25TH ANNIVERSARY, ROLLING HILLS INCORPORATION 80
The b4anager reported that the .City of Rolling Hills was incor-` .
porated on January 24 , 1957, and January 24 , 1982 will mark the� 25th '
Anniversary of the occasion. Mrs. Clifton said she had discussed� tYie� '
matter with several persons, and everybody was enthusiastic about �a�
celebration, but hesitated because of the season, and she suggested ' -'
that the celebration be scheduled later in the Spring or Summer. �9ith
the concurrence of the Council Mayor Rose said he would write to the
Presidents of the Women' s Community Club, the Tennis Club and Caballeros
�and ask them to work with the Manager to develop an appropriate celebra-
tion of the City's 25th Anniversary. � �

UPDATE ON ACTIVE FLYING TRIANGLE LANDSLIDE 125 �
In a letter dat�ed December 29, 1981 Dr. Perry Ehlig presented a
graph showing the results of ineasurements of displacement at the two
monitoring stations located alogn the margin of the active Flying Tri-
angle landslide. Dr. Ehlig stated that the most recent measurement
was made on December 28 and indicates that the landslide is . continuing
to move at a nearly uniform rate.
�The Manager reported that the letter and updated graph have not
been sent to .residents of the Flying Triangle until after review by
the Counci.l. The Manager was authorized to send the correspondence
to Flying Triangle residents.
LIABILITY INSURANCE 175
In a letter dated January 11, 1982 C. Fred Barth, Insurance
Broker for the Rolling Yills Community Association, advised the
Manager that the Rolling Hills Community Association Liability Policy
covers their e�posure in both the City Hall building and the Mainte-
nance Building, and the City of ftolling Hills has been added as an
Additional Named Insured with regard to their liability exposure in
these locations. Mrs . Clifton explained the Council had been sent a
copy of inemoranda sent to underwriters by Mr. Barth requesting that �
the City be named as an additional insured on the Assoc�ations policies
with respect to liability arising out of all operations regarding the
Rolling Hills Community Association, Los Caballeros, the Rolling Hills
Women 's Club and the Rolling Hills Tennis Club, but the endorsements .
have not yet been received.
CALIFORNIA STATE UNIVERSITY, ROBERT STONE : FELLOWSHIP 275
In a letter dated December 29, 1981 Perry L. Ehlig, Professor of
Geology at California State University, Los Angeles expressed his
appreciation to the City Council for the contribution of $5,000 made
to the Robert Stone Fellowship in lieu of payment to Dr. Ehlig for
- ' his assistance in the investigation of the Flying Triangle landslide.
Dr. Ehlig advised that the money has become part of a permanent. endow-
ment and the interest from the endowment will be awarded annualy� to a
graduate student to help defray research costs of a thesis project re-
lated to eng�neering geology.
The Manager reported that Dr. Ehlig telephoned her when the check
arrived, and he said he was pleased and gratified by the Council 's d
contribution to the Robert Stone Fellowship

� A letter dated December 3, 1981 from Jack Kirkwood, 65 Portuguese
Bend Road, and a map of the ancient and active landslides, showing the
location of the Kirkwood residence with relation to the slides were
presented to the Council .
In his letter Mr. Kirkwood advised that he has first option to
buy the property on which he is living, and with regard tu making _
some badly needed improvements, Mr. Kirkwood said he needs� an opinion
� from the City as to whether or not he would be permitted to enlarge
and generally upgrade the house if he purchased it , or if the present
owners agree to make the improvements in a situation where they can't
se1T the property because of its location with regard to the landslide.
�. A sketch of the existing house and the proposed improvements and a
schedule of Phase I through Phase V were presented with the letter.
. � Mayor Rose stated for the record that he represented Mr, and hirs.
August : Peisl;.or-�in thg sale of the property to Mr. Pdajor Langer, and .
he said if that caused a problem he would abstain from deliberations_
in and discussion of the matter. In the absence of representations
made that improvements could be made, or of any pending clairn to Mr.
Rose's knowledge the City Attorney said that Mr. Rose could take part
in the discussion.

