6/27/1983N2 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL CITY OF ROLLING HILLS, CALIFORNIA June 27, 1983 A regular meeting of the City Council of the City of Rolling Hills was called to order at the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California by Mayor pro tempore Leeuwenburgh at 7:30 P.M. Monday, June 27, 1983. ROLL CALL PRESENT: Councilmembers Pernell, Swanson, Mayor Leeuwenburgh ABSENT: Councilmembers Heinsheimer, Murdock ALSO PRESENT: PAYMENT OF BILLS Ronald L. Smith L. D. Russell City Manager City Treasurer Deputy City Clerk Palos Verdes News Observer Residents Councilman Pernell moved that Demands No. 11186 through 11209 in the amount of.$22,242.17 be approved for payment from the General Fund and that Demands No. 11189 and 11196 in the amount of $3,029.18 be ap- proved for payment from the Fire and Flood Self Insurance Fund. The motion was seconded by Councilwoman Swanson and carried by the follow- ing roll call vote: AYES: Councilmembers Pernell, Swanson, Mayor Leeuwenburgh 1 NOES: None g ABSENT: Councilmembers Heinsheimer, Murdock PUBLIC HEARING, 1983-84 CITY OF ROLLING HILLS FISCAL BUDGET 62 Mayor pro tem Leeuwenburgh opened a public hearing on the proposed Budget for the City of Rolling Hills for Fiscal Year 1983-84. The City Manager reviewed the proposed budget and stated that it is based on pro- jected revenues of $353,000, and expenditures of $337,875, and he noted a Newsletter had been sent to all residents with the Mayor's Budget Message enclosed. In discussing the projections for revenue Councilman Pernell asked the City Manager which areas have the greatest probability of change. Mr. Smith said there is a possibility of change in revenues from Motor Vehicle in Lieu and Building Permit fees, and possibly Sales Tax revenue. The City Treasurer said the Council can wait to adopt the the operating budget until all figures are known, but he explained that the Los Angeles County Tax Assessor must be advised of the figure for refuse collection by August for inclusion in the City's tax bill. Coun- cilman Pernell moved that the budget be held on the agenda for input by members of the Council who are not present at the budget hearing. Coun- cilwoman Swanson said she worked on the budget preparation and is aware. of the difficulties of developing a working budget in a situation of re duced and declining revenues; she said the increase in interest earned was due to prudent management and wise investment of funds. Councilwom Swanson said she wished to recommend that the Council develop a five ye•. plan based on expenses for the past few years and projections for the future, and that staff be asked to keep the Council advised of expenses and performance which would affect such a five year plan, in an effort to develop a policy regarding expenditures. The City Treasurer noted that the new computer for accounting can handle this type of projecting. The Council concurred that the proposal by Councilwoman Swanson could be handled in this manner. Councilwoman Swanson seconded the motion to continue the budget hearing until the next Council meeting on July 11. Mr. Alan Russell, 6 Runningbrand Road, said he was impressed by the proposed budget, noting the increase in ending fund balance. In 403 June 27, 1983 response to specific questions by Mr. Russell, the City Treasurer and the City Manager explained the process of development of the operating budget. Following the discussion Mr. Russell said he wished to compli- ment the City Council on the proposed budget. The motion to continue the budget hearing until the next regular Council meeting was carried on the following roll call vote: AYES: Councilmembers Pernell, Swanson, Mayor Leeuwenburgh NOES: None ABSENT: Councilmembers Heinsheimer, Murdock The City Treasurer advised the Council that in spite of the need for actual figures in.order to make specific allocations, salaries can be paid according to the allocations in the proposed budget. Mayor pro tem Leeuwenburgh said she wished to request a personnel session before the proposed salaries are approved. 00 OPEN AGENDA 965 O Mayor Leeuwenburgh opened the meeting to the Open Agenda, and m invited comment from the floor, advising that each person who wished to Co speak would be heard one time, and for a period not to exceed five min- utes. Dr. Richard Hoffman, 73 Portuguese Bend Road, advised the Council that he was present on behalf of members of the Flying Triangle Home- owners' Committee and to convey the disappointment and despair of_ those residents expressed at a recent homeowners' meeting over the lack of action by the City Council in terms of the safety of Portuguese Bend Road South. Dr..Hoffman said it appears that when it comes to safety the road leading to homes in .the Flying Triangle has become an orphan, and no one wants to.take responsibility, since the residents have been told by the Community Association's attorney that it is the City's responsibility when it comes to safety of the road, and at the last Council meeting Councilman Heinsheimer stated that the safety of the road is the responsibility of the Community Association, and was supported