8/27/19840 71 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL CITY OF ROLLING HILLS, CALIFORNIA August 27, 1984 A regular meeting of the City Council of the City of Rolling Hills was called to order at the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California by -Mayor Leeuwenburgh at 7:40 p.m. Monday, August 27, 1984. ROLL CALL PRESENT:. Wagner MOV City Manager Deputy City Clerk Palos Verdes News Residents Property Owner Mayor Leeuwenburgh asked that the minutes of the meeting on Monday, August 13, 1984 be amended to state that the closed session at the 'end of the meeting was requested by the City Attorney to discuss litigation. The minutes as amended were approved and accepted on a motion made by Councilwoman Murdock, seconded by Councilman Heinsheimer and carried - unanimously. PAYMENT OF BILLS Councilwoman Murdock moved that Demands No. 250 through 267 and 11744 through 11747 be approved for payment from the General Fund in the amount of $17,206.80. The motion was seconded by Councilman Hein- sheimer and carried by the following roll call vote: AYES: .NOES. .,ABSENT: FINANCIAL STATEMENT Councilmembers Heinsheimer, Murdock, Mayor Leeuwenburgh None Councilmembers Pernell, Swanson The Financial Statement dated July 31, 1984 was approved and accepted as presented on a motion made by Councilman Heinsheimer, seconded by Councilwoman Murdock and carried by the following roll call vote: AYES: Couricilmembers Heinsheimer, Murdock, Mayor Leeuwenburgh NOES: None ABSENT: Councilmembers Pernell, Swanson APPROVAL OF FINAL BUDGET, FISCAL 1984-85 823 The City Manager reported that the Budget for Fiscal 1984-85 was approved in concept on July 2, 1984; final approval was deferred until all ' revenues and disbursements through June 30, 1984 could be included. The Manager said the budget has been adjusted to reflect an increase An the reimbursement by-the.--Community-Asso.c-iation for Bookkeeper's -services, a decrease in the beginning fund -balance -_of the.Fire and Flood Account, and an increase -in -the beginning fund balance- ' -of the Refuse Collection Account, and he recommended that the budget be approved and adopted in 12 August -27, 1984 final form. The recommendation was accepted and the budget was approved : and adopted on a motion made by Councilwoman Murdock, seconded by Coun- cilman Heinsheimer and carried by the following roll call vote: AYES: Councilmembers Heinsheimer, Murdock, Mayor Leeuwenburgh NOES: None ABSENT: Councilmembers Pernell, Swanson PROPOSITION "A" FUNDING 864 .The Manager said that in response to a request by the City Council at the July 23, 1984 meeting, he had researched alternatives for the City of Rolling Hills to consider with regard to use of Proposition A Funds for transit development, and he presented a staff report defining the alternatives and points of consideration with regard to those al- ternatives. Following discussion of the alternatives, which included develop- ment of.a transportation program for the City, to be administered and ,operated by the City; administered by the City and operated by a con- tractor or operated and managed by a private operator; barter -of monies in exchange for needed City services; sale of allocation of funds to an interested governmental agency; support of RTD fixed route systems, or for capital improvements such as bus stops and bus turnouts and recre- ational purposes, such as trips to museums and events, Councilwoman Murdock said she considers use of the funds for capital improvement and recreation the best use, stating that the other uses described would compromise the privacy of the roads in the community. She sug-. gested that if the Council concurs with her, Caballeros and the Women's Community,Club could be advised of the availability of the funds,- and asked to make recommendations for consideration by the Council.. -She. asked about the time constraints, and Mr. Molendyk explained that..the - first year's funds would be lost to the City unless a plan is developed and approved by July, 1985. The Mayor said the City of Torrance has a transit system, and might wish to barter services for money for that system; she suggested that the Manager contact Torrance in the matter.. With the concurrence of the Council the matter was held on the agenda for additional information on the subject. COUNCILMAN PERNELL ARRIVED AT THE MEETING AT 7:55 P.M. FLYING TRIANGLE 990 The City Manager presented the Landslide Investigation Status Report No. 3 dated August 13, 1984 on Flying Triangle East, Flying Triangle West and Flying Triangle Main Mass, prepared by Robert Thomas, Engineering Geologist and approved by Arthur G. Keene, County Geologist. Mr. Molendyk said the report contains information regarding the move- ment recorded in the landslides, and a recommendation that the City contract the service of the Survey Division of the