APPROVAL OF MINUTES Tlie minutes of the meeting of October 8 , 1984 were approved and accepted as presented on a motion made by Councilman Pernell , seconded by Councilman Heinsheimer and carried unanimously. Mayor Leeuwenburgh. asked that the record reflect that the date of the meeting in the field regarding the. coy problem was Friday, October 5, . 1984. FINANCIAL STATEMENT 35 The Financial �Statement for September 1984 was approved and ac- : cepted as presented on a motion made by Councilman Heinsheimer, seconded by Councilwoman Murdock and carried by the following roll call vote : AYES : Councilmembers Heinsheimer, Murdock, Pernell Mayor Leeuwenburgh " ' � ' � � NOES : None � ABSENT : Councilwoman Swanson ARRIVAL AT MEETING � Mayor Leeuwenburgh asked that the record shaw .that .Councilwoman Swanson arrived at the meeting at 7 :40 p.m. PAYMENT OF BILLS � Councilman Heinsheimer moved that Demands No . 367 through 379 in the amount of $1, 932. 27 be approved for payment from the General Fund, and that Dema.nds No . 359 through 366 be voided. The motion was secon- de'd by Councilwoman Murdock and carried by the following roll call vote: ' AYES : Councilmembers Heinsheimer, Murdock, Pernell , Sw�nson " Mayor Leeuwenburgli NOES : None ABSENT : None �s October 22, 1984 ABATEMENT OF NUISANCE, LOT 12-FT, 53 PORTUGUESE BEND ROAD 93 Mayor Leeuwenburgh opened discussion in the continued public hearing regarding abatement of nuisance on Lot 12-FT, Iocated at 53 Portuguese Bend Road and owned by Mr. William Clayton. , Mr: Leach reported that he had met in the field with Mr. . Molendyk to view the site, and that he had requested Mr . Clayton to attend the meeting. In the absence of Mr. Clayton his contractor, Mr. Fred Ripley, was present. Mr. Leach said the matter of clearing the property has been pending for some time, and the City Attorney has advised that the hearing could be closed and nuisance abatement proceedings could be pursued, or the hearing could be continued, with specific findings to be presented after the c.lose of the hearing as a basis for nuisance abatement proceedings; also, that a third alter- native was available under a different provision of law which permits f iling of a misdemeanor complant against the owner, rather than the property, in the lien process. Mr. Leach said the City Attorney will be present at the next meeting, and it was his recommendation that the hearing be continued to the next Council meeting, and that specific tindings as to the condition of the property be developed with regard to abating the nuisance. Councilwoman Swanson maved that the Manager' s recommendation b.e accep�ed, with the requirement that the owner, Mr. Clayton, b.e advised that it is the Council ' s intention to pursue the. ma.tter if there is no compliance before the next meeting. Councilman Heinsheimer seconded the motion. Councilwoman Murdock said she has noted that there is an improvement in the appearance of. the property, although it has not been completely cleared as required, and it is her understanding that the owner wishes to retain the garage for storage. Mr. Leach said he has discussed this with Mr. Clayton and advised him that the garage con- tinues to deteriorate and storage in an off-site facility would be preferable. The motion was carried unanimously, and Mayor Leeuwenburgh ordereci the hearing continued to the next meeting, with findings to be presente __ at that time in preparation for nuisance abatement proceedings . PROPOSITION "A" FUNDING 215 Mayor Leeuwenburgh reported that Councilwoman Swanson has prepared information regarding use of ProPosition "A" funds , and stating that . the hearing is still open, she invited comment from residents present. Mso Sherrie Perkins, 1 Wideloop Roacl, said she is in favor of a mode of transportation similar to the transit system in Rancho Palos Verdes, explaining that her daughter had used the RPV transit during the summer; and it was especially helpful when she could be delivered to the South Gate, which has since been closed, for pickup by her mother. Councilwoman Swanson said that at the request o� the Council she had prepared a questionnaire to be sent to all residents in the News- letter, and she asked that the Council members review it and comment before it is printed. She said the purpose was to explain the options .