in his statement by the City.Attorney. Subsequently, Dr. Hoffman said he received a letter from the City Manager, stating that the City is not responsible for maintenance of the road; however the City is concerned with the public safety. Dr. Hoffman said the resi- dents - feel that they are being given "the run around"., since the road is, in his opinion, marginally safe; 16 to 16 1%2 feet wide with no shoulder, pot holes that make it unsafe to ride a bicycle and require that cars drive on the wrong side of the road. Dr. Hoffman urged that action be taken in the present dry season, before the next rainy season and he asked that .the Council stop evading the issue by sending him to .the Community Association who, in turn, sends him back to the Council. He said that Flying Triangle residents are residents of the City and members of the Rolling Hills Community Association, and have the same rights as other residents and Association members,. and they demand the same type of roads and the same type of safety on the roads as other residents, and he asked that his comments be made part of the public record. Councilman Pernell advised Dr. Hoffman that pursuant to appoint- ment by Mayor Murdock of Councilmen Heinsheimer and Pernell to act on behalf of the .'Council to meet with representatives of the Flying Tri- angle Homeowners' Association, a letter has been prepared asking that a meeting be scheduled when Councilman Heinsheimer returns from Europe. Further, Councilman Pernell said the letter recognizes the appearances Dr. Hoffman has made before the City Council, and states that any meet- ings which may be scheduled to discuss the matter of land movement are not to be subject to any preconditions. He explained that the Council is aware of the concern and distress of the residents in the sensitive matter, and he assured Dr. Hoffman that the Council has the ability to act if it is determined that the road is truly unsafe. Councilman Pernell said the City Council is not responsible for the maintenance of the road, and has jurisdiction in matters of safety, and he asked that the matter be approached in a spirit of cooperation, rather than confrontation in addressing the problem. -2- BE June 27, 1983 MATTERS FROM THE CITY COUNCIL MIRALESTE HIGH SCHOOL/DAPPLEGRAY INTERMEDIATE SCHOOL 1048 Mayor Leeuwenburgh said she has been asked to serve on the Mira- leste High School/Dapplegray School Sub -committee on Program with another Rolling Hills resident, and the committee will study the pos- sible combination of the two schools. She asked that residents be asked to continent on the idea, since Rolling Hills students will be affected. COMMUNITY ASSOCIATION NEIGHBORHOOD MEETING 1066 Mayor pro tem Leeuwenburgh reported that she and Mayor Murdock attended a recent neighborhood meeting on Georgeff Road, and that. Director Lusk was present to represent the Board of Directors. MATTERS FROM THE CITY MANAGER EVALUATION OF OUTSTANDING BUILDING PERMITS 1066 The City Manager reported that he has asked that the Department of Building and Safety and the Los Angeles County Fire Department inspect certain properties in the City on which building permits are outstanding, specifically property at 3 Quail Ridge Road on which construction has been abandoned and which has weeds growing up through the dried out wood. With regard to the Manny David subdivision at 38 Crest Road East on which the utilities have not been placed underground as required, Mr. Smith said the matter has been scheduled for a public hearing at the City Council meeting on July 11, 1983 to request that a notice of violation be recorded against the property, and the City Attorney has been requested to advise the insurance carrier for the bonds that the City of Rolling Hills wishes to be paid for the improvements. Council- woman Swanson said an additional requirement regarding fencing to designate the horse trail has not been completed. The Manager said that item was included in the request to the bonding company, and he said Mr. David had written a letter stating that the fencing could not be completed until after installation of the underground utilities. The Manager said the landscaping on the Coates property located at 3 Southfield Drive has not been installed, and is being pursued through the Building Department in an effort to expedite completion. Mr. Smith said the property owner has assured him that installation of landscaping will be completed within the next 30 to 60 days, and the Building Department will continue to monitor the matter. LICENSING BY HUMANE SOCIETY 1120 The City Manager reported that envelopes have been mailed to residents by the Humane Society for licensing of dogs for the next fiscal year, and he attended the rabies vaccination clinic on June 22, 1983 to assist residents in understanding the new procedure. Starting Friday, July 1, 1983 all animal control services will be provided by the Humane Society, rather than the Department of Animal Control of Los Angeles County. NEIGHBORHOOD MEETING 1166 Mayor Leeuwenburgh said the next neighborhood meeting will be held at7:30 P.M. Thursday, July 21, 1983 at 16 Eastfield Drive.
