The minutes of the regular meeting of September 24, 1984 were approved - and accepted as presented on a motion made by Councilwoman Murdock, seconded by Councilman Pernell, and carried unanimously. PAYN�NT OF BILLS Councilman Pernell moved that Demands No. 322 through 358 and 11759 through. 11764 (wi.th the exce tion of voided numbers 321, 323, , 337 and 11763) in the amount of �$24,696. 66 be approved for payment from the General Fund; and that Demand No. . 357 in the amount of $4,711.29 be approved for payment from the Fire and Flood Self Insurance Fund. �. The motion was seconded by Councilman Heinsheimer and carried by the� following roll call vote: • AYES : Councilmembers Heinsheimer, Murdock, � �` Pernell, Swanson `, Mayor Leeuwenburgh . NOES : , . .. ABSENT: � PUBLIC HEARING (CONTINUED) - NUISANCE ABATEMENT, 53 PORTUGUESE 68 BEND ROAD (WILLIAM CLAYTON). The City Manager reported that Mr. Clayton, owner of the property at 53 Portuguese Bend Road, has contix�.ued to make an attempt to clear his property, and has displayed "good faith" in his attempt; how- ever, his contractor, Fred Ripley, Jr. , has had difficulty in getting the proper equipment to clear the remainder of the debris . The Gity Manager presented pictures to the Council,. taken October S, 1984s which indicated the present condition of the property. The City Manager added that Mr. Clayton does intend to remove the holding tank and to fill the seepage tank; and staff° recommends that the . garage also be removed from the site. The Council concurred with the City Manager ' s recommendation that this matter be continued to the meeting of October 22, 1984. The Mayor so ordered. ZONING CASE ��289, MR. & MRS. KIM, ��8 BUGGY WHIP This matter was reviewed at the City Council meeting of September 24, �� October 8, 1984 1984; and the City Manager reported that Mr. Kim, applicant for a • paddle tennis court, had erected a retaining wall that was not built as approved in his original plan. The Building Inspector, Mr. Bill Magill, had observed the change, brought it to the attention of the Community Association Manager; and the City Manager, in turn, placed a stop order on the project to permit the City Council to consider the change. . Mr. Doug McHattie of South Bay Engineering circulated pictures of Mr. Kim` s retaining wall to the City Council . Mr. McHattie explained that the variance from the plan resulted in a vertical cut less than 1 ' deeper than originally specified. After discussion and review of the plan and pictures, Councilwoman � Murdock moved that the retaining wall, as built, be approved. The motion was seconded by Councilman Pernell and carried by the follow- ing roll call vote: AYES : Councilmembers Heinsheimer, Murdock, - " Pernell, Swanson Mayor Leeuwenburgh NOES : ABSENT: : , Councilman Heinsheimer stated that he would like to explore with the Council some sort of inechanism that would assure the City and its applicants that there would be no deviation from approved building - plans, thereby eliminating possible delays and unexpected costs to - the City and the applicants alike. Mayor Leeuwenburgh will invite the Planning Conunission to prepare recommenda�ions for preparing a compliance procedure, and when this is completed, a joint working session will be scheduled between the ' Counci.l and the Planning Commission to discuss this matter. . MATTERS FROM THE CITY COUNCIL .440 The Mayor welcomed to the Council meeting Mr. Joseph P. Leach; , former L. A. County Commission Transportation Director and former City Mana- ger of the cities of Rolling Hills Estates and Redondo Beach. PROPOSITION "A" FUNDING - TRANSIT FUNDS 454 The City Manager reported that staff has , since the Council meeting of September 24, 1984, sent out a Newsletter to the residents out- lining the background of Proposition. "A" funding; and staff has mailed letters to the Community Association organizations : the Women's Club, Caballeros, and the Tennis Club inviting their input regarding this proposition. Mrs. Cynthia. Miller, 4 Chesterfield Roady was in the audience, and she reported that she had had an opportunity to observe the Peninsula Transit buses at Dapplegray School . She had talked to the drivers; - and thought that the arrangement of picking up the children� at ' their homes, delivering them to school,. and returning them to their homes in the afternoon was a "fantastic arrangement", and .she would encourage the City of Rolling Hills to participate in the tran:sit plan in some way. Councilwoman Swanson reported that she had had a preliminary .dis- � cussion with the Mayor and a City Council member of Rancho Palos :; Verdes, and that they are going to look at the possibility of.'a - '�" . demar�`�deliver/response service for Rolling Hills, based on any�kind of specification that the City may make. If the City wishes to have a service to come into the community, it would be done in such` a way : -2- � � 85 October 8, 1984 that that service would be provided only for those who call for thaL- service, but there would be no loading or unloading of other persons within the limits of the City of Rolling Hills. Councilwoman Swan- son reported that the last Newsletter had some errors concerning Proposition "A" Funding, and she hop�lthat a subsequent Newsletter would correct this situation. The Mayor ordered that discussion of this item be continued to the meeting of October 22 , 1984 MATTERS FROM THE CITY MANAGER 529 Revenue Sharing The City Manager reported that staff became aware on Friday that cities were notified in 1983 that if they were using Revenue Sharing Funds, it would be necessary to adopt a grievance procedure for the . handicapped by October 17, 1984. According to staff' s inter retation, � a grievance procedure should be adopted by cities receiving �$25, 000 (� or more in revenue sharing funds; however, as it was not possible to � confirm this understanding before the Council meeting, and to pro- � tect the $8, 000 the City of Rolling .Hills receives in Revenue Sharing m Funds , it was the City Manager's recommendation that the procedure be a adopted. Councilman Pernell moved that the Revenue Sharing Handicapped Regula- tions be adopted. The motion was seconded by Councilwoman Murdock and carried by the following vote: AYES : Councilmembers Heinsheimer, Murdock, Pernell, Swanson . _ Mayor Leeuwenburgh NOES : ABSENT: • The Mayor authorized the City Attorney to work with the City Manager to prepare a simplied .grievance procedure form for the City of Roll- ing Hills. " STATUS OF COYS 578 The City Manager reported that on two occasions there have been _ sighting of Coys (a breeding of coyotes with domestic dogs) . Last Friday, a resident reported that a group of Coys was seen'eating a resident' s cat. The staff of the Humane Society reported that they caught one Coy in the trap on Sunday, October 7 , 1984; and they will keep the City Hall informed of additional trappings . ° The City Manager added that the Humane Society personnel recommends that residents keep their pets and their pets ' food inside at night. So far, the Coys have been sighted only in the canyons . Mrs . Janice Snyder, 23 Buggy �1hip, was in the audience, and stated that. on Friday morning, she heard "a lot of noise outside" ; and she obse�`ved between 8 to 10 Coys on Johns Canyon Drive around 7 :30 a.m. She was able to call her pets to her house, as the Coys ran down the canyon. She called the Humane Society, and they responded immedi-_ ately. She said that a month ago she had observed Coys in the • area. She feels that the presence �of the Coys presents danger . not only to pets , but to children as well . The Mayor and City Manager joined Mrs. Snyder to inspect the area where the Coys had been seen. It was the recommendation of the Council that. the Humane Society personnel continue to bait the Coys ; that the Society' s recommenda- _3_ O� October 8, 1984 , tions : (1) keep pets in at night; (2) remove all food during the night; and (3) don' t feed the Coys, be placed in the Newsletter. The Mayor also directed that the Rolling Hills Community Association be 'noti- fied of the current status of the Coys . ADJOURNED TO CLOSED SESSION 822 The meeting was adjourned to a closed session to discuss personnel matters concerning the hiring of an interim City Manager. .