r.4rs. Clifton advised the Council that she discussed the request
with Art Keene, Chief Geologist for Los Angeles County, and he said
the property owner would be required to supply certain information
and data in order for the request to be considered.
Councilman Crocker asked whether discussions pertaining to in-
side or outside of the landslide boundary pertains to the property or
the improvement , since the residence in which the Kirkwoods are living
is outside of the boundary of the ancient landslide, but part of the
property is within the boundary. The :City Attorney said property line
are not considered with respect to their location inside of the bound-
ary of a landslide area; the moratorium applies t,o all property within
the boundary. Mr. Coughlan said he would have a concern about the pro-
posal submitted by Mr. Kirkwood, which shows addition of two bathrooms.
He asked where the water would flow. Councilman Crocker asked whether
the submittal shows the existing or proposed housee Mr. Kirkwood .said
he showed the proposed size, since the existing house is only 1200 sq, �� �
feet . Councilman Crocker said that if people living within the Flying
Triangle can improve their properties without increasing the liability
of the City the Council 's objective should be to try tq help them, and
not restrain them in any way tha.t does not object the City's legal lia-
bility. He said limitations regarding additional bathrooms and land-
scaping coul,d be imposed. Mr. Coughlan said tha,t in the City of Rancho
Palos Verdes in limited situations approvals have been given in the
landslide areas, hold harniless agreements have been required. of the
owne.r in which they agree to defend and hold the City harmless from
any and all claims by them or their successors for damage which might
occur to their house or their neighbors house as a result of the con-
struction. �
Mrs. Clifton advised the Council that as a. result of a recent
study by. the County Counsel, the County Engineer will not permit any
building with a waiver.
Mayor Rose said he agrees with Councilman Crocker with regard to
permitting property owners to improve their properties and develop it
for their enjoyment ; at the same time he said tfie Council should keep , ,
in mind their responsibilities to adjacent land owners. In the .case
being considered he said the proximity of the residence to the ancient
landslide area requires significant geology study. Councilman Heins-
heimer said that in the past when the Council has been asked to make a
judgment or give an opinion about the outcome of development of property �
and it has been the practice of the Council, specifically in cases con- �
cerning division of property, not to make a guess. . He said that in
this particularly sensitive area he felt the Council should adhere to
that policy. In the established procedure the Council ' s approval is
the last step, and he said the Council should not make any statements
which could in any way. influence the matter, either by . encouraging or
discouraging the applicant . Councilman Pernell said he wishes to ex-
press a c�ncern, since at this time none of the geologists agree about
just where the landslide is, and the arbitrary line which defines the
moratorium area is in such close proximity to the residence for which
the proposal is made. Councilman Pernell said he would want to be very
careful about �he kind of geology and the evidence presented.
Councilman Crocker asked how valid a hold harmless aoreement �.is,
and whether the County would accept it . Mr. Coughlan said the geology
would have to be acceptable without question. Councilman Crocker asked
whether it �vould be possible for the Council to pre-approve the firm
they would rely on if they gave the Council advice. Mr. Coughlan said
the owner could be requested to submit the name of several geology firms
and the Council could decide which one they would be satisfied with. �-
After the study has been completed it could be reviewed by the County
geologist .or Dr. .Ehlig, Councilwoman Swanson said she thought a sec-
ond opinion should be required, .to be paid for by the applicant , The
Mayor said there is a procedure which requires that the applicant sub=
mit the geology for review, with a provision that the Council may then
ask for further geology, and that procedure would be followed.
Major Langer, 1 Runningbrand Road, owner of the property located
at 65 Portuguese Bend Road, said the County Geologist has been retained
by the City to determine what the problems are, and the result has been

