A regular meeting of the City Council of the City of Rolling Hills
was called to order at the Administration Building, 2 Portuguese Bend
Road, Rolling Hills, California by Mayor Crocker at 7:30 P.M. Monday,

CHIEF ADMINISTRATIVE OFFICER RE: CONTRACT SERVICES PROGRAM RENEWALS 63
A letter from the City -County Coordinator and renewal agreements
for services requested by the City were presented to the Council. The
Manager recommended that the.Agreement for Examination of Tract Maps
be renewed for a period of five years, to expire on June 30, 1986) to
be renewable for additional periods not to exceed five years, be exe-
cuted by the Mayor. Mrs. Clifton also recommended that the Agreement

for Animal Shelter Services be renewed for a period of five years as
recommended by the City/County Coordinator"to reduce the annual cost
factor for both the Cities and the County.
Councilman.Pernell moved that the Council authorize the Mayor to
execute both agreements_. The motion was seconded by Councilman Rose
and carried by the following roll call vote:

REQUEST FOR TIME EXTENSION, TENTATIVE TRACT 27006, DR. MAX NEGRI 74
In a letter dated April 14, 1981 Mr. Douglas McHattie, South
Bay Engineering Corporation, requested a time extension of one year
in order to satisfy the County requirements on Tentative Tract
No. 27006, Dr. Max Negri. The Manager reported that the tentative
map was approved on November 13, 1979, and the approval would expire
on May 13, 1981 unless extended by the Council.
A_motion to approve the request for a one year time extension
was made by Councilman Pernell, seconded by Councilwoman Swanson and
carried by the following roll call vote:

REQUEST FOR REACTIVATION OF TRACT NO. 33962, BEATRICE MORRIS 80
In a letter dated April 27, 1981 Mr. McHattie requested reacti-
vation of Tract No. 33962, advising that the tentative map approval
lapsed without a request for an extension of processing.time. Mr.
McHattie said the applicant wishes to continue with the processing
of the final map, and it is necessary to obtain a new tentative -ap-
proval from the legislative body before the City Engineer can continue
wi_.th the processing.
In discussing the matter the Manager advised.the Council that
Virtually all work done on the tentative map will have to be repeated
because in the time that has elapsed there have been changes.of person-
nel, and different people will be reviewing the map. Following the
discussion the Council agreed that the applicant should be required to
re -file the tract, with all fees to be charged, and the request to re-
activate the tract was denied.
FILING FEES -:SUBDIVISION 104
Mrs. Clifton reported that in discussing subdivision fees with
Mr`. McHattie, he said.it was his opinion that the fees charged for
final map processing were too high. Mayor Crocker asked the Manager
to research the matter.of the fees charged and make a recommendation
to the Council at a future meeting.
PAYMENT OF BILLS 117
Councilman Rose moved that Demands No...9577 through 9594 in the
amount of $12,328.09 be approved for payment from the General Fund,
and that Demands No. 9595 through 9598 be approved for payment in the
amount of $4,.163.78 from the Fire and -Flood Self Insurance Fund. The
motion was seconded by Mayor Crocker and carried by the following roll
call vote:

AGREEMENT COVERING A JOINT INSURANCE PROGRAM FOR HEALTH, MEDICAL,
DENTAL, LIFE AND PRESCRIPTION DRUG INSURANCE 136
The Manager presented an agreement for a joint insurance program
for health, medical, dental, life and prescription drug insurance by
the cities of Rancho Palos Verdes, Rolling Hills and Rolling Hills
Estates. Mrs.. Clifton said that if the resolution authorizing her. to
enter into an agreement with the other cities is adopted the program
will become effective on May 1.
RESOLUTION NO. 468
Mayor Crocker moved that Resolution No. 468 entitled A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS AUTHORIZING THE CITY
MANAGER TO ENTER INTO AN AGREEMENT WITH THE CITIES OF RANCHO PALOS
VERDES AND ROLLING HILLS ESTATES COVERING A -JOINT INSURANCE PROGRAM
FOR HEALTH, MEDICAL, DENTAL, LIFE AND PRESCRIPTION DRUG INSURANCE be
adopted, and that reading in full be waived.The motion was seconded
by Councilman Rose and carried by the following roll call vote:

