2/8/1982MINUTES OF A 123 REGULAR MEETING OF THE CITY COUNCIL CITY OF ROLLING HILLS February;8, 1982 A regular meeting of the City Council of the City of Rolling Hills was called to order at the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California by Mayor Rose at 7:30 P.M. Residents The minutes of the meeting on January 25, 1982 were approved and accepted as presented on a motion made by Councilman Crocker, seconded by Councilman Pernell and carried by the following roll call vote: AYES: Councilmen Crocker, Heinsheimer, Pernell, Mayor Rose NOES: None ABSENT, Councilwoman Swanson PAYMENT OF BILLS 1979 Councilman Crocker moved that Demands No. 10171.through 10174, 10176 through 10196 and 10198 through 10206, in the amount of $17,547.42 be paid from the General Fund,.that Demand No. 10205 in the amount of $7.00 be paid from the Fire and Flood Self Insurance Fund and that Demands No. 10175 and 10197 be voided. The motion was seconded by Councilman Pernell and carried by the following roll call vote: AYES: Councilmen Crocker, Heinsheimer, Pernell, ?:4ayor Rose NOES: None ABSENT: Councilwoman Swanson LIABILITY INSURANCE 1990 The Manager reported that information which was provided by the Association's carrier was forwarded to the City's carrier, and it was her understanding that the two carriers would discuss the coverage. Since no word was received from the City's carrier prior to the meeting the Manager requested that the matter be held on the agenda for a report at the next meeting. The Mayor so ordered. - INTRODUCTION OF LOS ANGELES COUNTY FIRE CHIEF 2002 Mayor Rose introduced Los Angeles County Fire Chief Ray Brunstrom, newly appointed to the South Bay area. Chief Brunstrom advised the Council that he served in the County Fire Station located in Rolling Hills from 1963 - 1967, and has been assigned to the division which includes Rolling Hills and the Peninsula, the City of Carson and unin- corporated areas west of Los Angeles. On behalf of the Fire Department he extended Birthday Greetings to the City Manager. Councilman Crocker asked Chief Brunstrom to comment on the City's requirements with regard to sunptession of -fire danger, Chief Brunstrom 124 February 8, 1982 said he has worked in 13-20 cities in Los Angeles County within the past 20 years, and Rolling Hills has had an extremely responsible attitude with regard to fire protection. Mayor Rose thanked Chief Brunstrom and invited him to attend. future meetings of the Council when his schedule permits him to do so. QUAIL RIDGE ROAD NORTH IMPROVEMENT, TRACT 27006 2036 The Manager reported that the matter of improvement of Quail Ridge Road North as a condition of approval of Tract 27006, Dr. Max Negri, will be considered by the Board of Directors at a meeting on Thursday, February 18, and she asked that it be held for consideration by the City Council on February 22, pending a report from the Board. Mayor Rose so ordered. The Manager said members of the Traffic Commission will -schedule a field trip to Quail Ridge Road North when Councilwoman Swanson, who is Chairman of the Traffic Commissioh, schedules the trip. INCORPORATION OF CITY - 25TH ANNIVERSARY CELEBRATION Mrs. Clifton reported that Mayor Rose wrote letters to the presidents of the Rolling Hills Women's Community Club, the Tennis Club and Caballeros, inviting those organizations to participate in a celebration of the 25th Anniversary.of incorporation of the City. Resp9nse from all of the organizations has been received, indicating a wish of those organizations to participate. LEASE BETWEEN CITY AND ROLLING HILLS COMMUNITY ASSOCIATION 2051 A copy of the lease agreement between the City of Rolling Hills and the Rolling Hills Community Association with respect to the Hesse Memorial Park, the Tennis Courts, the Administration Building and the Maintenance Building, prepared by the City Attorney, was presented to the Council. Mr. Jenkins, the City Attorney, advised Mayor Rose that the attorneys wished to have the agreement reviewed by the Council for the purpose of questions and comments. In discussing the lease agreement, Councilman Crocker said he would send a sample Arbitration Agreement to the .City Attorney for use with the agreement.when negotiating rent. The Manager said Paragraph 5 on page 4 should be reviewed, since the City does the maintenance of prop- erties and all improvements, and she asked that the agreement be clari- fied, since some of the maintenance is shared by City and Association employees. Mr. Courtright, City Treasurer, said that when the lease was discussed it was his understanding that the Association would lease office space, including free use of all office equipment, jani- torial services, everything in the Administration Building, which is different from the typical lease of office space. The Manager said the City owns all of the office equipment. Following the discussion Mayor Rose asked that the draft lease agreement be sent to Mr. Kinley, Association Attorney, and that the matter be held for discussion at the next meeting. CANDIDATES FOR CITY COUNCIL ELECTION 2190 Mayor Rose noted that candidates for member of the City Council were present and he asked the City Manager to introduce them. Mrs. Clifton introduced Dr. Donald Borden, tars. Ginny Leewenburgh and hors. Jody Murdock, who will be candidates in the April 13 municipal election, in addition to incumbents Mason Rose and Mrs. Gordana Swanson. PERSONAL APPEARANCE, JACK ROCKWELL, 32 SOUTH MIDDLERIDGE LANE 2200 Mr.. Rockwell advised the Council that he was a matter involving a dispute he is having with a struction which encroaches on his property. Mr. neighbor is a realtor, and he is concerned about the property might be sold without