Residents Mayor Heinsheimer stated that the purpose bf the joint.meeting, traditionally held on the fifth Monday of the month, was for the pur- pose of discussing matters of mutual interest and concern to the City Council and Board of Directors, and he invited participation in the discussion by residents present. FLYING TRIANGLE 1500 The City Manager reported that the proposal to fill Klondike Canyon submitted by Dr. Fritz Hartwig on behalf of several residents of the Flying Triangle has been forwarded to Los Angeles County for review and comment by the Departments of Geology,- Engineering and Public Works, with a request that a response be provided for the City Council meeting on April 14, 1986. Mr. Belanger said the plan has also been submitted to.a private engineer for evaluation, and expects to have his comments. -during the coming week. President Hornberger said that if .the plan is considered.to be feasible and waivers are signed by property owners,.there is a concern about the funding beyond a certain limit, as well.as concern about the adequacy of the road. Mr. Belanger said the private engineer has agreed to provide cost information, based on engineering standards, for comparison with -the revenue proj�ected' in the proposal. President Hornberger asked the proposed source of the funding. Mayor Heinsheimer said that has not been addressed; legal and technical information is being sought first. Councilman Pernell said the proposal implied a possibility of self - liquidation; he agreed that there should be consideration of the im- pact if overall revenue exceeds expense, and if overall expense ex- ceeds revenue. Further, Councilman Pernell said the legal aspects should be considered before proceeding, to determine whether there are any obstacles. Mr. Belanger said the City Attorney is doing such an evaluation for the April 14 meeting. The Manager said that after the project has been evaluated at that meeting, the sequence for.pro- ceeding, including scheduling and funding, can be considered. 276 March 31, 1986 Director Lusk noted that borings were made in Rancho Palos Verdes in an area adjacent to Rolling Hills and he asked whether City staff was advised about .the results of the drilling. Mr. Belanger said it was his understanding that work was done by the County to obtain mater= ial for litigation. He said Mr. Keene has suggested to the Council that additional excavations be dug.. in Rolling Hills in a continuing search for sub-terranean water, but no cost has been projected for the recommended six or seven holes, including one well. Mr. Belanger.said he estimated that such work would cost approximately $100,000. President Hornberger addressed the status of Portuguese Bend Road in the Flying Triangle area, and reported that Mr. Kinley, Legal Coun- sel for the Community Association, is negotiating with Mr. Leonard Brown's attorney for the.Brown property at 59 Portuguese Bend Road, for possible relocation of the road. Director Lusk-,-said-the road is currently on an Association easement; and if the Association is not successful in the negotiation, the.support of the City Council would be asked in.cdndemnation proceedings. President Hornberger.said the Board is also negotiating with Mr. Robert Lamb, contractor, for 24 hour on-call service for road repairs.in the Flying Triangle. Mayor Heinsheimer said the Council is also interested in having the area cleaned up, and is working with the County on abatement of nuisances on specific properties, in addition to requesting that residents continue to fill fissures'on their properties. Director Lusk suggested that a geologist be asked whether the location of the slide plane has been determined, and specifically, whether there is an underlying slide plane in the vicinity of Portu- guest Bend Road. He asked, also, whether loading Portuguese Bend Road with dirt will cause additional problems of sliding. Presi= dent Hornberger said no money has been spent by the Association on any road in the.community except Portuguese Bend Road South - all road maintenance funds for the year have been diverted to the Flying Triangle. Councilwoman Swanson asked whether it has been deter- mined that black topping the surface is the best -solution. Director Lusk said the grade is too steep for gravel. Mayor Heinsheimer asked whether alternatives have been considered; 'specifically,.a. road across the Barth property.. Director Stringfellow said a large fissure on the Barth property makes that impracticpl. -Dr. Hartwig said filling Paintbrush Canyon would provide an alternate route. Mr. Herbert Agid, 60 Portuguese Bend Road, said he has photo- graphic evidence of erosion