENT: Councilman Crocker
Councilwoman Swanson suggested that the Planning Commission
members be thanked for their -work in connection with the ordinance.

according to Rolling.Hills Community Association standards with
regard to construction and landscaping ,,and it is in the road easement
in Crest Road,.under the jurisdiction of the Community Association.
Mrs. Clifton said the question of safety of the installation was put
before the Council in April 1980,and is being reviewed by the County
Engineer, GouVis Engineering and a soils engineer. Councilwoman
Swanson said the record should show that '-a request that the matter
be placed on the agenda was made by Mr. ' V ' illiam King in a letter
dated November 11, 1980, sent by certified mail.

addressed the Council and sdid.he initiated the project in a letter
dated April 25, 1974 to Mr. Philip, Battaglia, who was then,a member
of the City Council and th*e,Boa.r -rd . of°Di..reOtOrs of the Community Associ-
ation. On November 4, 1974'.a.lettemas sent to the City Manager, and

ation and was executed in August 1976-., r. Mohr said the contract
will come up for renewal wit'h.fhe'!'Co , mm unity Association on August 1,
1981. Mr. Mohr said the City took out..a building permit for the
building and transmitters oin-July :5, 1978, and he read into the
record specifications from the.lease''for the building, approximately
800 square feet, for the housing of -communication equipment, and
three antenna towers, which shall not exceed 75 feet in height. Mr.
Mohr said that prior to that time he had been using Federal land
and land owned by the Water Company.for approximately 10 years
without a lease... In response to a question from Councilman Rose,
Mr. Mohr said his.an ' tenna are approximately 30 feet closer to the
William King residence than antenna on, Federal land. Councilman
Pernell asked whether Mr. Mohr has had any problems with the appara-
tus, which is highly wind, resistant. Mr. Mohr said that in February
1978 three telephone poles on t.he,Federal,property were tipped approxi-.
mately 30 degrees by high winds._66rpii-fig from a,southerly direction- The
poles wereab6ve road level-, and did not touch the ground, but did tip.
He said the tipping was caused -by 4 -combination of rain -soaked earth
and high winds, and was a slow process,_. taking about six hours to
reach the maximum angle. Councilm*afi�P'6rnell asked whether there was
any other damage, such as discs 1516 -wing off, and Mr. Mohr said there

was not. Councilman Rose said it was .his understanding that Mr. and
Mrs. King were aware of the installation and discussed it with the
City Manager before they purchased their home, and he said the only
consideration for the City is health and safety; and not appearance
or aesthetics. Mayor Heinsheimer asked whether it would be possible
to keep the building in the Community Association easement and remove
the poles to a location removed from the building. Mr. Mohr said it
would result in loss of microwave lines. Mr. Mohr sketched the poles
and building as they exist. Mayor•Heinsheimer asked if the equipment
could be moved to the adjacent property, and Mr. Mohr said it is pos-
sible that it could.
The Mayor asked Mr. Ivan Bullum, District Engineer; Los Angeles
County; to speak to the matter . Mr. Bullum said Mr. Gouvis of Gouvis
Engineering has submitted an acceptable design that probably will be
approved from•.the standpoint of.safety within the coming week. The
calculations have been reviewed and it appears that the construction
will be able to withstand winds of the velocity described by Mr. Mohr.
Mr. Bullum said the'.site was found to be safe by soils engineers, but
it is impossible to verify the embedment of the installation, so the
engineer has changed the design so the stability of poles does not
CO depend on embedment. Mr. Bullum said that with all construction. above
0 the ground as proposed the installation can be inspected.. Mrs. Clifton
Q said that when the building permit was typed, through clerical error
Q the permit was issued for communications equipment building, without
Q mention of the antenna, although the Conditional Use Permit and Com-
munity Association.Building Permit included all construction; there-
fore the inspection of antenna is for "as built" construction. Mr,
.Bullum gave a brief description of the planned construction, stating
that the poles will be .tensioned against one another. He said that.
his comments pertain only to the construction on Rolling Hills pro-
perty, since construction on Federal land is out of his juri.sdiction.
Mr. Bullum said verification.of calculations and plans submitted should
be completed within a week. Mr. Mohr said construction will start as
soon as soon as plan check is completed and the necessary permits are
issued. Councilwoman Swanson asked about the geology requirements. Mr.
Bullum-.said the.geology was approved by.the County in.May or June, 1980.
Mrs. Clifton advised the Council that the poles pass rigid tests when
they are manufactured, as an additional element of safety and stability.
Mr. Mohr said the contractor who installed the poles is present at the
meeting. Councilman Rose asked Mr. Mohr about liability insurance, -and
he said he has $500,000 as a requirement of the franchise agreement.
Mayor Heinsheimer said the City's Seismic Safety Plan indicates that
neither the land on which the installation was constructed nor the
property owned by the Kings is in current or ancient landslide.
Mr. William King, owner of the property at 92 Crest Road East,
circulated a.picture of the poles which tipped in a severe storm as
described by Mr. Mohr, and he said he is concerned about the safety
of his family and his property. Mr. King said he had a copy of a
letter dated August 25, 1980 to Mr. Mohr from the Army Corps of Engin-
eers advising him that the four pole installation on Federal land was
found to be unsafe, and ordering him to remove the installation by
November 1, 1980. Mr. King said that since Gouvis Engineering.could
not certify the depth of the installation on Rolling Hills property,
he asks assurance that the installation is safe. In response to
questions, Mr. King said it is his understanding that the poles shown
in the photo are not presently on the property, but were replaced by
the poles being discussed. Further, Mr. King said there are no "as -
built" drawings for the construction he is concerned about.
Mayor Heinsheimer said many of the comments made pertain to
inspections and esthetics, which are Association matters and should
be discussed with the Board. He asked Mr. Mohr whether the existing
poles would reach the King property if the poles were downed. Mr.
Mohr said the poles would reach the King property, but would not
reach the King residence.
Mr. King submitted a petition for removal of the antenna site
as being unsightly, a nuisance, and extremely dangerous to the resi-
dents of the area, signed by 60 Rolling Hills residents. Mayor
Heinsheimer received the document for the file, and said all inform-
ation on the subject would be made available to Mr, and Mrs. King.