correction of he has asked his attorney to attach something to property. He asked for assistance from the City in having the matter resolved. The Manager reported that the matter has not been before the City or the Planning Commission. She explained that plans.were approved and permits were issued by the Rolling Hills Community Association, and on that basis permits were issued by the County.. When it was determined that the construction was in the side yard, the owner of the property was advised by the City Attorney of the need for him to apply for a Variance of Side Yard Requirements, and he was advised that after he made application and paid the required fee the matter would be held and would not be acted on by the Planning Commission until his-liti- gation-with is liti- gation with the Community Association was resolved. Further, the Manager said that since the plan was approved and Association permits were issued without a survey, the City now requires a survey before the County issues permits on behalf of the City. Councilman Crocker asked the City Attorney to comment on whether the City can act. Mr. Jenkins said the City does not become involved in disputes between neighbors. The owner of the property adjoining the Rockwell property has been advised of the necessity of filing the appropriate request for a variance with the City, and when that is considered it can be denied, or approved with conditions, he said. CITY OF ROLLING HILLS ESTATES, JOINT EXERCISE OF POWER AGREEMENT 2305 A.letter.dated January 20, 1982 from Ray Taylor, Assistant to the City Ila nager of Rolling Hills Estates, and a Joint Power Agreement be- tween the Cities of Rolling Hills and Rolling Hills Estates, were pre- sented to the Council. Mr. Taylor advised that execution of the agree- ment by the Mayors,of both cities is required as a condition of allo- cation of funds from the 1980 Park Bond Act from the City of Rolling Hills to the City of Rolling Hills Iata,te's-as- authorized by'Resolution No. 459 of the City..of Rolling Hil.ls:.which was adopted on.March.91 1981. Mayor Rose was authorized to sign the agreement on behalf of the City of Rolling Hills in a motion made by Councilman Crocker, seconded by Councilman Pernell and carried by the following roll call vote: AYES: Councilmen Crocker, Heinsheimer, Pernell, 11ayor Rose' NOES: None ABSENT: Councilwoman Swanson CLARIFICATION OF CANDIDACY FOR ':VIBER OF THE CITY COUNCIL 2314 Councilman Crocker asked the City Attorney to advise the Council and state for the record the responsibility of a member of the City Council who is a resident of the Flying Triangle area and is a litigant against the City in connection with the landslide. Councilman Crocker explained that Dr. Donald Borden, who was present at the meeting, is a candidate for the office of member of the City Council, and he said he thought it would be constructive for the Council to be advised how certain issues dealing with the landslide would be handled if Dr. Borden is elected to the Council. The City Attorney agreed that there would be no conflict in voting on matters which are not connected with the litigation; in.matters con- nected with the litigation the Council member should state that there is a conflict and excuse himself from voting.on those issues, and he should excuse himself from any closed session at which the litigation - is discussed. TRAFFIC ENFORCEMENT 2331 The Manager reported that a number of traffic citations have been issued under the High Impact Traffic Enforcement Program discussed at the last meeting, and review of the citations indicates that most of the violations have been issued to non-residents. -3= 126 February 8, 1982 DR. PERRY EHLIG, LETTER DATED JANUARY 30, 1982 A letter from Dr. Ehlig and a graph of displacements at the two monitoring stations he maintains in the Flying Triangle landslide area were presented to the Council. Dr. Ehlig reported that between Decem- ber 28, 1981 and January 29, 1982 the station at the intersection of Ranchero and Portuguese Bend Roads moved 0.65 inches and the station at the horseshoe bend in Portuguese Bend Road moved 1.6 inches. Dr. Ehlig said the rate of movement during January was double the average rate of movement during the prior three months and he attributed the increased rate of movement to the rain on December 31, 1981 and Janu- ary 1, 1982. Dr. Ehlig recommended that open fissures on lots in the area be closed by collapsing the sides with a shovel and hand tarlping,,­ clay -rich dirt across the tops of the fissures to prevent surface run- off from flowing into the fissures. Further, he said the road appears to be in excellent condition with no open fissures on January 29. In discussing the matter, the Council agreed that residents in the area should be advised of Dr. Ehlig's recommendations with regard to sealing the fissures on private property. The Manager was directed to send the letter to all residents in the Flying Triangle and the Community Association. CLOSED SESSION Mayor Rose recessed the meeting to a closed session at 8:45 P.M. MEETING RECONVENED The Mayor reconvened the meeting and announced that during the closed session the salaries of the City's personnel were discussed. Mayor Rose said it was.determined that the salary of the Deputy City Clerk should be increased to $1650 base salary per month, effective February 1, 1982 and to increase the salary of the Secretary to. the City Manager to $1250 per month, retroactive to February 1, 1982. The Mayor said the record should reflect that the Council is attempting to deal with current market values as of February 1, 1982, and that will be taken into consideration in mid -year during the regular.salary review.