in Klondike Canyon that has increased since a 9" drainpipe was changed -.to 22", resulting in a 1200% in- crease in velocity of water discharged into the canyon. Mr. Agid said he is addressing access to homes, not the flow of water, and he stated that his driveway has dropped 18'. Mr. Agid asked that the volume of water to Klondike Canyon be controlled to prevent further damage. Mr. William Kirkendale, 67 Portuguese Bend Road, said he supports Mr. Agid in his statements concerning -the flow of water into the canyon, and he is also concerned about the costs for road grading on a continuing basis. Mr. Kirkendale suggested that the road be improved by leveling the high spots, using the dirt to. fill in the low spots, in an effort to make the road safer. Mr. Lusk said that would not be a good solution, since levelimg Portu- guese Bend Road in the area described by Mr. Kirkendale would make Ranchero Road inaccessible. Mr. Kirkendale said Ranchero Road should be graded to provide an intersection with Portuguese Bend Road, after that has been graded. Director Lusk said Ranchero Road lacks suffi- cient length to do the amount of grading that would be required. Mr. William Cross, 63 Portuguese. Bend Road, asked that Council woman Swanson report on her recent meeting with Congressman Lungren. Councilwoman Swanson said she met with Senator Lungren in his Wash- ington, D.C. office, and they'discuss.ed the Flying Triangle land- slide situation. Councilwoman Swanson said Senator Lungren is very familiar with the Peninsula area -and said he would personally contact the Army Corps of Engineers to request technical assistance for Rolling Hills. He advised that funding would be a problem, but said he would pursue the matter and would advise Councilwoman Swanson as soon as he had something to report. No word has been received at this time; and - the City Manager said he would check with Congressman Lungren's district office in Long Beach. Dr. Hartwig asked whether letters from residents -2- 277 March 31, 1986 would be helpful. Councilwoman Swanson said a letter writing campaign is of great value; anyone in the District can write, not only residents who will be directly affected. Mr. George Partridge, 69 Portuguese Bend Road, said he wished to go on record with both the City Council and Board of Directors regard- ing the importance of directing water flow away from the canyon. Mr. Partridge also recommended that a consultant be.hired to advise the Association with respect to road problems. 'Councilman Pernell sug- gested that Mr. Partridge provide names of road consultants that he referred to. Dr. Hartwig said he agreed with the recommendation that the road be leveled by removing the bumps and high spots and filling - the depressions,.using the material removed from the high spots to fill the low spots, arid --he asked .whether .waivers signed �by-.proper.ty owners would make it acceptable. Mayor Heinsheimer said it -is a technical proposal, not a legal question. Director Lusk said the Board is aware of the condition of -the road, and maintenance:,, -is done on a continuing basis. (D LIABILITY INSURANCE 2123 Lo The City Manager reported that the City has made application to M the Coachella Valley Joint Powers Authority and their executive com- LL mittee has recommended that Rolling Hills be accepted to their member CO ship; the application has been held in abeyance, however, while the Q Authority investigates the possibility�of joining a state-wide JPIA. in order to obtain greater excess coverage. In any case, Mr. Belanger said, the City will be accepted in the Coachella Valley JPIA; however, it would be.preferable to be a member in a larger authority, and it is possible that if the Coachella Valley JPIA.is accepted in the state authority, Rolling Hills would also be accepted. Meanwhile, Mr. Belanger reported, Marsh McLennan is continuing to attempt to obtain coverage, since the Community Association would not be covered by the City's participation in a JPIA. FACILITIES LEASE 2162- A 162A proposed amendment to the lease between the City of Rolling Hills and the -Rolling Hills Community Association was referred to the City .Attorney and Association Legal Counsel for review and resolution. LANDSCAPING AT CITY TENNIS COURTS 2190 Dr. W. D. Basque, 49 Eastfield Drive, said he was present.at a recent meeting of the Planning Commission, and landscaping a tennis court to screen it from an adjacent property was discussed in depth. Dr. Basque said the tennis courts at the Main Gate area are highly - visible, and.he asked that they'be landscaped to make them less visible. Councilman Pernell explained that the City -owned