Councilwoman Swanson asked Mr. Bullum whether he had any concerns.
about the construction or safety of the.three'pole antenna structure.
Mr. Bullum said that based on 'drawings submitted that afternoon he
would say preliminarily that it
appeared to meet all requirements, and
it was his opinion on that after calculation's were verified a permit would
be issued. Mayor Heinsheimer asked whether future inspections would be
made if expansion would be limited. Mr; Bullum said no further addi-
tions could be made without additional inspections.
Councilman Rose said the main concern c I e I rn is'.tilting, and he asked
whether there is a danger of fire from..sudh an incident. Mr,. Mohr
said there is no.voltage in the antennas, . which are for radio fre-
quency.
Mrs. King said that there is no mention of discs mounted on the
poles in the agreement,
, and.discs are not shown on the drawings. Mr.
Don Tuffli, 16 Eastfield Drive, said -he 'was not advised before the

is approved by the County. 'CouncilmanRose said the first, time around
the Environmental Quality Board found that the installation would not
have an adverse,impact on the Community, and a Negative Declaration was
issued, with conditions. Councilman Rose said aservice is being pro-
vided for the'Community; and the question before, the Council is safety,
which will be improved by the -modifications shown on drawings submitted
to the County, and not aesthetics. Mayor Heinsheimer affirmed that the
City is considering the complaint from the standpoint of safety, and
approval of the improved safety factor as verified by the County's re-
view of the calculations and drawings submitted does not in any way imply
that there is an opinion by the City on matters properly governed by the
Community Association, including aesthetics and renewal of contract.
Councilman Pernell said he agrees that the structure must be made as
safe as possible, and he said the City does benefit from the element of
safety provided by the communication system.
Mayor Heinsheimer said he wished to summarize the response to Mr.,
King's question about the Council's course of action to be taken,
without prejudice to the Community Association's response,- which may
be different.,, The Mayor -said
said the ' corrective work to provide maximum
safety W'illtbb submitted t6,%.he.County,'and after approval will proceed
as quickly as possible, siblei, with*la'lll information available to Mr. King.
He said the staff will -figure out a procedure to monitor the project,
to assure that --,a *--reasonable-,factor, of safety is maintained; specifically
with regard to addition of dishes. Mr. Mohr is to be advised of the
limitation on working hours, except for emergencies, and the Mayor said
that since there was a representation that TV reception would not be
impacted, there ,should be an effort by Mr. Mohr to see that that is so.
Mr. King said he wished to express his objection that he is required=
to install underground utilities as a condition of approval of improving
his residence, while a commercial activity involving 75 foot high poles
was approved, and he asked that Mr. Mohr not be permitted to proceed.
Councilwoman Swanson said she wished to emphasize thatthe con-
struction is of utmost concern, specifically -to residents of the East-
field area, and she asked that the County exercise concern before
issuing the permit for the .work proposed. Further., Councilwoman
Swanson said no' additional dishes should be allowed, and the staff
should enfoice''.the restriction on working hours.
Mayor Heifisheimer-thanked the residents who appeared before the
Council on the matter,' and said additional information would be Pre-
sented as it becomes available.

