Mokler 2260 City Manager City Attorney City Treasurer Deputy City Clerk Lomita Sheriff's Station Observers Residents The minutes of the meeting of February 22, 1982 were approved and accepted as presented on a motion made by Councilman Crocker, seconded by Councilman Heinsheimer and carried by the following roll call vote: AYES: NOES: ABSENT: PAYMENT OF BILLS Councilmen Crocker, Heinsheimer, Pernell Mayor Rose None Councilwoman Swanson 2270 Councilman Crocker moved that Demands No. 10233 through 10236, 10238 through 10249, and 10251 through 10266 in the amount of $22,437.51 be paid from the General Fund, and that Demands No. 10232, 10237 and 10250 be voided. The motion was seconded by Councilman Pernell and carried by the following roll call vote: AYES: Councilmen Crocker, Heinsheimer, Pernell Mayor Rose NOES: None ABSENT: Councilwoman Swanson FINANCIAL STATEMENT 2290 The Financial Statement for February 1982 was presented. Mayor Rose ordered it held on the agenda for consideration at the next meet- ing because it was not mailed to members of the Council with agenda material. The Manager said figures reported on Page 3 of the statement in connection with City Attorney, Outside Legal Counsel, Litigation and Legal Expense will be re -worked and a corrected accounting will be pre- sented at the next meeting. 135 Mayor Rose welcomed Captain Denny Emerson, commanding officer of the Sheriff's Lomita station, to the meeting. Captain Emerson advised the Council that the high level traffic enforcement conducted in Rolling Hills indicated that.there is a need for additional hours of surveillance and traffic enforcement. He said the City's service contract is limited in regard to this service, and. he recommended that time be spent in traffic enforcement in specific areas where there are readily identifiable problems. It was his recom- mendation that the Council consider purchasing six 'additional.hours per week for a period of thirty days, with results. -to be analyzed. Captain Emerson said the extra time could be terminated at any time, if the Council so wishes, or if it is no longer needed. Mayor Rose asked Captain Emerson to.describe the program_;.use.d in January. Captain Emerson said the usual traffic. enforcement program in the City of Rolling Hills results in 5-15 citAtioins issued.per week, 00 depending on a .variety of factors. Because of problems on Crest Road, efforts were concentrated there for about two hours in the morning and O two hours in the afternoon after school was dismissed, and 30-40 cita- Ti tions per week wer_e.,i.ss.ued. Also three arrests were made for violation m of the City's,ordinance prohibiting entry by unauthorized persons,.mis- m representing their destination. Q Councilman Crocker said there is -a problem with joggers who run abreast on Crest Road, instead of single file, as they have been re- quested to do. Councilman Pernell said skateboarders are also a problem. Captain Emerson said the sheriff cites in both cases, since joggers tend.:to.believe:�that.as'pedestrians they can run..in a traffic lane;.with .reference to.skateboarders he said pedestrianviolations concern the sheriff because of the high risk to the safety of the pedestrians. With reference to his recommendation regarding increased time .for traffic enforcement, Captain Emerson said the cost to the City would be approximately $25 per hour plus 24 cents per vehicle mile driven, and in addition to Crest Road., which is a high priority area, other problem areas would be targeted. Councilman Crocker said.the cost could be built into a new budget, and the existing budget could be developed to handle the increased cost. Mayor Rose said that revenues -are returned to the City from citations, and at least -a portion of the cost would be recovered. Following the discussion Councilman Crocker moved that the Council contract with the Sheriff's Department for six additional hours of traffic law enforcement per week•fgr.thirty days,°with the results to be analyzed by the Sheriff at the end of that period, and subject to.his recommendation about whether the program should be continued beyond that time period. The motion was seconded by Councilman Pernell and carried by the following roll call vote: AYES: Councilmen Crocker, Heinsheimer, Pernell, Mayor Rose NOES: None ABSENT: Councilwoman Swanson Captain Emerson said the program would start in about one week. LIABILITY INSURANCE 2423 Mrs. Clifton reported that she wrote to Mr. Barth, agent for the Community Association, but.he has not responded since he was out of town. At the Manager's request the matter was held on the agenda. LEASE BETWEEN CITY AND COMMUNITY ASSOCIATION 2429 The Manager reported that she and the City Attorney are reviewing the lease and there are some policy questions which should be resolved. -2- 136 March 8, 1982 • , :.�;g,� ."uw Jay ��i.'