County Engineer to establish and monitor a series of survey monuments located within the main boundaries of the Flying Triangle [Jest and Flying Triangle Main Mass Landslides to correlate the different sets of movement within the Flying Triangle area. Councilwoman Murdock asked whether the County had given an indi- cation of the cost oZE the survey monuments with their recommendation. The City Manager said not cost information was presented. Councilman Pernell said there is a continuing effort to obtain additional inform- ation, and he asked whether the additional information provided with each new study is important to the overall landslide problem perspec- tive. Mrs. Betsy Raine, 71 Portuguese Bend Road, said she has been told that the County Geologist has suggested that there might be ground. water trapped under the surface, and said she did not receive a�-copy of the report in which it was mentioned. The City Manager said copies of all reports are available for residents, and a copy of the -July 19 report would be sent to Mrs. Raine. 73 August 27,:1984 Mayor Leeuwenburgh directed that Landslide Investigation Report No. 3 dated August 13, 1984 be forwarded to the Board of Directors of the Rolling Hills Community Association. OPEN AGENDA PRESENTATION'OF PHOTOGRAPH TO CITY Mr. Herbert Agid, 60 Portuguese Bend Road, presented a large aerial photograph of a portion of the coastline of the Palos Verdes Peninsula south of the City of Rolling Hills, and asked that it be hung in City Hall. Mayor Leeuwenburgh and members of the City Coun- cil thanked Mr. Agid for his gift to the City. OBSERVATIONS REGARDING FLYING TRIANGLE SLIDE 1050 Mr. Agid said he wished to take an opportunity during the open agenda portion of the meeting to express his observations regarding. (D the slide in the Flying Triangle area, where he has resided for 27 years. Mr. Agid said he has -been informed that in the early 1970's a LL '...conduitwhich carries water from Crest Road to the Flying Triangle'. M 'area was increased to carry 1100% more water to be disbursed in I the Klondike Canyon area, and has resulted in increased erosion in an area in which it-was'.kndwn that problems existed-. Mr. Agid said'the Council members are considered to be guardians of the health, safety and.general welfare of the entire community, not individual residents, and he asked that members of the community who reside in the Flying Triangle area be given some assistance.- He said the geologists who advise the City have recommended that cracks and fissures be filled; he said that is not being done by the individual residents, and there are cracks that are 4,.6 and even 15 feet deep, and theyrangefrom four,'inches to four feet in width. Mr. Agid said that when -the rains start movement -wi-1--l-be accelerated unless the cracks are filled and - he urged that the City address the problem by filling the cracks and, holes and attempt to stop the flow of water into the canyon by.divert- ing'the flow, or by going back to a smaller pipe to slow the flow of water from Crest Road. Further, Mr. Agid said the most crucial problem is Adcess'to the Agid, Doak and Nixon propertie's which share a common driveway to and" from Portuguese Bend Road. -Mr. Agid said long term repairs to the deteriorating roadway are not possible; several thousands of dollars have been spent on short-term repairs which do not holdup, and the road can be -negotiated only in a four wheel drive vehicle. He asked that the City Council assist in finding an alternate means of access from Crest Road East, explaining that it would serve those three homes only,.since it appears that the access between those homes and Portu- guese Bend Road will soon be eliminated. - Councilman Heinsheimer asked that the City Manager discuss thee points raised by Mr. Agid with the City Attorney regarding drainage,. repair ofcracks and fissures and access, and report to tfie''Coun-cil at,,,the next meeting with respect to the City's rights -and obligations in the issues. -Councilman Pernell thanked Mr. Agid for his eloquent presentation, and noted that when the City attempted to assist the residents in formation of an abatement district, it was defeated by the Flying Triangle residents. Mr. Agid said he thought the abate- ment district should not be fora designated part of the community only. Mayor Leeuwenburgh explained that in ' order for a property to be.included,4in an abatement district it must benefit directly from formation of the district. With regard to diverting the water flow, Councilman Pernell said there has been no evidence presented that the increased flow has affected the slide. ,Councilman Heinsheimer said the City and Association have spent money. on road maintenance, but have not made repairs on private pro- perties; he asked why residents -don't take care of filling fissures andl,cracks on their