tennis courts are a recreational use in .a non-residential area. He said that when a request for a tennis court on private property is approved, conditions are imposed -which are intended to reduce the impact of such . facilities on other private properties in the residential zone. The motion was seconded by Councilwoman Leeuwenburgh and carried unanimously. APPROVAL OF MINUTES The minutes of a regular meeting on March 24, 1986 were approved and accepted as written. The Clerk reported that Director Lusk requested that the minutes of a joint meeting with the Board of Directors on March 31, 1986 be corrected on page 2, paragraph 3, to indicate that his question about an underlying slide plane pertained to the Pinto Road area, not Portu- guese Bend Road, as stated in the minutes, and that his question about the effects of loading with dirt was directed to the area between the Klondike and Paintbrush Canyons, and the impact of buttress fill in both canyons in that area, not the effect on Portuguese Bend Road, as shown in the minutes. The minutes of the joint meeting on March 31, 1986 were approved and accepted as corrected. PAYMENT OF BILLS Demands No. 1268 through 1314 in the amount of $33,747.25 were approved for payment from the General Fund. Demands No. 1290 and 1299 in the amount of $72:0.76 were approved for payment from the Fire and Flood Self Insurance Fund. ORDINANCE NO. 211 - MULTIPLE DRIVEWAYS IN RESIDENTIAL ZONES An ordinance entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS RELATING TO MULTIPLE DRIVEWAYS IN RESIDENTIAL ZONES AND AMENDING THE ROLLING HILLS MUNICIPAL CODE, which was introduced at the previous meeting, was adopted and_ reading in.full was waived on a motion made by Councilman Pernell, seconded by Councilwoman Leeuwenburgh and car- ried unanimously. LD LO 0) LL m a 279 April 14, 1986 PROPOSED ORDINANCE RELATING TO NON-COMMERCIAL ANTENNAE 42 In a staff report to the Council the City Manager advised that ataregular meeting on March 18, 1986 the Planning Commission re- commended that a proposed ordinance relating to non-commercial radio and television antennae in residential zones be adopted, and that the Municipal Code be amended. Mr. Belanger said the Plan- ning Commission held public hearings and considered input concerning antennae used in connection with ham radio operation presented by licensed operators both in and outside of the City. He recommended that the proposed ordinance be introduced, and that a public hearing be scheduled. Councilwoman Leeuwenburgh moved that the proposed ordinance entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS RELATING TO NON- COMMERCIAL RADIO AND TELEVISION ANTENNAE IN RESIDENTIAL ZONES AND AMENDING THE ROLLING HILLS MUNICIPAL CODE be introduced, and that reading in full be waived. The motion was seconded by Councilman Pernell and carried unanimously. With the concurrence of members of the Council, Mayor Heinsheime.r:. set a public hearing on the pro- posed ordinance for Monday, May 12, 1986 at 7:30 p.m. PROPOSED ORDINANCE ADOPTING L. A. COUNTY ELECTRICAL CODE The City Manager advised the Council that Los Angeles County has adopted a revised Electrical Code, and has requested that the Rolling Hills City Council adopt the County Code by reference and amend the Rolling Hills Municipal Code. The Manager said it would be necessary for the Council to hold a public hearing. Councilwoman Leeuwenburgh moved that the proposed ordinance entitled AN ORDINANCE OF THE CITY OF ROLLING HILLS ADOPTING BY REFERENCE THE LOS ANGELES COUNTY ELECTRICAL CODE AND AMENDING THE ROLLING. HILLS MUNICIPAL CODE be introduced, and that reading in full be waived. The motion was seconded by Councilman Pernell and carried unanimously. A public hearing on the proposed ordinance was set for Monday, May 12, 1986 at 7:30 p.m. STATUS OF MUNICIPAL LIABILITY INSURANCE 104 The Manager reported that an application by the City of Rolling Hills for membership in the Coachella Valley Joint Powers Authority was approved by their executive committee,. but was held in abeyance while the JPIA pursued membership in.a state-wide JPIA, which has not been available to groups in which cities in Los Angeles County are members. The.Coachella Valley Joint Power Authority, which has agreed to accept the cities of Sierra Madre.and Rolling Hills, was successful in having the restriction waived, and it is anticipated that Rolling Hills will be accepted by the Coachella Valley JPIA at a meeting of the Board on April 22, 1986. Mr. Belanger said he has been requested to attend the Board meeting, and will report on the results of the meeting at the next regular City Council meeting on