10/10/1989 352 MINUTES OF AN ADJOURNED MEETING OF THE CZTY COUNCIL CITY OF ROLLING HILLS, CALIFORNIA • October 10, 1989 An ad�ourned meeting of the City Council of the City of Rolling Hills was called to order at 7:35 p.m. , in the Council Chamber at th City Hall/Administration Building, 2 Portuguese Bend Road, Rollin Hills, California, by Mayor Leeuwenburgh on Tuesday, October 10, 1989. ROLL CALL - PRESENT: Councilman Heinsheimer, Councilwoman Murdock, Councilman Pernell (arrived at 7:44 p.m. ) , Mayor Leeuwenburgh ABSENT: Councilwoman Swanson (excused) ALSO PRESENT: Terrence L. C�uncilman Heinsheimer seconded the motion, and it carried unanimously. APPROVAL OF MINUTES The minutes of a regular meeting of the City Council, held on September 25, 1989, were approved as written. PAYMENT OF BILLS Demands Nos. 4026 through 4041, 4043, 4045 through 4059, 4061 and 4062, in the amount of $25,742 .42, were approved for payment from the General Fund. Demands Nos. 4042, 4044, and 4060 were voided. OLD BUSINESS ZONING CASE NO. 379, MANSOOR MIRSAIDI 1 MAVERICK LANE The City Manager reported that this matter was held on the agenda until the appeal period expired. The appeal period has now expired, and there has been no appeal received by the applicant. This comes to the City Council from the Planning Commission as a report of denial of the request for a variance to the front yard. set�iack, and a report of approval of the variance to the side yard setback. There was no additional discussion, and the report from th Planning Commission was received for the file. AMENDMENT TO ANIMAL CONTROL ORDINANCE RE: ANIMAL NUISANCES � The City Manager reported that the City Council had, for their review, copies of the revised ordinance amending that portion of the Animal Control Ordinance relating to animal nuisances. The proposed ordinance was revised by the City Attorney, pursuant to the Council's direction at their meeting on September 25, 1989. In the most recent revised version, the proposed new Section 6.44. 060 dealing with dogs running at-large and destroying property has been deleted. Also, the , 35� � prior repeal of Section 6.48.020 has been deleted. Instead, Section 6. 48 . 020 has been retained, as is, with the exception that the references to barking and other noise making by dogs has been deleted. Accordingly, a barking or noisy dog will now be handled under new Section 6.46; a dog which is otherwise a nuisance (for example, destroying property) will be handled under existing Section 6.48. 020. Additionally, if a dog is barking and running at-large off its owner's property, Section 6.46. 010 continues to contain language that would enable the City's Animal Control Agent to pick up and impound the dog. Councilwoman Murdock moved that the revised proposed ordinance, entitled '�AN ORDINANCE RELATING TO BARKING DOGS, AND AMENDING THE ROLLING HILLS MUNICIPAL CODE" be approved- and adopted, and that reading in full be waived. Councilman Heinsheimer seconded the motion, and it carried unanimously. NEW BUSINESS REPORT OF PLANNING COMMISSION ACTIONS - SEPTEMBER 19, 1989 " � ZONING CASE NO. 397, DENNIS MOORE. 0 OPEN BRAND T'� � The City Manager reported that, previously, the Council received 7 a report of approval for a variance to the front yard. However, at ['(] the time that the Planning Commission took its original action, the Q resolution of approval failed to include an additional grant of variance to the rear yard for the construction of an addition to the existing residence. Therefore, a public hearing was renoticed for this element of the application. Subsequently, the Planning Commission reviewed this matter and granted approval. for a variance to the rear yard, as well as, to the front yard. There was no additional discussion, and the Council` received the Planning Commission's report of approval. ZONING CASE N0. 400 DAVID CLP,RK 11 PACKSADDLE ROAD EAST This is a request for a variance to encroach into the front yard to construct an addition to the existing nonconforming residence, and a request for site plan review. After extensive review, the Planning Commission took action to grant the front yard variance for the residential addition and to �approve the site plan. The City Manager pointed out that, previously, the City Council received a report of denial from the Planning Commission for a request for a front yard variance to construct an addition to the existing illegal barn. Thus, it should be noted that, as a condition of the site plan review approval, the illegal barn must be removed before anv permits are issued or any construction takes place. There was no further discussion, and the Council received the Planning Commission's report of approval for the front yard variance for an addition to the existing residence and approval of the site plan. ZONING CASE NO. 405 GLOVER SANDERS 69 EASTFIELD DRIVE This is a request for a minor variance to the side yard and front yard setbacks for the construction of a small (16 square foot) addition to the existing nonconforming garage at 69 Eastfield Drive, and a request for site plan review approval. The existing residence is approximately 1620 square feet; the applicant is proposing to increase the residential structure by approximately 1500 square feet. The addition will be confined to the existing building pad. Therefore, there will be minimal, if any, grading required, with the exception of excavation for the foundations. The proposed addition to the garage, necessitating the variance, is for a small tool bench alcove. 