properties. Mr. Agid said some of the homes have been.abandoned, and.there is an air of hopelessness, but it is his -3- August 27, 1984 opinion that repairs could be made to properties in 5 - 6 hours, with cost of a skip loader or tractor approximately $35 per hour, and he said that two of the abandoned private properties which are a hazard in their present state could be fixed for approximately $200 - $300, and he said repairs should be made before the rainy season. Council- man Heinsheimer asked whether a possible emergency road has been dis- cussed. Mr. Agid said he has discussed the possibility of providing emergency access to Crest Road over an easement with the City Manager and South Bay Engineering. Mayor Leeuwenburgh said the Association should be included in the discussions,' since they control the ease- ments. Councilman Heinsheimer suggested that the Council contact the' Association to determine whether it would be possible to provide an emergency access -over easements. Mrs. Raine said residents in the Flying Triangle area would be in favor of an abatement district if the Rolling Hills Community As- sociation were a part, stating that the residents feel they could not - handle the district without the Association's support. Mayor Leeuwen-. burgh said the district would have to be made'up of the properties within specific boundaries, and she said the Association has expended large sums of money in support of Flying Triangle residents. Mrs. Raine said she is aware of the Association's help, and is extremely grateful; she said she thinks there has been some misunderstanding - .regarding formation of an abatement district. MATTERS FROM THE.CITY COUNCIL 1490 PERSONNEL SESSION Councilman Pernell requested a personnel session after completion of the City Council meeting. CONTRACT CITIES MEETING Mayor Leeuwenburgh announced that the Los,Angeles County Fire and Sheriff's Departments will co -host the -September dinner meeting of the California Contract Cities Association on September 19, 1984 at the Los _ Angeles County Fire Department Training Center in East Los Angeles. LEAGUE OF CALIFORNIA CITIES CONFERENCE Mayor Leeuwenburgh asked that reservations be made for Councilman Heinsheimer and Councilwoman Murdock for the League of California Cities Conference in Anaheim September 23-- 26, 1984. DINNER FOR FIRE CHIEF BRAGDON The Mayor said Fire Chief Clyde Bragdon has retired froTq the Los Angeles County Fire Department and will be honored at a dinner at the Quiet Cannon Inn in Montebello on September 5, 1984. Councilman Per- nell said he would attend and present a plaque on behalf of the City. CITY MANAGER -CITY COUNCIL WORKSHOP Mayor Leeuwenburgh said a City Manager - City Council workshop will be held at Lake Arrowhead October 24 - 26, 1984. MATTERS FROM THE CITY MANAGER 1519 PROPERTIES IN FLYING TRIANGLE Douglas Herrick, 2 Ranchero Road The Manager reported that as an alternative to draining the pool on his property Mr. Douglas Herrick has requested permission to keep the pool filled and have weekly inspections. An arrangement has been made by Mr. Herrick and Mr. Keene, County Geologist, for a weekly in- specition by a geologist, with all costs to be paid by Mr. Herrick. -4- Lo M m a W � 75 August 27, 1984 Clayton Property, 53 Portuguese Bend Road The'Manager reported that demolition of the Clayton property at 53 Portuguese Bend Road has not progressed as promised, and because of'the hazardous condition, the City Manager recommended that the City Council initiate the procedure for declaring the property.a public nuisance and abating the nuisance. Councilman Pernell moved that the recommendation of the City Mana- ger be accepted and that the property at 53 Portuguese Bend Road be declared a public nuisance. The motion was'seconded by Councilwoman Murdock and carried by the following roll call voter AYES: Councilmembers Heinsheimer, Murdock, Pernell Mayor Leeuwenburgh NOES: None ABSENT: Councilwoman Swanson The Manager said the public hearing on the matter would be scheduled for Monday, September 24, 1984. .Kelly Property, 2 Pinto Road & Barth Property, 51 Portuguese Bend Road The Manger said more movement has been detected on the Kelly property at 2 Pinto Road and the Barth property at 51 Portuguese Bend Road, and he has asked for an update from Harry Kondo,.County Engineer. ANTENNA The Manager said he was advised by the FAA.that Advanced Electronics is working diligently to remove the antenna by September 30,' 1984, and the City Council will be kept advised. _ ADJOURNED TO CLOSED SESSION 1586 The meeting was adjourned to a closed session to discuss personnel and litigation at 9:00 p.m. MEETING RECONVENED The meeting was reconvened at 11:15 p.m. and was immediately adjourned by Mayor Leeuwenburgh to Tuesday, September 11, 1984:at 7:30 p.m. because of a legal holiday on the regular meeting date.
