3/16/1984MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL CITY OF ROLLING HILLS, CALIFORNIA March 16, 1984 A special meeting of the City Council of the City of Rolling Hills was called to order at the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California by Mayor Murdock at 7:05 A.M. Friday, March 12, 1984. ROLL CALL PRESENT: Councilmembers Leeuwenburgh, Pernell, Mayor Murdock Councilman Heinsheimer arrived at 7:12 A.M. ABSENT: Councilwoman Swanson ALSO PRESENT: June Cunningham City Clerk Douglas McHattie South Bay Engineering (� Mr, and Mrs. S. M. Kim Property Owners LO (J) PURPOSE OF MEETING L' Mayor Murdock announced that the purpose of the special meeting m was to consider Zoning Case No. 289, an application by.Mr. and Mrs. S. M. Kim, owners of property located at 8 Buggy Whip, for a Conditional Use Permit for construction of a paddle tennis court. The Mayor said -the application received tentative approval by the Planning Commission on February 21, 1984, subject to a condition that plans for the court as approved be submitted and signed by the Planning Commission Chair- man. When the plan was submitted, it was noted by staff that certain requirements, specifically height of a retaining wall, were not in compliance with requirements of the Commission, and the plan was not signed. It has been reported to the office that other changes are _being made on the property without. architectural approval. A letter was sent to Mr. and Mrs. Kim on February 27, 1984 advising them of the Planning Commission's action on February 21, and the Mayor said that in order to avert further progress on the tennis court, it would be necessary for the City Council to take an action regarding the status of the zoning case so the height of retaining walls and other changes could be reviewed. Councilwoman Leeuwenburgh moved that the City Council take juris- diction of Zoning Case No. 289, pursuant to Section 17.32.140 of the Municipal Code, which provides that the City Council, upon affirmative vote of three members of the Council, can appeal the action of the Planning Commission within twenty days after filing of -the notice of 'the Commission's action by the City Clerk. The motion was seconded 'by Councilman Pernell and carried by the following roll call vote: AYES: Councilmembers Leeuwenburgh, Pernell, Mayor. Murdock NOES: None ABSENT: Councilmembers Heinsheimer, Swanson Councilman Pernell moved that Zoning Case No. 289 be remanded to the next regular City Council meeting, -and that it be placed on the agenda for full consideration of plans for development of the Kim property. The motion was seconded by Councilwoman Leeuwenburgh and carried by the following roll call vote: AYES: Councilmembers Leeuwenburgh, Pernell, Mayor Murdock NOES: None ABSENT: Councilmembers Heinsheimer, Swanson z March 16, 1984 ADJOURNMENT The meeting was adjourned at 7:10 A.M. to the next regular meeting at 7:30 P.M.