The Manager presented an accounting of total actual geology expen'"y
to date, listing the costs incurred, the company providing the service
and the service provided. It was determined that the total incurred
and paid is $84,663.17. The Community Association has paid 50% of,all
costs with the exception of the consulting attorney hired by.the City.
Total expense to the City to date is $44,568.11; to the Associaton,:
$40,095'.06. Mrs. Clifton said there may be an additional cost for -the
final geology study. Mayor Crocker said that Dr. Ehlig had offered;,.his
services to the City on a voluntary basis, and had suggested that h•e
would prefer a donation to a scholarship fund instead of compensation.
The accounting was entered.as an exhibit.,for the file.
Councilman Pernell moved that approval of .additional funds in the
amount of approximately $8,000;'discussed with members of the Council
in individual telephone calls by the Manager, be ratified. The motion
was seconded by Councilman Rose and carried by the following roll
call vote:

SUPPLEMENTARY DRAINAGE STUDY, WEST FORK OF KLONDIKE CANYON 188
A letter dated April 10, 1981 from the Los Angeles County
Department -of Engineer -Facilities recommending remedial work for
the West Fork of Klondike Canyon was presented to. the Council. The*_
recommendation was for remedial work in.the vicinity of Pinto'Road,
at an estimated cost'of $15,000 and in a small canyon immediately
to the west of Klondike Canyon, where it-meets.Portuguese Bend Road`
South', at an estimated cost of $1,000. The -areas were defined on a
study area map attached to the correspondence as Location 1 and
Location 4.
The Manager advised the Council that the area defined as Loca-
tion.4 was a Flood Control District project'and the -drain was built

with funds from the 1962 Bond Issue. There have been many problems
with the drain, and Mrs. Clifton said she has contacted the Flood
Control District, since she thinks the corrective work is:their re-
sponsibility. Mayor -Crocker said that since the County Engineer has
advised that the problem in that area contributes to the flooding
problems at'Pinto Road, it was his opinion that both recommendations
for corrective work should be considered high priority. In response
to a question from the Mayor, the City Attorney said provisions should
be made in the budget to take care of both problem areas to avoid
future liability. -Further, Mr. Kinley said it should be ascertained
'whether the drain in the Pinto Road location is in an Association
Easement or on the Ron Dessy property at 4 Pinto Road. Mr. Kinley
said that when that determination has been made it is his opinion,
that the Association will assume at least'part of the expense, and
the property owner may be asked to contribute to the corrective work,
since the property will benefit. The Mayor asked that the Council be
advised by the Board of Directors or their attorney about what is done
in the matter.
.LITIGATION SESSION 280