� available as briefly and concisely as possible, and give the residents an opportunity to make their wishes known. Councilwoman Murdock said the questionnaire as presented offers hope for services for which no funds are available; specifically, there is mention of need for transportation for handicapped and students , which could not be provided under existing financial con- straints. Councilwoman Swanson said it was her wish to determine the needs of the community, which would be evaluated with relation to resources available. Councilman Heinsheimer said residents should . be advised of the funds accumulated over a three year period, and the amount that will be received each year thereafter . Councilwomari. Council. Mayor Leeuwenburgh said that at a recent meeting of the Mayors of the Peninsula Cities it was suggested that the four Mayors write a letter for publication; expressing united op- r position to the proposition. Councilman Heinsheimer said he would encourage the action, with drafting comments submitted by each Mayor.. Mayor Leeuwenburgh invited comment from residents present. � Mr. James Brogdon, 5 Maverick Lane, said that in discussing the. proposition with Mr. Molendyk he was advised that fees would be .ad- � versely affected by passage of Proposition 36. Mr. Molendyk saict � City services would be affected by requirements of the law with regard � to fees, and he reviewed aspects of the proposed legislation, noting m '. for the Council the probable impact on the community, stating that Q there would be a loss of approximately $18 , 000 of tax money from the General Fund. Mr. Leach said that in addition to the loss of revenue, the community would suffer from loss of services, particularl�y sub- . stantial loss of fire and library services . • - C�uricilman Heinsheimer said the City is receiving valuable services from special districts , and if Proposition 36 is passed the services will be reduced. Co-sncilman Pernell noted that the City tax is minimal, compared to the Community Association assessment. . Councilwoman Swanson said proponents and opponents of Proposition 36 addressed a recent meeting of South Bay Cities Association, and after hearing both .sides �he was convinced that passage would erode-:city services , and she noted that Rolling Hills is presently constrained by limited staffing and a "shoe string" budget. - r Mr . Brogdon advised the Council that when he reported loss of his wallet recently the response by the Sheriff was, in his opinion, excessive. Mr. Brogdon was invited to attend a Regional Law Enforce- ment meeting on Tuesday, October 23, 1984 when response time will be addressed. , -. . FAREWELL PRESENTATION TO. .RON MOLENDYK. ; . 775 � � Mayor Leeuwenburgh announced that the City Council has accepted the resignation of. Ron Moiendyk, City Manager, who has accepted the position of City Manager for the City of Lake Elsinore. The Mayor said she had received a note from Lowell Lusk, President of the � Rolling Hills Community Association, expressing his regret that he was unable to attend the meeting, and asking that his wishes for suc- cess in the new position be conveyed to Mr. Molendyk. Members of the City Council expressed their individual sentiments . to Mr. Molendyk, and on behalf of the Council Mayor Leeuwenburgh presented a. City �v plaque engraved to express appreciation to Mr. Molendyl: for his ser- vice to Rolling Hills from March 1 , 1984 to October z?_, 1984. Mr. . Molendyk thanked the Mayor and City Council and presented tokens of his appreciation to Council members . Captain Elmer Omohundro, Sta- � tion Commander of the Los Angeles County Sheriff' s Department in Lomita, and Don Bailey, District Manager for Southern California Edison Company, added .their good wishes. . � � � MATTERS FROM THE CITY COUNCIL ^ COYS/WILD DOGS 881 � � Councilwoman Murdock reported that on October �2, 1984 she, Mayor Leeuwenburgh and Mr. Leach went to the City of Glendale to -3- I � 90 October 22, 1984 consult with officials of that city with regard to common prohlems concerning wild dogs and coyotes . It was determined that the prob- lems in the cities were not similar, but certain recommendations � made by Glendale officials will be passed on to residents with regard to the importance of eliminating sources of food for the animals . Mr . Leach said he has contacted the Humane Society and the County - Agricultural Society for additional control information on dealing with the problem. He said the Humane Society has placed two traps in the City and has captured one animal. Councilwoman Swanson sug- . - gested that residents be asked to advise City staff if they see coys or coyotes in areas other than the Johns Canyon area, where they were previously reported. Mrse Linda Katell, 27 Crest Road West, said she has had packs of dogs on her property between 1 :OO .a.m, and. 3 : 00 a.m. ar�.d since they run in packs it is her opinion that they are wild dogs . Mrs. Janice Snyder, 23 Buggy Whip Drive, said