. f. The City Treasurer said there are provisions in the lease agree- ment for specific maintenance on buildings and equipment; also there is a policy for sharing expenses for certain things which has been in effect, and has been worked out amicably, but is not written down in any document. It was his recommendation that the sharing of costs, which has been informal and should continue to be so, be written in such a way that the new City Manager can understand the policy. Mr. Courtright said he has made a list of the items to be included, and will meet with the City Manager to finalize the policy.. RESOLUTION NO. 483 2449 Councilman Heinsheimer moved that Resolution No. 483 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS, CALI- FORNIA ESTABLISHING A VOTING PRECINCT AND POLLING PLACE, APPOINTING PRECINCT BOARD MEMBERS AND FIXING COMPENSATION FOR THE GENERAL MUNI- CIPAL ELECTION OF SAID CITY ON TUESDAY, APRIL 131 1982, HERETOFORE CALLED BY RESOLUTION NO. 476 OF THE CITY COUNCIL be adopted, and that reading in full be waived. The motion was seconded by Councilman Pernell and carried by the following roll call vote: AYES: Councilmen Crocker,-.Heinsheimer, Pernell) Mayor Rose NOES: None ABSENT: Councilwoman Swanson TRACT 33871, CHACKSFIELD-MERIT, REQUEST FOR TIME EXTENSION 2455- In 455 In a letter dated March 3, 1982 Douglas McHattie, South Bay Engin- eering Corporation, requested a one year extension of time for approval of Tentative Tract 33871, Chacksfield-Merit Homes, in order to fulfill the requirements of the City and County for the subdivision. The.Mana= ger advised the Council that the tentative map was approved on Novem- ber 3, 1980 and would expire on May 3, 1982 unless extended by the Council. A motion to grant the extension to May 3, 1983 as requested was made by Councilman Crocker, seconded by Councilman Heinsheimer and carried by the following roll call vote:- _ AYES: Councilmen Crocker, Heinsheimer, Pernell, Mayor Rose NOES: None ABSENT: Councilwoman Swanson L. A. COUNTY ENGINEER GEOLOGICAL UPDATE, FLYING TRIANGLE AREA 2467 The Manager reported that the County Geologist has estimated that it will take approximately 30 hours to complete the readouts of computer information regarding the slope indicators in the Flying -3- 13'7 March 8, 1982 Triangle and preparation of reports, including field time, and the cost would be close to $1,000.' In response to a request from Council- man Pernell about what would be included, Mrs. Clifton explained that it would include the computer readout on the remaining slope indicator on the Kelly property and a review of the general field conditions, ,and should take no more than thirty.hours. Councilman Heinsheimer sug- gested that the analysis be made later in the year, preferably in the summer. Mayor Rose asked what the situation is with the Community Associ- ation regarding sharing of costs.. The City Manager said the City was advised by the Association that they would not be spending any more money on the geologic investigation. Councilman Crocker said that if the City has an opportunity to determine the status of the situation and whether corrective measures can betaken, he wished to know how long the information would be applicable to the situation. Mrs. Clif- ton said the information would-be in the form of an update to the current status, and rain or continued movement would change the situ- ation. Councilman Heinsheimer said a lot of money has been spent to observe how much the land is moving on a day to day or week to week 00 basis, and he suggested that a policy be,.developed'for watching it 0 over a very.long term. He suggested that it.be followed on an annual S"+ basis, or more often if something is called to the Council's attention, CO and he suggested that the County Geologist .be, asked _to write a •.letter CO advising what information could be provided for a set annual expendi- ture to keep track of the situation. When that cost information has Q been provided, Councilman Heinsheimer-said a long range program could be developed, and the Association could be asked .to share in the cost, rather than the City acting on an ad hoc basis each time. Councilman Crocker said concern has-been expressed about swimming pools, not because of the possibility of sudden flooding, but because an undetected leak could exist for several days, dumping large amounts of water into the soil, and he asked whether the testing facility is of any help in evaluating the danger. He said Councilman Heinsheimer has suggested that a certain amount of money be spent each year, with documentation of how the money is to be spent in doing various tests, .including when. they would be done, and..how they would be done. Mayor Rose asked the City Attorney to comment on the proposal. Mr. Jenkins said the City Attorney would want to review any pro- posal the Council comes up with before any action is taken, because of litigation involving properties in the Flying Triangle. Council- man Pernell asked whether any testing is being done at present... Mrs,. Clifton said Dr. Perry Ehlig is conducting a test informally, and he has set up two monitoring stations. Councilman Heinsheimer said bench. marks could be set up on the surface and monitored as part of a long term program. He said this type of program could be conducted for less money. Mayor Rose asked the City Manager to write to the County Engineer and to Dr. Ehlig, asking for suggestions, and outlining Councilman Heinsheimer's suggestion for a long range program of testing and obser- vation. RAPID TRANSIT DISTRICT, LETTER RE: SPECIAL MEETING MARCH 17, 1982 .129/2 A letter dated February 17, 1982 from the General Manager of RTD was presented to the Council. Mr. Dyer advised that a special public meeting will be held on March 17 to discuss -how the reduction.of federal operating subsidies for public transportation will affect current'ser- vices and fares. A list of proposed service and fare considerations was enclosed with the letter. In discussing the matter Councilman Heinsheimer asked that Council- woman Swanson, who will attend the meeting, be advised that most of the solutions being proposed will significantly increase the vehicle miles traveled by automobiles, which is in conflict with the federal program which is.trying to reduce the vehicle miles to achieve clean air, and the RTD might wish to consider the conflict between the cuts in RTD subsidies and the Clean Air Act.. -4- 138 March 83, 1982 BOARD OF SUPERVISORS, LETTER DATED FEBRUARY 