DR. JERRY GREENHUT, TRACT 30345, FENCE REPLACEMENT, BLACKWATER CANYON RD. 46E
The Manager reported that the fence which was removed from the
Woodley property when work was done on Blackwater Canyon Road in con-
nection with the Greenhut property is being replaced, and she asked that
the matter be removed from the agenda. The Mayor so ordered.
RESIGNATION FROM TRAFFIC COMMISSION

A letter of resignation from the Traffic Commission submitted by
Mrs. Joann Haberman, 19 Georgeff Road was accepted with regret on a
motion made by Councilman Rose, seconded by Councilman Pernell and.
carried unanimously. The Mayor asked that the vacancy be announced in
the Newsletter. Chairman Swanson said she has received one resume and
expression of interest in the appointment, and would keep it to be re-
viewed with other applications submitted.
RECOMMENDATIONS OF TRAFFIC COMMISSION 493
Traffic Commission Chairman Swanson presented excerpts from the
W minutes of a meeting of the Commission on December 2, 1980, containing
recommendations of the Commission that:a sign or..signs:be placed in a
O location chosen to give adequate warning,.advising that Upper Black-
water Canyon Road is nota through street,'and giving the numbers -of
Q houses: located on the.road.
Q Councilman Rose moved that the Council adopt the recommendations
Q of the...Traffic Commission and that the City Manager be authorized to
carry them out. The motion was seconded by Mayor Heinsheimer and
_carried by the following roll call vote:

Additional recommendations by the Commission, based on.recommend-
ations in a study of Saddleback Road near Hillside Lane by Ed•Rugel,
Los Angeles County Traffic Engineer, for the following:
1. Relocate the cluster of 5 mail boxes for residences at
2, 3, 4, 5 and 6 Hillside Lane form the east side of
Saddleback Road to the north side of Hillside.Lane,
approximately 100 feet west of Saddleback Road.
2. Relocate the single snail box for #46 Saddleback Road from
its existing location 130 feet north of Hillside Lane to
a point about 375 feet north of Hillside Lane.
3. Recommend against installation of "Caution Blind Driveway"
type signs prior to any of the driveways near this location
were submitted to the Council, and in addition the Traffic Commission
requested approval of installation of a 20 mile per hour advisory sign
posted for northbound traffic with a curve warning sign, on Saddleback
Road in the vicinity.of Hillside Lane.
The recommendation was approved in a motion by Councilwoman Swanson,

Mrs. Clifton said Mr. Jerry Sass, 46 Saddleback Road, advised her
that it considered the recommendation that his mail box be changed.from
the present location near his driveway an increased hazard for him.
Councilman Pernell said that since Mr. Sass was advised of the meeting
of the Traffic Commission and did not appear to express his opposition
to Mr. Rugel's recommendation, he thought it should stand.