a demarkation of an area defined by them as the ancient slide area.
141r. Langer said about half of his property is within that area, ac-
cording to the County's report , and the balance of the property is
outside of any defined slide area. Mr. Langer said study of the City's
maps indicate that there are approximately 50 - 60 ancient landslides
in the City of Rolling Hills, and in the Flying Triangle there are 30 -
40 acres whiah have not been defined by the Cocunty as being in a land-
slide area. He said that sooner or later ..owners of the properties are
_ going to try to develop or. remodel thoss properties, and Mr. Kirkwood,
as a prospective purchaser of the property, is asking for a general
indication of what the attitude is with respect to development. He
said there is an established procedure which would be followed, but
he said he questions the value of having the geology reviewed by the
County, since the County has already made a determination of the geology.
He said there should be consideration of the fact that the residence
is not within an area defined as either ancient or active landslide.
He said a waiver, as referred to by Mr. Coughlan, would not be accept-
able, and would riot be any different on that property than on any other
property not in a landslide and not in a moratorium area. Mayor Rose
� said he agrees that. the property should not be singled out.
0 Councilman Pernell asked how the slide areas were superimposed
� on the map of the area. �Irs. Clifton explained that the map was pre-
� pared by the County Engineer in response .to her .request for a map
m defining the ancient and active slide areas in the Flying Triangle,
Q whicYi could be sold to interested persons. Review of the map indica-
ted that the property being discussed is removed from the area which
has been defined by the County Engineer as an active landslide.
Councilman Heinsheimer said a process has been developed to be
applied to consideration o� development in the area, and if the pro-
cedures are not specific enough, as Mr. Langer has .indicated, maybe
the .Council should consider amending the procedures to eliminate any
randomness, since some of th� properties are outside of the act,ive
slide, but may be inside or outside of the ancient slide as defined.
Councilwoman Swanson said she thinks it. depends on what is being .
requested; an addition which would not require additional grading is
different from a large addition requiring. grading and use of heavy
equipment which must travei over roads in the actiye slide area to
reach the property which is not in a slide area. Councilman Pernell
said he shares a concern expressed earlier by the City Attorney about
additional water _being introduced into the ground, and its flow.
Mr. Coughlan said that in a memo to the Council the City Manager �
has 'relayed the five requirements set forth by the County Geologist ,
and Mr. Langer has expressed an objection to the requirement for an
additional geology report . He said the question before the C auncil is
whether the requirements are reasonable. � e
Councilman Crocker said he would be willing to move that the
Council approve the request for specific information as set forth in
the memo dated January 8, 1982 from the City Manager as a first step
required. r��yor Rose said the action would not preclude asking for
additional information, which would amount to seeking a third opinion.
The Manager advised that in a telephone conversation b4r. Keene had
outliried some of tfie procedures which would be��needed for a submittal,
and she said the requirements may be enlarged and put in writing.
3 Mr. Jack Kirkwood addressed the Council and he said the land has
already been graded, with almost all of the area proposed to be devel-
oped presently a concrete slab which would be removed and replaced by
new construction; the garage would also be removed, replaced by two
bedrooms and two additional baths, and a detached garage is proposed.
He said he has submitte� a sketch showing the proposed improvements
to Mr. Langer, who owns the property. Further, Mr. Kirkwood said he
wishes to buy the property and Pdr. Langer wishes_ to sell it , which
may not be praetical unless the property .can be approved.
Mayor Rose said the Council will clarify the procedure .which
must be followed.

RESOLUTION NO. 479 ?05 � .
Councilman Crocker moved that Resolution No. 479 entitled
RESOLUTION AUTHORIZING INVESTMENT OF ROLLING HILLS h�ONIES IN LOCAL
AGENCY INVESTMENT FUND be adopted, and that reading in full be waived.
The motion was seconded by Councilman Pernell and carried by the fol-
lowing roll call vote :

The bZanager explained that the Resolutions specifies that the .
Mayor and the City Manager are the City officers authorized to order
the deposit or withdrawal of money in the Investment Fund.
JOI.NT PO`9ERS AGREEMENT FOR SOUTH BAY CORRIDOR STUDY, PHASE III 720
Councilwoman Swanson advised the Council that the City of Rolling
Hills participated in Phase I and Phase II of the Joint Powers Agree-
ment for the South Bay Corridor Study, and contributed funds to the
project ; Phase III �is the Implementation of Phases I and II , and the
document is before the Council for the Mayor's signature. Council-
woman Swanson said representatives of the City would be present at
meetings at which the provisions .of Phase I and Phase II were put into
effect�, and she moved that the Mayor be authorized to execute the �
agreement on behalf of the Ci.ty of Rolling Hills. The motion was
seconded by Councilman Crocker and carried by the following roll call
vote :

CALIFORNIA CONTRACT CITIES ASSOCIATION RE : ASSESSMENT FOR LEGISLATIVE ACTIVI7
A letter dated January 4, 1982 from California Contract Cities �
Association was presented to the Council. Tom Jackson, Association �
President ; advised that at the December Contract Cities meeting the
membership voted to approve a one-tirne assessment for all member cities
to raise funds for lobbying activity in Sacramento on important legis-
lation. The Manag.er informed the Council that the assessment approved
by the membership is 25% of one year' s dues, which is $75 for Rolling
Hills. Councilman Heinsheimer said he attended the meeting at which
the matter was presented, and although he voted against the proposal
it passed by a vote of approximately 2/1.
Councilman Crocker moved that the Council authorize payment of
the $75 assessment . The motion was seconded by Councilman Pernell and
carried by the following roll call vote:

STEPHEN J. KOONCE, COUNTY ENGINEER RE: COMBATING CRIME 800
In a letter dated December 16 , 1981 Stephen J. Koonce, County
Engineer, advised that in the course of making daily inspections and
performing routine investigations and operations field personnel of
the County Engineer' s Department are in a position to observe criminal
or suspicious activity, and presence in the field and direct communi-
cation potential of many units presents a unique opportunity to report
actual or potential criminal activity to the proper authorities. Mr.
Koonce said all managers and supervisors over field operations have

been requested to instruct personnel and crews operating in the field
to be alert for criminal or suspicious activity and to relay suspicious
activity via radio to the dispatcher, who will contact the Sheriff or
local police .department .

