Weeks APPROVAL OF CONSENT CALENDAR 1260 City Manager City Clerk Sheriff's Lomita Station Los Angeles Times Palos Verdes News Residents I Councilwoman Swanson moved that the consent calendar, items a - d, including approval of minutes of the meeting on September 10, 1985; the Financial Statement for August 1985; payment of Demands No. 904 through 924 and 11822 through 11824 from the General Fund in the amount of $22,886.84; and acceptance of sanitary sewers and exoneration Of the faithful performance bond for Tract No. 33871 be approved. The motion was seconded by Councilwoman Murdock and carried unanimously. - REQUEST FOR PLACEMENT OF TEMPORARY TRAILER AT 71 PORTUGUESE BEND RD-,,, RAINE In a staff report to the Council the City Manager reported that Mrs. Betsy Raine had appeared before the Planning Commission on Sep- tember 17 to request permission to place a 12' x 50' house trailer c-�n her -i)-t-operty, Lot 28 -FT located at 71 .Portuguese Bend Road, :to be. 011_11cuplby .her family during rehabilitation of her home which has dl�-,,..,iaged by the 'Flying Triangle landslide.. Mr. Devereux said,.the - request to repair the h6us.e by raising it from the foundation and re- inforcing the structure in a procedure similar to that used on the Hartwig property at 3 Pinto Road, was approved in concept by the Planning Commission, to be done to *specifications approved by the Dept. of Building and Safety. Temporary placement of a house trailer to be occupied by residents of the property during rehabilitation of the , main residence was.approved for six months, subject to conditions that Mrs. Raine submit six copies of a plan showing the location of the house trailer, that the necessary waivers be filed with the.County of Los Angeles, and with a provision that the applicant can request time extensions in increments of two months for a maximum of one year from the date of grant. Copies of the Planning Commission minutes were dis- tributed to the Council. Following review of the plan and confirmation of City Council policy regarding waiving of permit fees normally charged by the City if the work is restorative work to repair landslide damage, the in- formation was received for the file. LETTER OF AGREEMENT, EMERGENCY AMBULANCE SERVICE A Letter of Agreement from Goodhew Ambulance Service, Inc. dated September 9, 1985 was presented to the Council. In a staff report 208 September 23, 1985 the City Manager explained that after extensive negotiations and legal action brought by California Contract Cities over responsibility for payment for emergency ambulance service in Los Angeles County, settle- ment in favor of Contract Cities has not been accepted by the County. In an effort to ensure emergency medical response and transport, City Managers in the immediate area met with the president of Goodhew Ambu- lance Service, and Goodhew has agreed to provide emergency ambulance service to .December 31, 1985 at no cost to the City, at which time the City will be notified of Goodhew's ability to continue the service, or a need to negotiate revisions to the Letter of Agreement. Mr. Devereux explained that ambulance service is needed for transportation only, and the Fire Department will continue to respond to local emergencies and can provide backup transportation service if needed, so there should not be a problem if an ambulance is serving another city during an emergency in Rolling Hills. The Manager said there is no obligation, financial or otherwise, to the City to ensure that emergency ambulance service remains available to residents while the County contract is being negotiated by Contract Cities representatives, and he recommended that the Letter of Agreement submitted by Goodhue Ambulance Service be approved as submitted, and that the City Manager be authorized to ex- ecute it on the City's behalf. The City Manager's recommendation was approved in a motion made by Councilwoman Swanson, seconded by Councilwoman Murdock and carried unanimously. LIABILITY INSURANCE PROGRAM 1386 The City Manager reported that he met with the City's insurance broker to discuss the City's program which is due for renewal on January 8, 1986. The Manager was advised that Chicago Insurance will no longer insure local governments, joining most liability insurance carriers which are withdrawing from the municipal market. Information about the Southern California Joint Powers Insurance Authority (S.C.J. P.I.A.) was presented for Council review, and Mr. Devereux recommended that George Anast, S.C.J.P.I.A. Manager, be invited to a meeting to address the City Council and explain the programs and procedures of the organization. Further, the Manager recommended that the Council authorize completion of the Membership Application for possible sub mission to S.C.J.P.I.A. and explained that the 22% fee;. or $712.50 f:or the application is refundable if the City is not accepted, or if the City decides not to join the organization. Councilman Pernell suggested that the Board of Directors of the Rolling Hills Community Association be consulted and invited to com- ment on the insurance program. Councilwoman Leeuwenburgh said it has been established that the City Council and Board of Directors will -meet on the fifth Monday of any month if there is business to discuss, and she suggested that a joint meeting be called for Monday, Septem- ber_ 30. Councilwoman Swanson suggested that the Manager try . to find additional brokers in an effort to obtain a better premium rate. Mr. Devereux said that can be done in a good insurance market, but he has been advised that currently only three insurance companies insure the iminicipal market, and it is anticipated that the insurance premiums for Rolling Hills will increase approximately 400%, with higher deduc- tibles and lower limits when the policy is renewed. Councilwoman Leeuwenburgh said that when the S.C.J.P.I.A. was investigated before the most recent renewal the City was advised that the Community Associ- ation, Womens' Club and Tennis Club would be excluded, and she asked whether that is still true. The Manager said he suspects that the Women's Club and Tennis Club could be included, but he is not sure that the Community Association could be. Councilwoman Murdock said' -it ap-. pears that it is easier for a private :corporation to obtain insurance coverage than it is for a City;. and'said it was her opinion that the City should proceed with an application to the S..C.J.P.I.A. while in- vestigating other options. Mayor Heinsheimer said additional inform- ation is needed, and Councilman Pernell suggested that the matter be placed on the agenda for a joint meeting on 14onday, September 30. Councilwoman Swanson moved that the City Manager be authorized to pro- ceed with the application for possible membership in the S.C.J.P.I.A. and that the Mana;er of the insurance pool be invited to address the -2- September 23, 1985 .209 City Council and Board of Directors. The motion was seconded by Councilwoman Murdock and carried unanimously. OPEN AGENDA Mr. and Mrs. Roy Stinnett Mr. and Mrs. Roy Stinnett, 9 Caballeros Road, displayed two trophies won by their two year old quarter horse, Azure Hope II, in futurity races this season. Mrs. Stinnett explained the futurity race, and said onlyeight futurity races are run in California each year_,_ and it--.1-s--unusual...for a horse to win more than one futurity..!4r_ . Stinnett said the horse won the futurity at Sacramento and Pomona,. and won the largest purse ever awarded at the Los Angeles County Fair. The next event.willibe the�Orange County Fair in November. Members of the City Council and residents present congratulated Mr. and Mrs. Stinnett. Mr ..Sam Weeks 00 Mr. Sam Weeks, 10 Possum Ridge Road, addressed the Council and LO s.aid a locai'landslide had occurred on his property.on '"larch 9, 1983 following a period of heavy rainfall. In the intervening 2 1/2 years Mr. Weeks said he has .been working with geologists, soils engineers, LL mfoundation engineers and civil engineers, and has satisfied 67 require- ments for Los Angeles County and is in the final phase of restoration Q of the slope. Mr. Weeks said he has been advised that it is "technic- ally" impossible to attain 2:1 grading on the slope, and he asked for permission to grade the slope 1 1/2:1, explaining that his lot is the last parcel on Possum Ridge Road and is bound by two major canyons which originate at Crest Road West. Mr. Weeks said the canyon between his property and Portuguese Bend Road joins with the canyon between his property and Quail Ridge Road, at an area north of his property. Mr. Weeks was advised of requirements of the Municipal Code for a Variance from grading, which includes submittal of a letter from the Building Official explaining the necessity of requesting a variance from grading regulations for the project, and submittal of a request for variance from the Planning Commission. Mrs. Catherine Partridge Mrs. Catherine Partridge, 69 Portuguese Bend Road, advised the Council that she reviewed a letter dated July 1, 1985 from the Deputy Director of the Department of Public Works, and said that in Item No. 3 drainage in the Klondike Canyon was addressed. Mrs. Partridge said she has observed the force and quantity of water that comes through the canyon during and after a storm, and she asked that the City Council order the drains coming into the canyon closed as an emergency measure to protect the.health, safety and welfare of resi- dents in the Flying Triangle. Mayor Heinsheimer noted that two letters dated September 18, 1985 were submitted by F. W. Hartwig, 3 Pinto Road, making a similar request. The Manager said copies of Dr. Hartwig's letters were sent to Arthur Keene, County Geologist, for review and comment, but no response has been received to date. Councilwoman Leeuwenburgh said the report was written at the request of the Rolling Hills Community Association and has been for- warded to the Board of Directors, and she said Dr. Hartwig wrote to the Board of Directors as well as to the City Council, requesting that the drain be closed. Councilwoman Swanson said Mrs. Partridge based her request on public health, safety and welfare, and she said owner- ship of the drain should be determined, and the appropriate body should respond to the request. Councilwoman Leeuwenburgh said it is a --Commun- ity Association drain, and was offset by the slide plane, but has been repaired by the Association within the past few weeks. Mrs. Partridge said the drain she is referring to is on Crest Road, above the slide, and the canyon has been closed by shale as a result of water from the drain entering Klondike Canyon. She said the loose shale is a threat to residents below. Councilwoman Swanson suggested that an engineer- ing report address the matter. Councilwoman Murdock suggested that the City Manager be directed to discuss the matter with the Association -3- W-1 September 23, 1985 Manager before any action is taken, since closing a drain will re- quire diverting the water to another area, and drainage is within the jurisdiction of the Community Association. The Mayor -said the matter will be placed on the agenda for a joint meeting on September 30, and a report will be made to residents. MATTERS FROM COUNCIL Mayor Heinsheimer circulated a copy of a letter from Donald Hodel, the Secretary of the Interior, thanking'him for his letter expressing concern on the preliminary agreement regarding development of the Outer Continental Shelf offshore California. A copy of a letter to Secretary Hodel from Mayor John McTaggart of Rancho Palos Verdes was also circu- lated to the Council. I - RECESS.