0 Following a discussion with members of the Council, Mayor Crocker
scheduled a Litigation Session for 6:00 P.M. Monday, May.4.to review
m with the geologists and*the attorneys the final geology report, which
will be completed and delivered to the City on. Friday, May 1. Council-
woman Swanson urged that the report; which was scheduled to be released
Q to the public on May 4, not .be released until after it has been reviewed
by the Council and discussed with the geologists and approved by the..
attorneys: Mr. Kinley agreed that although th6,report will be public
information, ih.view of the claims filed against the City the. report
should not be released until the Council has had an opportunity to
review the report and to determine what their obligations, duties and
responsibilities are.
Mayor Crocker reported that in a letter dated April 22, 1981
Pat Coughlan advised that the City does not have insulation under-'
Proposition 13 from liability in the event there is an'adverse`judge- '..
ment against the City. In the event such a J udgement is entered the
City would be required to assess the residents, and the assessed
values would not be limited by Proposition 13.
ZONING CASE NO. 259, MASON ROSE, 37 CREST ROAD WEST- APPEAL OF DECISION 340
Mayor Crocker reported that he and Councilwoman Swanson made a
field trip to the Mason Rose property at 37 Crest Road West just prior
to the start of the meeting. Councilmen Heinsheimer and Pernell were
'not at the field trip, and because Councilman Heinsheimer was absent
from the Council meeting, Councilman Rose requested that the matter of...
his.appeal from the decision of the Planning Commission on March 17,
denying his request for a Conditional Use Permit be deferred.
The hearing of the appeal was scheduled for Tuesday, May 26.
PLANNING COMMISSION ACTION, APRIL 21, 1981 435
A memo dated April 23 reporting the action.of the Planning Commis-
sion on April 21 was distributed. The Council was advised that the
,Commission approved'requests for Conditional Use Permit for construc-
tion of a tennis court in the rear yard by Gerald Katell, 27 Crest.Road
West and a Variance of Side Yard Setback Requirements for an existing
residence addition:. which was built without a permit before purchase by
the.current owner, William Thomas, 17 Georgeff Road. The information
was received for the file.
INTERVIEWS, CANDIDATES FOR CITY ATTORNEY 443
Councilman Pernell, personnel officer, reported that he has
scheduled interviews with three candidates for the position of City
Attorney. 'Preliminary interviews will be held on May 11, and have
been scheduled for 6:00, 6:30 and 7:00 P.M. at the City Hall. Two
members of each firm will be interviewed by Councilman Pernell and
Mayor Crocker, with other members of.the Council attending if they

wish to. The Mayor said the meeting at La Cresta School on May 11
to discuss the final Geology Report would be called to order at 8 P.M.
AMENDMENT TO CLAIM FILED BY JIM AND SONIA EVANS 490
The City Attorney reported that an amendment to the claim previ-
ously filed by Jim and Sonia Evans has been filed. Mr. Kinley recom-
mended that the amendment to the claim be rejected. Councilwoman
Swanson moved that the amendment to the claim, filed April 23, 1981,
be rejected. The motion was seconded by Councilman Pernell and car-
ried by the following roll call vote:

AGREEMENT, INTERSECTION IMPROVEMENT 523
Mr. Kinley reported that he had reviewed the Agreement Between
Rolling Hills and Rolling Hills Estates for Intersection Improvement,
Portuguese Bend Road and Palos Verdes Drive North, and found.it in
order. Councilman Rose moved that the Mayor and City Attorney be
authorized to execute the agreement. The motion was seconded by
Mayor Crocker and carried by the following roll call vote:

PROPOSED ORDINANCE RE: JOGGERS
Mr. Kinley distributed copies of a proposed ordinance regarding
"Running.on Roadways". Mayor Crocker asked that members of the Council
review the proposed ordinance for discussion at a-future.meeting.
LETTER TO MAYOR RE: LIABILITY 530
In a letter dated'April 2.7; 1981 written in response to a re-
quest from the Mayor that the City Attorney'advise whether or not
the City Council, as a group, should investigate, visit or examine
the properties -which have been affected by the Flying Triangle slide.
Mr. Kinley said that tactically, from a trial standpoint, he believes
that -it is inadvisable for the City Council to visit the properties,
in -view of the fact that claims have been filed against the City.
PROPOSED BUDGET, 1981/82

Councilwoman Swanson asked that the proposed budget be pre-
sented to the Council as soon.as possible, for consideration at
the next meeting if possible. The Manager said the budget will
be typed within a few days, and will be distributed to the Council
before the next meeting.
NEIGHBORHOOD MEETING
Councilwoman Swanson said the next Rolling Hills Community
Association neighborhood meeting will be in her neighborhood, and
she plans to attend, and would bring up any matters the Council
wished discussed.
PARTICIPATION IN COST OF MAILING BROCHURES FOR SUMMER PROGRAM 56.2
The.Manager reported that the cost to Rolling Hills for parti-.
cipating in the cost of mailing brochures for the Palos Verdes Summer
Recreation Program would be $119. The expenditure was approved in a
motion by Councilwoman Swanson, seconded by Councilman Rose and car-
ried by the following roll call vote:
