7/23/1990MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL CITY OF ROLLING HILLS, CALIFORNIA July 23, 1990 A regular meeting of the City Council of the City of Rolling Hills was .called to order by Mayor Heinsheimer at 7:30 p.m. on Monday, July 23, 1990 in the Council Chamber at the City Hall/Administration Building, 2 Portuguese Bend Road, Rolling Hills, California. The motion was seconded by Councilman Pernell and carried unanimously. PRESENTATION OF CERTIFICATE OF APPRECIATION TO MAYOR HEINSHEIMER Mr. Carl Bailey, District Manager, U.S. Bureau of Census, thanked Mayor Heinsheimer and the other Peninsula mayors and citizens for their contributions in making the 1990 U.S. census a success. INTRODUCTION OF SOUTHERN CALIFORNIA EDISON AREA MANAGER Mayor Heinsheimer introduced Mr. Scott Gobble, new Area Manager on the Peninsula for Southern California Edison Company. Mr. Gobble, who has just moved here from Santa Barbara, said he wor,:ld be available to assist in any questions that might arise. REPORT OF FIRE IN CANYON Interim City Manager McDuffie reported that a recent brush fire in Georgeff Canyon which burned approximately two acres was caused.by a tree limb downing a power line. There was minor damage to a storage shed but no injuries. Chief Jay Corbett added that very calm winds that day were very helpful in minimizing the spread of the fire. He commended the Council on their recent actions to upgrade the existing roof ordinance for new construction or remodeling. Brush clearance in the -1= city has been excellent and cooperation from residents has been good. No changes in clearance requirements are contemplated for next year. Members of the Wildlife Committee spoke of their concerns for preserving wildlife habitats. Chief* Rigaud responded that what is needed is for residents to trim out dead parts of the brush, not necessarily remove it all. Chief Corbett added that the Fire Department is finalizing a program for all the cities on the Peninsula to identify the major areas of concern, starting with the canyons. The County property will be taken care of first, after which Fire Department representatives will meet with Peninsula City Managers and request to present the program to City Councils and also to members of the community, soliciting their cooperation and assistance in reducing potential hazards. Mayor Heinsheimer suggested the Wildlife Committee work with the Fire Department to identify areas of concern. Councilwoman Swanson suggested also involving members of the Caballeros to ride the trails with Fire Department personnel to assist in pointing out specific hazards. Mayor Heinsheimer agreed to write the Caballeros on this matter. PUBLIC HEARINGS AN ORDINANCE OF THE CITY OF ROLLING HILLS RELATING TO VESTING TENTATIVE MAPS, AMENDING THE SUBDIVISION ORDINANCE AND AMENDING THE ROLLING HILLS MUNICIPAL CODE. The Interim City Manager explained this proposed ordinance would have no effect on Rolling Hills but was needed to bring the city into compliance with state requirements. Councilwoman Leeuwenburgh moved the ordinance be adopted without reading in full. The motion was seconded by Councilwoman Swanson and carried unanimously. AN ORDINANCE OF THE CITY OF ROLLING HILLS AMENDING THE ZONING ORDINANCE AND SUBDIVISION ORDINANCE RELATIVE TO SITING OF HAZARDOUS WASTE FACILITIES AND AMENDING THE ROLLING HILLS MUNICIPAL CODE. Mr. McDuffie advised that the Planning Commission has reviewed this proposed ordinance and recommended its adoption to bring the city into compliance with the Los Angeles County Hazardous Waste Management Plan. Councilman Pernell moved the ordinance be adopted without reading in full. The motion was seconded by Councilwoman Murdock and carried unanimously. OPEN AGENDA Mr. Herb Agid, homeowner at 160 Portuguese Bend, asked that the Council take action to resolve the problem of three eyesore areas near his home. Mayor Heinsheimer said he would discuss the matter with the Community Association and will report back to the Council and Mr. Agid. Mr. Don Gales, Vice Chairman of the Rolling Hills Wildlife Preservation Committee, asked that notices of vacancies on the Committee be published in the Rolling Hills Newsletter. The Committee also requested that the City Council provide $1500 and space at three sites for guzzlers (man-made ponds providing water for wildlife). Mayor Heinsheimer asked the Committee to submit the request as an agenda item and Councilman Pernell agreed to work with them on the matter. Mr. Gales also expressed concern about the possibility of the Fire Department requiring clearance of brush 200 feet from structures, and the effect this would have on foxes and other animals living in the canyons. Mayor Heinsheimer suggested the Committee work with the Fire Department in this regard. -2- OLD BUSINESS AN ORDINANCE OF THE CITY OF ROLLING HILLS• PROHIBITING THE RIDING OF BICYCLES ON EQUESTRIAN TRAILS, AMENDING THE ROLLING HILLS MUNICIPAL CODE AND DECLARING THE URGENCY THEREOF. Interim City Manager McDuffie reported that the Caballeros and the Traffic Commission have endorsed this ordinance: The version now presented to Council contains an urgency clause (Section 3), which permits the ordinance to be adopted immediately, on first reading. At the neat Council meeting the version without the urgency clause can