DEPARTMENT OF HEALTH SERVICES RE:� AMBULANCE SERVICE AGREEMENT 810 .
The Manager reported that in a letter Dated December 18, 1981 from.
the Los Angeles County Department of Health Services the City was ad-
vised that. a recommendation for an. increase in emergency ambulance
service rates would be on the December 29, 1981 agenda before the Board
of Supervisors. The letter was received for the file.
CITY OF ROLLING HILLS ESTATES RESOLUTION 825 .
A letter dated December 11 , 1981 from the City of ftolling Hills
Estates and a copy of a resolution adopted by that City on December 8,
� 1981 in support of an initiative to require deposits on all beverage
O containers sold in California was presented to the Council.

TRAFFIC CONGESTION IN PENINSULA CENTER AftEA 868 .
. Letters dated November 25, 1981 from M. Mergurian, a resident of .
Rancho Palos Verdes and R. T. Purvis , a resident of Rolling Hills Es-
tates, regarding increasing tr.affic problems and accidents in the
Peninsula Center area due to additional building and shopping facili-
ties in the area were. presented to the Council.
Councilwoman Swanson said the matter was discussed informally at
a meeting of the Peninsula Transportation Committee, and the concensus
was that the problem should be referred to the City in which the con-
gestion and problems occur; in the absence of action the Peninsula
cities should act as a group. Councilwoman Swanson said the Rolling
Hi11s Traffic Commission would study the problem if requested :to do
so by the Council. '
Councilman Heinsheimer "suggested that Councilwoman Swanson be
authorized to call Mr. Purvis and thank him for his letter and advise
him that the Rolling Hills Council shares his concern. P4ayor Rose
asked Councilwoman Swanson, Chairman of the Rolling Hills Traffic
Commission, to contact the chairmen of the Traffic Commissions of the
other Peninsula cities and suggest that a joint meeting be held to
discuss the problem. .
RESIDENCE ADDITION DESIGN, K. TABATABAY, 3 QUAIL RIDGE ROAD NORTH 950
The Manager advised the Council that inspection of the plans for
a residence remodel at 3 Quail Ridge Ro�.d North indicates that the plans

has been approved by the Architectural Committee and building permits
have been issued by the Association and the City for an addition which
consists of a six car garage, a storage area, wine cellar, machine
equipment room and tool room. On the floor above the garage area are
a master bedroom suite, bedrooms, study, baths and a gymnasium, giving
the appearance of a two story residence addition. Mrs. Clifton said
she discussed the matter with the Association P�anager and was advised
that the addition was not in violation of the Community Association's
building regulations, and conversations with the plan checkers in the
Department of Building and Safety indicate that the plan conforms to
the requirements of the Los Angeles County Building Code, which Rolling
Hills has adopted by reference. �4rs . Clifton said the matter was
brought to her attention by the County Building Inspector because of
the two-story appearance of the addition.
In discussing the matter the City Attorney recommended that the
section of the Zoning Ordinance pertaining to building height be
amended to eliminate any ambiguity in the wording. The Council agreed
that the building permit should be suspended and Mr. K. Tabatabay, the
owner, should be asked to attend the next meeting to discuss the matter.
Following the discussion Councilman Crocker moved that a letter
be written to Mr: Tabatabay advising him that the buildin.g permit has
been suspended and asking him to attend the next Meeting to discuss
the matter with the Council, and that the Board of Directors of the
Rolling Hills Community Asso.ciation be advised of the Council 's
ac�ion. The meeting was seconded by Councilman Heinsheimer and carried
by the following roll call vote :

ROLLING HILLS ESTATES RERUEST TO USE ROLLING HILLS FREQUENCY 1256
The Manager report��d that the City of Rolling Hills Estates had
asked permission to share .the Ro:lling Hills frequency, 158.775, nZrs.
Clifton explained that at present Rolling Hills shares the frequency,
which was issued by the FCC, with the Cities of Lawndale, Lomita and
Bellflower, and with Ventura County, and since the frequency is rela-
tively uncrowded, it was her opinion that the City of Rolling Hills
Estates could satisfactorily share the system. Further, the Manager
said the FCC would determine whether the two cities are too close to
share the system, but there has not been any problem with the City of
Lomita because of proximity.
Councilman Crocker moued that the request be appro��Qd, subject
to FCC approval. The motion was seconded by Council�an Heinsheimer
and carried by the following roll call vote:

Councilwoman Swanson asked that the record show that use of the
Government channel will not require addition of any equipment to the
tower. The Mayor so ordered.
KENNETH VROOh1, 26 MIDDLERIDGE LANE, CONSTRUCTION IN SIDE YARD 1275
In a memo dated January 8 to the Council the Manager advised that
Mr. Vroom has constructed a swimming pool , deck and pool equipment in
what has been determined to be the side yard setback of his property
at 26 Middleridge Lane South. As a result Mrs. Clifton said a procedure
has been initiated which requires a survey before a City building per-
mit can be issued, since no survey was required by the Community Associ-
ation. Mrs. Clifton said Mr. Vroom is now in litigation with the Com-

munity Association because part of the construction is in the easement
and has asked that all correspondence referring to his property be
sent to his attorney.
Mr. Coughlan said the only matter before the Council is the
matter of the construction which is in the side yard in violation
of the Zoning Ordinance, and he recommended that Mr. Vroom be granted
a stay with regard to filing the necessary application for a Variance
_ with the Planning Commission pending the outcome of the matter with
the Community Association . Councilman Crocker moved that based on the
advice of the City Attorney, the Council approve a stay for r�Ir. Kenneth
Vroom, 26 Middleridge Lane South, and that Mr. Vroom be advised that he
will be required to file a request with the Planning Commission for a
Variance of Side Yard. Setback Requirements as soon as the matter has
been resolved with the Board of Directors. The motion was seconded. by

HOLIDAY SCHEDULE 1362 �
The City Attorney reported that the legislature recently designated
January 15, Martin Luther King' s Birthday, a holiday, . and City employees
must be given the holiday unless a resolution is adopted specifying the
City 's holidays. Mr. Coughlan read the list of holidays into the record.
Following discussion the Council agreed to establish the holidays no�v
observed by resolution of the Council.

SUMNIONS RE: S�VC60949 , RICHARD HOFFMAN AND CAROLE HOFFr4AN 1405
The hianager advised the Council that a summons has been served on
the City advising of a suit filed against the City and others by
Richard and Carole Hoffman in connection with the landslide in the
Flying Triangle. A copy of the summons was given to the City
Attorney, and he asked that a copy be forwarded to the City's insur-
ance carrier.
LETTER TO DR. DALE RE: PLANTING ON CREST .ftOAD 1422
Councilman Heinsheimer reported that Dr. Thomas Dale, 25 Crest .
Road West has planted shrubs along Crest Road, which he will maintain, �
and he asked. that a letter be written to Dr. Dale thanking him for his
beautification project. The P�iayor so ordered. Councilman Pernell
suggested that Dr. Dale's efforts should be noted in the Newslettere
YOUTH ON PARADE 1425
Councilman Heinsheimer said he was contacted by a member of the
Library Board and asked to arrange for participation by the City of
Rolling Hills in the annual Peninsula Yauth on Parade on January 16.
�Ie said he would attempt to arrange. for a car for t'he parade, and he
asked the Manager to provide the large metallic City logos . to be used
for identif ication.
SCHOOL BUS STOPS IN CITY 1444
Councilwoman Swanson reported that there are still markings in
the City marked "Stop for School Bus", although a survey at the Traf-
fic Commission's request has indicated that the only school buses now
coming into the City provide door to door service. Because the markings
are o.bsolete, the Traffic Commission has recommended that they be de=
leted.
Councilwoman Swa�son moved that the Council accept the Traffic
Commission' s recommendation for removal of all signs pertaining to
school buses. The motion was seconded by Councilman Crocker and car-
ried by the following roll call vote:
AYES: Councilmembers Crocker, Heinsheimer, Pernell, Swanson

APPROVAL OF DISPOSAL OF SURPLUS EQUIPMENT 1452
The b4anager distributed a listing of surplus equipment and asked
that the Council approve disposal. Following discussion and removal
of certain items from the list Councilman C.rocker moved that the items
remaining on the list , as amended, be declared surplus and that the
City Manager be authorized to dispose of them. The motion was seconded
by Councilman Heinsheimer a.nd carried by the following roll call vote:
AYES: Councilmembers Crocker, Heinsheimer, Pernell, Swanson

REGIONAL SH�RIFF SERUICES 1531 :
bSayor Rose reported that he and the .t,4anager attended a meeting
to review the effectivness of the regional sheriff services pro.gram.
�Ie said the plan is. working well, and Rolling Hills is receiving more
� hours of service than was originally anticipated, respo-nse times are
generally good. t2ayor. Rose said� he had requested an increase �of
traffic enforcement, especially at certain hours. .