354 There was no additional discussion, and the Planning Commission's report of approval was received for the file. REPORT OF TRAFFIC COMMISSION RECOMMENDATIONS - SEPTEMBER 22, 1989 NEW DRIVEWAY AT 4 BUGGY WHIP DRIVE The City Manager reported that the Traffic Commission reviewed a proposal for a new driveway associated with the new development at 4 Buggy Whip Drive. To date, there has been no development on this property. The Traffic Conumission recommends to the City Council approval of the proposed new driveway location, as shown on the site development plan. NEW DRIVEWAY AT 2864 PALOS VERDES DRIVE NORTH The City Manager reported that the Traffic Commission and Traffic Engineer reviewed the proposed driveway location for this proposed new development, and recommend to the City Council approval of the proposed new driveway location, pursuant to the approved site plan. MOTZON TO ADOPT TRAFFIC COMMISSION RECOMMENDATIONS Councilman Heinsheimer moved approval and adoption of the Traffic Commission's recommendations of approval for new driveway locations at 4 Buggy Whip Drive and 2864 Palos Verdes Drive North. Councilman Pernell seconded the motion, and it carried unanimously. PUBLIC IiEARING - CONTINUED ZONING CASE NO. _ 396, MARION RUTH 5 OUTRIDER ROAD The City Manager reported that at the last City Council meeting the Council ' conducted a public hearing, and some Councilmembers expressed concern regarding the location of the proposed stable relative to the residence. A seeming ambiguity in the zoning ordinance was discussed, which dealt with the definition of a residence when the garage is attached thereto. The Council indicated that they were prone to consider a garage attached to a residence as part of the residence, which creates a separation distance problem with the proposed stable location. Thus, the applicant has redesigned the plan by separating the garage from the residence. The revised plan indicates a six foot (6 ' ) wide unconnected breezeway between the garage and residence. The purpose of the breezeway is to create an independent garage structure. Thus, the proposed future stable is located approximately eleven feet (11 ' ) from the garage and is more than forty feet (40 ' ) away from the residence. The proposed stable will be approximately seventy feet (70 ' ) from the Post property at 3 Outrider and approximately fifty feet (50' ) from the Po�tter property at 7 Outrider. In addition, the proposed stable will be approximately one hundred feet (100 ' ) from the existing stable on the Post property. Mayor Leeuwenburgh opened the public hearing, and invited comments from the� audience. Mr. Grant Kirkpatrick, architect on the project, addressed the Council and concurred with the City Manager's review of the proposal. Mr. Kirkpatrick explained that the breezeway was ,created to further establish that the separation distance between the stable and residence would be greater than thirty-five feet (35' ) . There were no additional comments, and Mayor Leeuwenburgh closed the public hearing. In response to a procedural question from Councilman Heinsheimer and Councilman Pernell regarding resolution of the original request for a Variance, Mr. Mike Jenkins, City Attorney, explained that the Variance request could be deemed withdrawn by virtue of the modification of the site development plan. 35�5 The City Manager informed the Council that the appropriate resolution, memorializing the Council 's action, would be prepared and brought back to the Council for final disposition, at their next regular meeting. � Councilman Pernell commented that the applicant and her � representative are to be commended on their cooperativeness and responsiveness; it was greatly appreciated by the Council. Councilman Heinsheimer moved approval of the site plan, as revised. Councilman Pernell seconded the motion, and it carried unanimously. OPEN AGENDA Mayor Leeuwenburgh invited the audience to address the Council on any topic not outlined on the agenda. h ;. The City Manager reported that there is no new information from Dimension Cable. He will be meeting tomorrow with District Manager for GTE to tour their cable system in Cerritos. ARMY CORPS OF ENGINEERS - RECONNAISSANCE STUDY Councilman Pernell asked for an � update on the pr.ogress of the � Army Corps of Engineers study. The City Manager reported that he spoke with their office today, and there is no new information. The Corps of Engineers had intended to have a draft plan completed by this time. The City Manager noted that the City has provided them with complete data and information that has been requested. The City Manager will update the Council on the Army Corps of Engineers progress when more information is available. NEIGHBORHOOD MEETING � Councilwoman Murdock announced that she attended the Eastfield neighborhood meeting, sponsored by the Community Association. The topics concerning the residents seemed to be cable television, and dog nuisances and attacks. The meeting was well attended. LETTER FROM CITY OF RANCHO PALOS VERDES RE: EQUESTRIAN TRAIL SYSTEM Councilwoman Murdock referred to a letter from the Mayor of the City of Rancho Palos Verdes, requesting input and response to Rancho Palos Verdes' proposed equestrian trail system. The City Manager indicated that the letter had been referred to the Community Association for a response, as the Rolling Hills Community Association has jurisdiction of the equestrian trails. MEETING WITH GENERAL PLAN CONSULTANTS, CBA Mayor Leeuwenburgh announced that the General Plan Consultants, Cotton/Beland/Associates, have expressed a desire to meet with the Council to report on the progress of the preparation of the Housing } Element and the General Plan Revisions. Thus, a meeting was scheduled for Wednesday, October 18, 1989, at 7:00 a.m. in the Council Chamber at City Hall. Councilman Pernell announced that he attended the meeting last week of the General Plan Advisory Committee, and commended the members of the Committee and their diligence. � 356 MATTERS FROM STAFF RECYCLING PROGRAM The City Manager reported that there is no additional information, at this time. This matter will be held on the agenda, and he will keep the Council apprised of any new information. LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE The City Manger announced that he and the City Attorney would b attending the League of California Cities Annual Conference in Sar Francisco, October 23 - 25. CLOSED SESSION � It was determined that a Closed Session was not necessary.
