was called to order at the Administrati�n Building, 2 Portuguese Bend

Councilraoman Leeuwenburgh asked that Item 2 , Approval of .4inutesr
be removed from the Consent Calendar, The City :'4anager asked that
Item d, Amendment of the Contract Between the City Manager and City
Council be removed fox discussion at an Executive Session follocaing
the regular meeting. The Mayor so ordered. Councils,�roman Leeuwenbur�h
moved that the remaining items on t?�e Consent Calendar be approved.

APPROVAL OF P'IINUTES 1960
Councilr,�roman Leeuwenburgh asked that the zninutes of the meeting
. on January 13, 1986 be corrected in the last paragraph on Page 1 to
state that she wished staff to discuss the billing with Traffic Opera -
ations . On page 4, she asked that the firs� paragrap�. under VANDALISM
be changed to state that traffic signs , not residence signs , were dam-
aged or removede The City Manager asked that the minutes be changed on
page 3 in the next to last paragraph by deletin� "---explaining that
Caballeros have insurance, and they are sub-lessees of the equestrian
facilities ." The minutes as corrected `�ere approved on a motion made
by Councilcaoman Leeuwenburgh, seconded by Council�voman Swanson and
carried unanimouslye
FINANCIAL STATEMENT
The .Financial Statement for Jecember 1985 �vas approved and acce�ted
as presented on a motion made by Councilwoman Leeuwenbur�h, seconded by
Councilwoman Swanson and carried unanimously.
PAYi�'IEiVT OF BILLS
Councilwoman Leeuwenburgh moved that Demands Noe 1108 through 1136
and 11846-7-8 in the amount of $18 , 764. 55 be approved for payment from
the General Fund, an3 that Demand No. 1122 in the amount of $26 .85 be
approved for payment from the Fire and Flood Self-Insurance Fund. The
motion was seconded by Councilwoman S�vanson and carried unanimously.
STATUS OF '�IIJIVICIPAL LIABILITY INSURANCE 1974
The City ?�ianager reportecl that he has been in contact with the
City' s insurance broker, but has no new information to report regarding
municipal liability insurance coverage for the City. Mr. Belanger said
- � a risk analysis of selected City facilities was performed by Xordium,
Risk Control Consultants, and copies of the report dated January 17; T986

were forwarded to the Council and the Community Association. Mr.
Belanger said the report contains recommendations for makin� the City' s
� properties safer . The City Manager said he �vill continue to work .wi�h
tlie brokers and the Association in an effort to obtain insurance.
Councilwoman Swanson asked whether the Council will be advised
before any action is taken in the event the Association decides to re-
open any of the closed facilities after the recommendations have been
implemented. Councilwoman i�iurdock said she and Councilman Pernell have
been asked to work with representatives of the Cornmunity Association in
- the matter. Mayor Heinsheimer said the decision about whether to open
the courts rests solely with the Community Association, but a committee
has been formed to provide input from the Council; he asked whether the
contract by which the Association leases the recreational facilities
from the City would be affected if the Council wished to be involved in
the decision making process about whether to re-open the courts an3/or
riding rings . Councilwoman Swanson said both bodies share similar con-
cerns, and she asked that the Council be advised of the decision made
by the respective committees before the action is taken, because of the
lack of insurance coverage for both the City and Association.
� Mr. David Breiholz, president of Los Catialleros, said he has re-
� ceived numerous inquiries about re-opening the trails and riding rings,
� and he asked that he be informed on a re�ular basis on the status of
� insurance. A copy of the Xordium report was given to Mr. Breiholz, and
� the Mayor said the matter will be included on the Council ' s agenda until
Q it has been resolved; meanwhile, if any developments require a_ special
meeting, Mr. Breiholz will be informed. Mr. Breiholz said Caballeros .
has applied for renewal of their insurance which �aill expire in February.
The City Manager said the City has no jurisdiction over trails, which are
on Association easements; the City can be affected only by decisions re-
garding opening the tennis courts and riding rings . The matter was held
on the agenda for additional information.
SANITARY SE�JER SYSTEM PLANNING 2095 .
� � ---� A staff report on Sanitary Sewer System Planning was presented to
the Council. The Manager explained that a projec�ed time frame and es-
timated costs for a sanitary sewer system were included in the report.
In reviewing the nine steps proposed, the Manager said the first three
steps would be done concurrently, and it �aould take approximately f.our
months �for the preliminary analysis to create a framework for making a
decision about whether to continue with the projeet . The Mayor noted
that Phase 1, development of a topo�raphical map data base using aerial
maps, at an estimated cost of $35, 000, and Phase 2, preliminary engineer-
ing study, at an estimated cost of .$15 ,000, might be reversed in priority
suggesting that the engineering study, which is less costly, might be a
preferred initial step, with the more expensive maps as a second step .
Mr. Belanger said he has discussed the matter with an engineer, and it
appears that the data base currently available may not be sufficient
for a preliminary engineering study. The Mayor said that in the event.
an engineering study indicates that it would be possible to install
sanitary sewers in certain areas of the City and inadvisable '.to iristall.
them in other areas, it would not be necessary to have new aerial photo-
graphed maps of the entire city. Mr. Belanger said that should the
Council wish to proceed on that basis he will attempt to deterinine whe-
ther there is a sufficient data base . to proceed with a preliminary en= �
gineering study. Members of the Council agreed with the Mayor' s recom-
mendation. Mayor Heinshe�imer asked the City Treasurer to advise the
Council at the next�-meeting regarding the City' s ability to "pay for _an
engineering study from the current .bud.get. In response. to questior:s-
from Councilwoman Leeuwenburgh, the City Manager said he considers the
projected time frame realistic , explaining that some of the steps will
be aone concurrently. Mayor Heinsheimer said if possible the study
should focus on attempting to find a specific area cohere removdl of
septic tanks would significantly contribute to the stability of the
area, and where construction and maintenance of a sewer system would
not endanger the stability of the area, and a geological study of the
area might be an important part of the engineering study. The Manager
said that at a recent Community Association meeting a statement was
made that there are 38 ancient slides in Rolling Hills, and he agreed
that any proposal for sanitary sewers must be carefully evaluated