APPOINTMENTS, ENVIRONMENTAL QUALITY BOARD 580
A request by Chairman Jody Murdock that the following appoint-
ments be made to the Environmental Quality Board to comply with re-
quirements of the Ordinance: Betty Hesse, Vice Chairman; Judy Hollings -
head, Secretary; and June Cunningham, Recording Secretary, was approved
on a motion made by Councilman Rose, seconded by Councilman Pernell and
carried unanimously.
PLANNING COMMISSION ACTION, MASON ROSE, 37 CREST ROAD WEST
Copies of a letter to Mr. Rose from Planning Commission Chairman
Jody Murdock, advising that the request for a variance of side yard
requirements on Lot 241 -A -3 -MS was tentatively approved in the field
on November 25, 1980, subject to submittal of a revised plan showing
the actual proposed location of the paved area, elimination of the
masonry posts in the easements and elimination of side and rear ease-
ments shown on the map originally submitted, were distributed to the
Council. Mayor Heinsheimer asked that the matter be referred to the
Council after final approval has been given.by the Planning Commission.
TENTATIVE TRACT 37810, EMMANUEL DAVID,.38-CREST ROAD EAST 626
Copies of the Findings'of Fact.and Formal.Report in the Matter of
the Application of Emmanuel David, Subdivider,, Tentative Tract No. 37810,
were distributed by the City Attorney. The findings were corrected on
Page 1 to show that the the matter first came on for hearing on Novem-
ber 24, 1980, and was continued to the 8th day of December, 1980, and
that all members of the City Council, except Councilman Donald Crocker
were present at the meeting.
Councilman Rose moved that Tentative Tract 37810 be approved,
subject to the following findings and conclusions.commencing on Page.2:
1. Notice of the time and place of the hearing of the matter by
the City Council has been given as required by law.
2. Tentative Tract No. 37810 consists of approximately 8.7 acres
of land which is proposed by applicant to be subdivided into two
lots, one of said lots being improved with a residential dwelling,
and the remaining lot being vacant and unimproved, each of said
lots having not less than two acres net area as required by the
Subdivision Ordinance of the City of Rolling Hills;
3. The land in said Tentative Tract is located easterly of
Caballeros Road and northerly of Crest Road in the City of
Rolling Hills;
4. The land in said TractNo. 37810 is now zoned RAS -2
(Residential, Agricultural, Sub.urban), two -acre minimum lot
size;
5. The improved residential dwelling located on one of the
lots in said Tract is now being occupied as such and the re-
mainder of the property remains vacant and unimproved;
6. Tentative Tract 37810 is in conformance with the General
Plan:of the City of Rolling Hills and will not unreasonably
interfere with the free and complete exercise by a public
entity and/or a public utility, rights-of-way and/or easements
within the Tract;
7. The Environmental Quality Board has heretofore caused a
Negative Declaration to be made, which Negative Declaration
was based on facts presented to the Environmental Quality Board
at a hearing held on said proposed Tentative Tract No. 37810
and said Negative Declaration is hereby approved and the Com-
mission finds that the Tentative Tract will not have a signifi-
cant effect on the environment and therefore does not require
the preparation of an Environmental Impact Report;

8. The City Council further finds that no violation of sewer
discharge requirements will occur as a result of the approval
of said Tentative Tract Map as provided for in Section 66476.6
of the Government Code;
9. The City Council further finds that:
(A) The Tentative Tract Map of Tract No. 37810 is not
inconsistent with.the applicable General and Specific
Plans of the City of Rolling Hills;
(B) The design ' or improvement of Tentative Tract No. 37810
is not inconsistent with the applicable -General and Specific
Plans of the City of Rolling Hills.
(C) The site of said Tentative Traci No. 37810 is physically.
suitable for the type of residential development shown on
said proposed map.
(D) The site of Tentative Tract No. 37810 is physically
suitable for the proposed density of the proposed CO resi-
CO dential development;
0 (E-) The design of Tentative Tract No. 3'7910 I or - the proposed
4% improvements to be constructed thereon, are not likely to
cause substantial environmental damage or substantial and.
avoidable injury to fish or wildlife or their habitat.
(F) The design of Tentative Tract No. 37810 and the im-
provements to be located or constructed thereon, will not
cause serious public health problems; and
(G) The design of said Tenatative Tract No. 37810 or thea
type of improvements to be,constructed thereon will not
conflict with the easements acquired by the public at
large for access through or use of property within the
proposed subdivision.
10. Because of the terrain and characteristics of the property
to be subdivided and title limitations, lot width requirements
and depth requirements, as required by Sections 11-2.154(b) and
11 -2.,154(d) -of the -Subdivision Ordinance -of -the City are modi-
fied and the proposed lot width and depths as shown on said
Tract Map are approved;
11. Subdivider shall comply with the following conditions:
(A) through (N) inclusive...
The motion was seconded by Mayor Heinsheimer.Councilwoman Swanson
asked about the requirement in Paragraph (E), and the paragraph was
corrected to read: Subdivider shall construct and install a drainage
facility on Lots 1 and 2, within an area extending along.a portion of
the easterly boundary of said Lots, to the satisfaction of the City
Engineer, for a distance of not less than 150 feet or more than 300 feet.
Councilwoman Swanson said requirements for recompadtion of the trail
in the portion that is to be re -graded, and double fencing to separate
the property from the horse trail, discussed with the engineer at the
last meeting, should be included in the findings. Mr. McHattie, engin-
eer for.:Mr. David, said the subdivider will grade and re -compact the
trail as required, and the fencing required Will be installed. Mr.
Kinley said Paragraph (0) should be added as follows: (0) The subdivider
shall re -grade and compact the bridle.trail-along the northerly boundary
of Lot 2 to the satisfaction of the staff, and install a standard Rolling
Hills 3 rail fence on the southerly side of.said bridle trail. Mayor
Heinsheimer suggested that the requirement be for double fencing, subject
to the approval of the Community.Association, and directed that the ad-
dition be made to the Findings. Councilman Pernell-said that it appears
that the property lies 'Within an area designated in the General Plan as