17, 1982 170 In a letter dated February 17, 1982 James Mize, Executive Officer, advised that on the motion of Supervisor Hahn the Board of Supervisors unanimously urged all incorporated cities in Los Angeles County to adopt a policy of personally notifying residents whose homes are sub- ject to foreclosure due to unpaid assessment taxes, because of a recent highly publicized incident concerning eviction of a Los Angeles couple from their home on which the mortgage is fully paid because of their failure to pay a street lighting assessment. The letter was received for the file. PLANNING COMMISSION ACTION MARCH 2, 1982 174 Copies of a resolution entitled A RESOLUTION OF THE PLANNING COM- MISSION OF THE CITY OF ROLLING HILLS REVOKING CONDITIONAL USE PERMIT NO. 212, adopted by the Planning Commission on March 2, 1982, were distributed to the Council. .Mayor Rose said that at the last meeting the attorney for one of the parties advised that an appeal would be filed. The Manager said no appeal has been filed to date.. Councilman Crocker said.the Mayor could specify what material could be presented by both sides, in an effort to conclude the hearing on appeal as quickly as possible,,in view of possible changes in the membership of the Council, which could affect the deliberation. The City Attorney suggested that the Council wait until an appeal is filed before making a decision. The Mayor requested that he and the City Attorney be advised immediately when an appeal is filed, and he ordered the matter held on the agenda. TENTATIVE TRACT 27006, DR. MAX NEGRI, 2 QUAIL RIDGE RD.. N.. ROAD REQUIREMENTS The Manager reported in a memo dated March 4, 1982. that at the direction of the City Council the.Rolling Hills Traffic Commission met in the field on February 23 and viewed the Negri property to determine whether, as a condition of approval of the map for Tract 27006�`there was a need for the Council to impose requirements for widening.the street surface. At the field trip the Traffic Commission determined that the road width is adequate thou& narrow, and recommended that the existing sign reading "Road Narrows" be maintained and that additional sign posts with reflectors be installed in the road easement of the property across from the Negri property to warn of the curve in that location.. Further, the Commission recommended that.insead of grading the west bank to provide a bridle trail at road level, the bank on the west side should be maintained as it is, and that the Community Association be requested to review with Caballeros and with Dr. Negri the possibility of placing the trail behind the existing white rail fence, requesting an easement from.Dr. Negri for the trail, and place a new white rail fence on the west side of the new trail on top of the bank. It was the opinion of members of the Traffic Commission that the indicated location for the trail would.preserve several large healthy pine trees along the road, and would prevent an erosion condition by grading. The Manager recommended that the engineer be authorized to proceed to prepare the final map for Tract 27006, and the money for the road improvement will be transferred to the Community Association as pre- , viously agreed. JOHNS CANYON ROAD VIEW OBSTRUCTION 373 Mrs. Clifton explained that she had received a complaint that trees near the corner of Chestnut Lane and Johns Canyon Road are causing a view obstruction with regard to.traffic visibility. After viewing the area the Traffic Commission recommended that large branches be trimmed. to improve visibility. TRAFFIC AT PENINSULA CENTER In a memo dated March 5, 1982 Councilwoman Swanson, Chairman of -5- 139 March 8, 1982 the Traffic. Commission, advised that she had contacted other Peninsula cities to discuss the feasibility of having a committee study Peninsula. Center traffic congestion. She reported that Rolling Hills Estates is sending out a letter to the other cities welcoming such a meeting. The information was received for the file. LETTERS TO ASSEMBLYWOMAN RYAN AND SENATOR BEVERLY 404 Copies of letters sent to Assemblywoman Marilyn Ryan and Senator Robert Beverly, congratulating them on their voting records as repre- sentatives in Sacramento, were received for the -file. APPLICATION FOR VARIANCE, KENNETH VROOM 416 The Manager reported that Kenneth Vroom, 26 Middleridge Lane South, has submitted .an application for a Variance of Side Yard Requirements, 00 which will be held for resolution of litigation between Mr. Vroom and O his -neighbor. Mrs. Clifton said no fee was submitted with the appli- 7., cation, but will be required before the application is processed. m Mr. Jenkins recommended that a letter be sent to Mr. Vroom m advising him that acceptance of the application does not imply that Q fees have been waived, and no action.will be taken until the fee is paid. The Mayor so ordered. ^ TRACT 32256, ROGER MEURER 446 The Manager -presented a letter dated March 5, 1982 from Betty Hesse, Vice-president of the Board of Directors, advising that the Association has a bid price for installation of a drain and road paving on Black- water Canyon Road. Mrs. Hesse said the bid price for the project will terminate on March 31, 1982, and she asked that the City pay to the Association the $28,000 which was bonded by Roger Meurer for the road improvements as a condition of approval of the map for Tract 32256. Mrs. Clifton advised the Council that she is working on the matter and has kept.the City Attorney apprised of her efforts in connection with calling,in the bond.in the amount of $28.,000 for the work, and when the money is received it will be transferred to the Community Association immediately.