to determine whether or not they �vould enhance the particular area in
which they are to be installed. The �layor ordered the item held on
the agenda for additional information on hojv to proceed.

and the Commission has scheduled a public hearin� on the matter for
February 1S , 1986. The Cit� �?anager recommended that the urgenc� �.

OPEi� AGENDA
The :�ayor invited comment from persons present on items not on
the agendae P4r. Herbert Agid, b0 Portuguese Bend Road, said he be-
� lieves the Flying Triangle can be considered a disaster area; six
homes have been destroyed by the landslide and the move�ent of the
slide area is on-going. At a recent Association meeting the community
was advised that the Flying Triangle � is no�. the only landslide area in
the City and the potential for landslide dar_iage in other areas exists .
. �Ir. Agid said he has two questions to pose to the Council: a) iahat are
officials doin; to gain access to financial assistance from .the ��overn--
ment to be used in disaster areas; b) can the Citg apply for such funds
or can the citizens in the Flying Trian�le area take an action on their
own behalf. .'Ir. Agid said he is asking for direction. .
The City Nianager said he has discussed the matter with a member
of Assemblyman Felando ' s staff and �aas advised that a request for
public �oney must be r.iade by a public entity, na�ely, the City, and �
public monies in a grant . form or emergency funding can be utilized .
for public purposes; use of public money for private land is limited -
as to use. The Mayor said the .City should respond to the residents
with a concise report, and he asked that the Manager contact the staff
of local officials and irivite the� to attend the meeting to discuss
what can be done . ''�Iayor Heinsheimer asked that the matter be nlaced
on the agenda for the next meeting, and that a staff report be prenared
� indicating the various options and limitations . �
SET PUBLIC HEARING RE: '.�fULTIPLE DRIVE�JAYS 2353
In a staff report to the Council the City ?'lanager reported that
the Planning Commission had studied the matter .of multiple driveways :
and recom�ended that the Zoning Ordinance and Municipal Code be amen-
ded to per►�►it additional drivetaays as a Conditional Use Permit use
if other criteria can be met, including required distance from a road-
way intersection, property frontage and minimum separation between
drivewayse A proposed ordinance was presented to the Council . Coun-
cil��voman Swansori moved that the Council. act on the Planning Commis-
sion' s ,recommendation and schedule a �ublic hearing on the proposed
amendment. The motion was seconded by Councilwoman Murdock and
carried unanimously. ':Kayor Heinsheimer set a public hearing for

;IATTERS FROM. CITY OFFICIALS
Councilwoman Leeuwenburgh said she cvished to attend a seminar
for elected officials sponsored by the Oran�e Count� Division of the �
League of California Cities , and asked that the Council approve pay-
ment of the $50 registration fee. Councilwoinan Swanson said she may
also wish to attend. Payment of fees for the se�inar was approved
unanimously.
Council�voman Leeuwenburgh said she addressed the League of Women
Voters at a recent meeting, and concern was expressed at the meetin� �
about the City` s lack of insurance and the trail closure. �.

heimer on the recent vandalism in the City has been mailed.

the contract between the City Manager and the City Council , amending
the name of the contractor and incorporating Planning and Zoning
Responsibilities as part of the City rlanager's duties, was approved
as amended, and that the amended contract will be returned to the
Council for ratification at the next regular r.ieeting.