the vicious dogs in the Johns Canyon area make it necessary for her to keep her dogs indoors. � Mayor Leeuwenburgh said she had a telephone call from another resident � on Buggy ��Thip reporting problems similar to those described by Mrs . Katell and Mrso Snyder. Councilman Heinsheimer said it appears that in addition to the - problem of coys and coyotes, domestic dogs who are permitted to run . loose at night create problemsy and he suggested that residents be- asked to keep dogs in at nighto Councilman Pernell suggested that in view of the strong sentiment in the coIInnunity against a leash Iaw, the Council consider a curfew for ciogs running loose as an aid to - control of the probleme Mayor Leeuwenburgh said a meeting with the Humane Society will be scheduled to establish a more aggressive plan of control , and the recommendations expressed at the meeting will be conveyed to Society personnel. Councilwoman Swanson said she would _ l.ike to explore a curfew, and said residents should be advised of the current trapping program and possible future program for tranquilizing animals, so all domestic animals can be kept indoors at night. She suggested further that the City buy enough traps to make the program � effective, since th.e number of traps available from the Humane Society is limited, stating that they could be rented in the future to help recover the expense. - � Mr. Leach asked that information regarding the habitats of coys and coyotes be reported to the City Hall or be relayed to the Humane Society to aid in placement of traps . CONDITIONS OF APPROVAL � CONDITIONAL USE PERMITS Councilwoman Murdock reported that in response to an inquiry as to whether conditions of approval imposed as part of approval of a Conditional Use Permit travel with the land, she had received a com- munication from the City Attorney recommending that the Council initiate a procedure that involves .recording the signature of the applicant accepting the conditions i�posed on approvals of a Variance � or Conditional Use Permit, to be made part of the record and to run with the land in the event of sale of the property. REGIONAL LAW ENFORCEMENT MEETING 1230 _ Councilwoman Murdock asked whether the Council wished to have any matters brought up at the Regional Law Enforcement meeting on Tuesday, October 23, 1984. Councilman Pernell said incidents of ,}uveniles smoking in brush areas have b.een reported to him. LEAGUE OF WOMEN VOTERS 1238 Councilwoman Murdock said the L.eague of Women Voters invited a member of the Council to participate in a League sponsored panel discussion of Proposition 36. With the concurrence of the Council Mayor Leeuwenburgh said the invitation would be graciously declined, since the Council had agreed not to take a position on the proposition. SPECIAL MEETING, PROPOSITION "A" FUNDS 1240 - Mayor Leeuwenburgh reported that she attended a special meeting of California Contract Cities on October 17 , 1984 on the liberaliz- ation of Proposition "A" funds , and information would be distributed,. -4- ;- � � si October 22, 1984 � SOUTH BAY CITIES ASSOCIATION MEETING . The Mayor said South Bay Cities will meet on Thursday, October 25. . WELCOME TO JOSEPH P . LEACH 1255 Councilman Pernell, personnel officer�:for the C auncil , .welcomed Joseph P. Leach, who has been retained by the City as interim City Manager, and he said Mr. Leach has been asked to make an evaluation and advise the Council regarding the needs of .the City. Mr. Leach said he is pleased to have the opportunity to continue with his career in his prese�t position with the City of Rolling Hills . MATTERS FROM THE CITY MANAGER CLAIM AGAINS THE CITY - JAMES AND SONYA EVANS Mr. Leach presented a claim against the City .by James and Sonya Evans and recommended that the Council deny the claim _and refer it (� to the City Attorney. A motion to accept the City Manager' s recom- � mendation was made by Councilwoman Swanson, seconded by Councilwoman. � Murdock and carried unanimously. Ll- . DOG LICENSING CANVASS BY. HUMANE SOC�iETY 1280 � a The City Manager advised the Council that the Humane Society wishes to conduct a dog l 'icensing follow up canvass on Saturday, . November 3 and Saturday, November 17 , 1984. Councilman Swanson moved that the request be approved. The motion was seconded by ' Councilwoman Murdock and carried unanimously. RECESS TO PERSONNEL SESSION The meeting was recessed to a personnel session. MEETING RECONVENED . The meeting was reconvened at 9 :40 p.m. Mayor Leeuwenburgh said she was authorized by the Council to investigate the City' s insurance coverage and take any needed action. Personnel matters were also dis- cussed.