landslide area, and he suggested that. an appropriate. note be placed
on the map. Mr. Kinley said the note will be on the final map-.
Councilman Perneli movedthat the findings be amended to include a
note that the property may have a geological hazard and should be so
indicated on the map. The City Manager asked that the addition of
the statement be referenced to the appropriate map by date. Mr..
Kinley said the subdivider's engineer should verify such a condition
before the notation is put on the map.
Because of_the number of additions and corrections, Mayor Heins-
heimer ordered the approval tabled until the corrected.report is
prepared by the City Attorney and t -he geological hazard on the pro-
perty is verified by the Engineer.
GEOLOGY REPORT, FLYING TRIANGLE AREA

Mayor Heins.heimer said that Los Angeles County Geologists had
promised that their report on the geology in the Flying Triangle
would be ready for review by the Council by December 1. Because the

the report be made available to anyone who wishes to see it when it is
presented, and he asked.that staff arid the ICouncil review the report as
soon as possible after it is presente'd.to avoid additional delay.
LA CRESTA SCHOOL USAGE 878
Mayor Heinsheimer reported that he and Planning Commission Chairman
Jody Murdock met with representatives of the Palos Verdes School Board
Ann Hinchliffe and Neal Hertzman to discuss use of La Cresta School by
Harbor Community College. Long range versus short.range planning for
use of the school was discussed, and Mrs. Murdock is going to work with
members of the School Board to•obtain the information required for the
Environmental Impact Report. Summer usage of the site was discussed,
and the School Board said definite plans have not been made for use of
the site during the summer. A study of eventual use of the abandoned
school sites is continuing, and in the.interim Harbor College is using
the La Cresta site while information for the EIR is being gathered.
Mayor Heinsheimer suggested that Mrs..P.4urdock be designated as
liaison between the. Rolling Hills Community Association and the School
Board in any matters concerning the Community Association. Mr. Kinley
said he would make the recommendation to the Board of.Directors.
APPOINTMENT TO RTD. BOARD , 970.
P:iayor Heinsheimer advised members of the Council that newly elected
Supervisor Deane Dana had requested the resignation of Councilwoman
Gordana Swanson from the Board of Directors of the Rapid Transit District
appointment'made by Supervisor Yvonne Brathwaite Burke before she left
office. The Mayor said that because Councilwoman Swanson is highly
qualified for the position, he felt that she should be supported by the
Council. Members of the Council concurred and the Mayor asked Council-
woman Swanson to,provide him,with copies of the telegram from Supervisor
Dana and the letter written by Councilwoman Swanson in reply, so they
can be circulated with a letter from the Mayor to organizations with a
request for support.
GEOLOGY, JOSEPH. LADEMAN, 48 SADDLEBACK ROAD 1044
The Manager _.presented• a paper delivered to her by Mr.- Ivan Bullum,
Los Angeles Couhty'Engineer, summarizing the progress of geology approval
on the Joseph Lademan property at 48 Saddleback Road. Mrs. Clifton said
the request by Mr. Lademan for variances on the property will be heard
by the Planning Commission on December 9. The Mayor directed that the

matter be placed on.the next City Council agenda, with a report of
the Planning Commission's action.
LEGISLATIVE COMMITTEE TOUR, CALIFORNIA CONTRACT CITIES 1066
The City Manager said she wished to attend the annual Legislative
tour sponsored by California Contract Cities in January. Approval of
the Manager's attendance and payment of her travel funds was given. by
unanimous vote of the Council.