April 28. The Manager said that approval of the obligation does not obligate the City to become a member of the JPIA. He said, further, there is an additional step on April 29, when the Coachella Valley Association of Governments Board reviews applications for member- ship. The Manager said he anticipates that the application by the City of Rolling Hills will be received favorably. STATUS OF FLYING TRIANGLE 170 The Manager reported that he was advised by the County Engineer that the County has not completed a review of the proposal by Dr. Fritz Hartwig for a project in the Flying Triangle intended to abate the active slide by filling the canyons. Mr. Belanger said staff attempted to reach all residents in that area by phone, and only a few people who were not contacted are present at the meeting: The Manager said the plan is being reviewed by the County's civil engineers, geologists and flood control personnel, and he has been advised that the hydrologists have not yet responded. .The private -2- April 14, 1986 engineer contacted by the City Manager has not completed his review of the proposal, and it was the recommendation of the Manager that the matter be deferred until the next Council meeting on April 28. Mayor Heinsheimer so ordered. The City Attorney advised the Council that as reported in the press, the City's motion for summary judgment has been denied, and he requested a closed session following the regular meeting for the purpose of discussing litigation. In a response to questions by Mr. George Partridge, 69 Portuguese Bend Road, Mr. Jenkins explained that the City had asked the court, based on facts which were not disputed, that the City be found not to be liable in a court of law, and that the entire question involving the City be decided as a matter of law. The City's motion was denied by the Court, with a finding that in the opinion of the Court there are several issues of fact which must be resolved by trial. MATTERS FROM THE CITY COUNCIL NEIGHBORHOOD WATCH Councilwoman Leeuwenburgh reported that the Rolling Hills Womens' Community Club has agreed to sponsor the Neighborhood Watch program for the third year, and information concerning the program will be discussed at a neighborhood meeting on Thursday, April 17 on Cinchring Road, and at all neighborhood meetings held during the year. UNSAFE COMMERCIAL VEHICLES Councilman Pernell said Captain Omohundro had requested the support of the City Council of legislation to remove unsafe commer- cial vehicles from highways, and he asked Captain Omohundro whether he had additional information. The Captain said it was.heard in the Assembly on April 9, and he will advise the Council on the status. PLAQUES FOR RETIRING FIREMEN Councilwoman Murdock moved that plaques, appropriately engraved, be presented to three members of Engine Co. 56 in Rolling Hills, who are retiring. The motion was seconded by Councilwoman Leeuwenburgh and carried unanimously. The City Manager said he plans to attend a dinner honoring the three firemen on Friday, April 18. OPEN AGENDA,�CAPT. ROY MELBYE Captain Roy Melbye, 5 Wrangler Road, addressed the Council and offered his opinion that the origin of the landslide is deep within the earth, and that efforts to abate it by working on the surface will not be successful. Captain Melbye said he is basing his state- ment on information in a presentation by a geologist made at the Miraleste School approximately 36 years ago. He urged that the Council not require removal of septic tanks, or approve filling the canyons, stating his opinion that neither would be effective in stopping the slide.- Mayor Heinsheimer and the Council thanked Captain Melbye for his comments. RECESS TO CLOSED SESSION Mayor Heinsheimer recessed the meeting to a closed session at 8:20 p.m. MEETING RECONVENED The meeting was reconvened at 9:20 p.m. and Mayor Heinsheimer reported that the Council and City Attorney discussed potential litigation. ADMINISTRATION OF OFFICE The City Manager advised that the Elections Code of the State of California requires that the vote be canvassed on the first -3- 281 April 14, 1986 Tuesday following the Municipal Election, and that the oath of office be administered to newly elected members of the City Council. In the event that only one person is nominated for an office, and is appointed to that office and the election is cancelled, the person appointed shall qualify and take office and serve exactly as if elected at a municipal election for that office. *. The meeting was adjourned to Tuesday, April 15, 1986 at 8:00 a.m. for the purpose of administering the oath of office to Councilwomen Leeuwenburgh, Murdock and Swanson.
