Monday, August 10, 1981. PAYMENT' OF BILLS 220 Councilman Heinsheimer moved that Demands No. 9796 through 9837 * in theamount of $13,802.52 be approved for payment from the General Fund; that Demands No. 9825, 9826, 9827,belvoided. The Mayor noted that Demand.No. 9835 to Walter Odemer Co., Inc. in the amount of $1,248.85 and Demand No. 9837 in the amount of $350.00 to Fidelity Sound Systems was within, the budget allo ' cat - ion, and included punch -ase- and installation of sound and recording equipment which would improve -amplification and transcription of Council business. The motion.to.approve payment of the demands was seconded by Councilman Pernell and carried by the following roll call vote: AYES:' Councilmembers Heinsheimer, Pernell, Swanson Mayor Crocker NOES: None ABSENT: Councilman Rose ADOPTION OF BUDGET, FISCAL YEAR 1981-82.- 230 The Budget for Fiscal 1981-82 as finalized by the City Treasurer was presented to the Council. Councilman Pernell moved that the Budget be approved for purposes of discussion. The motion was seconded by Councilwoman Swanson. 11 M August 10, 1981 In discussing the'Budget, members of the Council questioned the allocation of $100,000 for expenditures in the Fire and Flood Self - Insurance Fund for. 1981-82. Mayor Crocker said the question would be put to the City Treasurer for clarification at the next meeting. The motion.to approve the Budget was carried by the following roll call vote: AYES: Counc.ilmembers Heinsheimer, Pernell, Swanson Mayor .Crocker NOES: None ABSENT: Councilman Rose PUBLIC HEARING, PROPOSED ORDINANCE, MOBILE HOMES IN ACTIVE SLIDE AREA 278 Mayor Crocker opened a meeting of a public hearing to consider.a proposed ordinance entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS PROVIDING FOR TEMPORARY RESIDENTIAL USES IN ACTIVE LANDSLIDE AREAS AND AMENDING THE ROLLING HILLS MUNICIPAL CODE. Mr. Michael Jenkins, City 00 Attorney, advised the Council that' the amendments discussed at the last O meeting had bden incorporated in the proposed ordinance,.and in addition to.the copies distributed to the Council, he had additional copies of Co the proposed ordinance which could be adopted as an urgency ordinance. The Mayor asked Mrs•:. Margaret'.Wagner, 54 Portuguese Bend Road, who Q previously applied for.permission to place a•mobil.e home on her property, how soon she would be prepared to move if the ordinance is adopted. Mrs. Wagner said she wishes to move as soon as possible because of the con- dition of her existing home, and she. would like to be settled before the start of bad weather. Mayor Crocker said.it will be necessary for Mrs. Wagner to make application to the Community Association, and the Council concurred that the ordinance should not be adopted in urgency form, since the requirements of the ordinance will take some time to complete. Following discussion the Council agreed that if the proposed ordinance is introduced at this meeting and adopted at the next meeting, applications for permission to'place a mobile home on a property in the active slide area could be presented'to the Planning Commission during the 30 day period before the .ordinance becomes effective, but would not be acted on until the effective date of the ordinance. Further, Mayor Crocker said the ordinance will be dis'cussed..at apublic hearing.of. the.Planning.Commission.on Tuesday, August 11, and should not be adopt- ed in urgency form before the Planning Commission has an opportunity to review it. Councilman Heinsheimer moved that the proposed.ordinance be intro- duced, and that reading in full ,be waived. Councilman Pernell.seconded the motion for purposes of discussion,.and he suggested that.staff be asked to prepare.spec,ific requirements for the applicant's guidance, ..and he said that the list of specific requirements be prepared during the 30 day period. the. Crocker said he thought there should be a requirement.for public hearing if the application is renewed a-fter one year, to'give the public an opportunity to discuss the matter in the event it becomes controversial. Councilman Heinshe.imer suggested that ,the ordinance be adopted as written, with changes and amendments made as it appears necessary or desireable. After.discussion the word "not" was deleted from the last sentence of paragraph 5,.changing the wording to "A public hearing shall be required for approval of extensions." Mr. Jenkins said the extension could be granted for time periods of up to 12,months, and, the extension would -not automati.cally be for one year. Mayor Crocker suggested that the words "and a reasonable time has elapsed within which to return the primary residence