be adopted and will supersede this version. In the open hearing Mr. John Short, resident of Newbury Park and member of Concerned Off -Road Bicyclists Association (CORBA), stated that he has ridden the Peninsula trails for several years and has never had a negative encounter with an equestrian. He said that CORBA works with equestrian groups and bicyclists to teach them proper trail etiquette, and requested that at least one trail remain open from the north to the south side of the Peninsula so that bicyclists .can avoid automobile traffic on the highways. Mayor Heinsheimer responded that modifications could be made to the ordinance in the future based on information CORBA submits to the Council, which will be shared with the Community Association and the Caballeros. There was no further discussion from the public. Councilwoman Murdock moved the urgency ordinance be adopted as well as first reading on the non -urgency ordinance. Councilwoman Swanson seconded the motion and it was passed unanimously. MATTERS FROM MEMBERS OF THE CITY COUNCIL Councilwoman Leeuwenburgh reported on the Traffic Commission meeting of July 18, 1990. The Commission will meet August 10 to discuss the EIR on Miraleste High School and will make recommendations on changes in traffic which might be necessitated by the closure of the school. Additionally, the Commission will recommend purchase of a radar speed unit and funding for uniforms for the motorcycle sheriffs. Recycling recommendations were also discussed at the meeting and will be voted upon at the August 10 meeting. Councilman Pernell was excused from the meeting at 8:30 p.m. for personal reasons. Councilwoman Murdock advised that the Chairman of the Landscape Committee is looking into further bids for the work and will report back to the Council. The Zelke concerns are also being investigated. Councilwoman Swanson reiterated her concern regarding obstruction of the natural watercourse in canyons. The Interim City Manager promised to check with the City Attorney the next day and see that the letter to the property owner and his realtor is sent out immediately. Councilwoman Leeuwenburgh inquired about mosquito abatement following a telephone call from the Daily Breeze on a mosquito problem in Rolling Hills. City Manager McDuffie agreed to look into it. Councilwoman Swanson urged staff to investigate the status of the Juge property, which is still not fenced and is unsightly and a safety hazard. She said several other properties are also in deplorable state, with building materials, plant materials and other matter in view, and asked about the possibility of an ordinance enforcing cleanup. Mayor Heinsheimer suggested waiting until the new staff is in place and asking the new City Manager to study and report back on what other -3- cities do in this regard. Interim City Manager McDuffie said he would gather together some model ordinances to begin the process. MATTERS FROM STAFF Mr. McDuffie provided information regarding the Integrated Waste Management and Recycling Joint Powers Agreement. The questions and comments of City Attorney Michael Jenkins were attached, and Councilmembers were asked to give their comments to staff at their convenience. Staff recently attended a meeting of "Area G" cities to discuss the "Disaster Response '90" exercise on October '29, 1990. They indicated' that the City of Rolling Hills will participate in the exercise. Council has submitted their comments on the proposed Mixed Use Structures code amendment. Councilwoman Murdock requested, that the gist of the comments be transmitted to the Planning Commission for their discussion. Council approved clarification of the allocation of CDBG funds to the City of Lomita. The approved allocation was $9682 for the year 1989/90 and $9272 for the year 1990/91. The Interim City Manager advised that the CDBG Cooperation Agreement with the County of Los Angeles is required in order to allow for allocation of CDBG funds to the City of Lomita. Councilwoman Swanson moved the agreement be approved, Councilwoman Leeuwenburgh seconded, and it was passed unanimously. MATTERS FROM THE CITY ATTORNEY A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS ESTABLISHING FEES FOR PLANNING AND ZONING SERVICES AND REPEALING RESOLUTION 614. Attorney Ennis advised that there is a current request for the View Impairment process and a fee needs to be set. It is likely that five to ten hours of mediation service would be required at a cost of $500 to $1,000 or more. He asked if the City would assume some of the cost in order to make the process relatively affordable. The City Attorney's office has contacted two prospective mediators, both well qualified in the field of mediation. One is a Rolling Hills resident. After discussion it was decided that Council preferred to hire a non -City resident and Mr. Anthony Mohr was agreed upon. Councilwoman Swanson urged making the fee low to encourage use of the service. The resolution can be changed again later if a higher fee is desired. After discussion, Councilwoman Swanson moved the fee be set at $200. Councilwoman Murdock seconded the motion and it passed unanimously. ADJOURNMENT Mayor Heinsheimer adjourned the meeting at 8:55 p.m. to Monday, July 30, 1990, at 6:00 p.m. for the purpose of interviewing candidates for City Manager.