to habitability." be added to section (d) of Paragraph 7. Councilman Pernell suggested that that could be a condition of renewal of the application, and the addi- tion was not made. The motion to approve the proposed ordinance as amended by deletion of one word and refer it to the Planning Commission was carried by the following roll call vote: AYES:. Councilmembers Heinsheimer, Pernell, Swanson Mayor Crocker NOES: None ABSENT: Councilman Rose -2- HE August 10, 1981 PROPOSED ORDINANCE, EXCEPTIONS FOR HANDICAPPED 329 The proposed ordinance entitled AN ORDINANCE OF THE CITY OF ROLLING.HILLS AMENDING THE ZONING ORDINANCE RELATING TO SPECIAL PERMITS FOR THE HANDICAPPED AND AMENDING THE ROLLING HILLS MUNICI- PAL CODE was referred to the Planning Commission. ORDINANCE NO. 186, AMENDING TRAFFIC COMMISSION MEMBERSHIP: 353 Councilman Heinsheimer moved that Ordinance No. 186 entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS MODIFYING THE MEMBERSHIP OF THE ADVISORY TRAFFIC. COMMISSION AND AMENDING THE ROLLING HILLS MUNICIPAL.CODE be adopted, and that reading in full be waived. The motion was seconded by Councilwoman Swanson and carried by the fol- lowing roll call vote: AYES: Councilmembers Heinsheimer, Pernell, Swanson Mayor Crocker NOES: None ABSENT: Councilman Rose RESOLUTION N0. 472 Councilwoman Swanson moved that. Resolution No. 472 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS PROVIDING REVENUE SHARING CREDIT FOR CERTAIN FIRE PROTECTION TAXES PAID BY CITY PROPERTY OWNERS be adopted, and.that reading in full be waived. Councilmembers Heinsheimer, Pernell, Swanson Mayor Crocker NOES: None ABSENT: Councilman Rose -3- August 10, 198.1 MATTERS FROM THE COUNCIL Mayor Crocker 611 Mayor Crocker asked that. the matter of consideration of a contrib- ution to a scholarship fund in appreciation of services volunteered to the City by Dr. Perry Ehlig be scheduled for discussion at the next meeting. Councilman Heinsheimer ...Councilman Heinsheimer reported that he had received a telephone call from a person who solicited funds on behalf of the "Palos Verdes Police Association". When questioned in..._depth the caller explained that he was'an employee of a public.relations firm working on behalf' of the Palos Verdes Estates Police Department. Councilman Heinsheimer said he objects to such misrepresentation, since there is no Palos Verdes Police Association, and he asked that residents be advised in the Newsletter that any.donation made to that organization is not Co paid directly to a police department, but a portion ultimately does O reach them after serv.ices.of the public relations firm are paid for Further, he .asked that residents be advised that. no portion of their mdonation is given.to the Los Angeles County Sheriff's Department, which provides services for Rolling Hills and two other cities on the Penin - (n sula. a_ In discussing..the.matter-Councilwoman Swanson said she thought ..response to such a telephoned appeal.for funds should be an individual matter. Councilman Pernell and Mayor Crocker said they agreed with Councilman Heinsheimer that the appeal is being misrepresented. At'�. Councilman Heinsheimer's request, and with Councilman Pernell's con- currence., Mayor Crocker said he would write a..letter to the Palos Verdes Police Association objecting to the misrepresentation, with copies to:the..Chi.ef.of.Police of Palos. Verdes Estates and -Los Angeles County Sheriff's Lomita office. Councilwoman Swanson Councilwoman Swanson reported on her attendance at the recent League of California Cities Conference in Monterey. Among.the subjects covered were fiscal independence andlong range planning, working with a two ,year budget which was recommended for consideration, hiring policies, evaluation of the.City Manager and City Attorney, conduct of.publi.c hearings and contracting for. services. METROPOLITAN WATER DISTRICT OF SOUTHERN CALIFORNIA 474 Mayor Crocker presented a letter.dated July 31, 1981 from the Metropolitan Water'District of.Souther n.California, advising that there is a vital need to'conserve water because of the increasing cost of energy to.tr.ansport it,.and the future loss of more than half the allotment from the Colorado River in 1985. ..The City was asked to participate.in a district -wide program to proclaim September 13-20 "Southern California.Water Watch". The Council agreed that instead of making such'a proclamation, the contents of the proposed proclamation furnished by the Water District should be summarized and printed in the.Newsletter_.sent to residents prior to the September 14 meeting of the Council, since the timing would be appropriate to the request.
