MINUTES OF A
REGULAR MEETING OF THE CITY COUNCIL OF THE
CITY OF ROLLING HILLS, CALIFORNIA
November 12, 1990
A regular meeting of the City Council of the City of Rolling
Hills was called to order by Mayor Pro Tem Pernell at 7:30 p.m. on
Monday, November 12, 1990 in the City Council Chambers at the City
Hall/Administration Building, 2 Portuguese Bend Road, Rolling
Hills, California.

Councilwoman Swanson moved approval of all items on the
Consent Calendar as listed below. The motion was seconded by
Councilwoman Leeuwenburgh and carried unanimously.
a. Minutes of the Adjourned Regular Meeting of October 29, 1990
were approved as submitted.
b. Payment of Bills - Demands Number 3972 through 5013 in the
amount of $36,194.09 were approved for payment from the General
Fund, with the exception of Demand Number 4986 which was voided..
c&d. Minutes of the Traffic Commission meetings of September 21 and
October 19, 1990 were received and filed.
e. Minutes of the Wildlife Preservation Committee meeting of
September 17, 1990 were received and filed.
f. Resolution re: Zonina Case No. 435
Mr. & Mrs. Mike Boyd, 5 Williamsburg Lane, Lot 35-RH; Request
for Variances: to encroach into the front yard setback to
construct a new residence; to encroach into the front yard
setback to construct a retaining wall; request for Site Plan
Review for new residence and stable.
Resolution re: Zonina Case No. 437
Mr. & Mrs. Tony Lin, 10 Portuguese Bend Road, Lot 52-RH;
Request for a Conditional Use Permit to construct and maintain
a paddle tennis court; request for Site Plan Review for a new
residential redevelopment on the site and for a paddle tennis
court.

Resolution re: Zonina Case No. 439
Mr. & Mrs. Ralph Schmoller, 4 Middleridge Lane South; Lot 256• -
UR; request for a variance to encroach into the side yard
setback in order to construct a swimming pool and spa; request
for Site Plan Review to determine the compatibility of the
pool and spa with the site.
Resolution re: Zonina Case No. 440
Dr. Stephen Taus, 11 Poppy Trail, Lot 90-B-RH; request for a
Conditional Use Permit for a tennis court; request for Site
Plan Review to determine the compatibility of the proposed
tennis court with the site.
Resolution re: Zonina Case No. 393
Mr. & Mrs. Charles Haueisen, 6 Eastfield Drive, Lot 62 -EF;
request for variance to exceed the 20 percent coverage of a
required side yard setback to construct a driveway; request
for modification of an approved site plan to construct a
detached garage with driveway access and amend Resolution of
Approval accordingly.
PUBLIC HEARINGS
A. Introduction and first reading of the following ordinance:
ORDINANCE NO. 229: AN ORDINANCE OF THE CITY OF ROLLING HILLS
REQUIRING A CONDITIONAL USE PERMIT FOR A DETACHED GARAGE OR
MIXED USE STRUCTURE AND AMENDING THE ROLLING HILLS MUNICIPAL
CODE.
Councilwoman Leeuwenburgh suggested consideration of this
ordinance be held over until the full Council is present. There
was no one present who wished to testify on the matter. At the
direction of the City Council members present, the public hearing
was opened and continued to the November 26 meeting.
OLD BUSINESS
There were no items of old business to consider.
NEW BUSINESS
A. CONSIDERATION OF RECOMMENDATION FROM THE TRAFFIC COMMISSION
RELATIVE TO LOCATION OF THE RECYCLING CONTAINERS ADJACENT TO
THE CITY ADMINISTRATION FACILITY PARKING LOT.
Councilwoman Leeuwenburgh reported that the Traffic Commission
is recommending that seven 100 -gallon recycling containers be
placed in back of City Hall for recycling purposes. Mr. Chip
Scholz of Browning-Ferris Industries said this program will be a
good gauge of the community's willingness to recycle. He stated
that three or four of the containers would be designated for
newspapers and the remainder for mixed recyclable materials (glass,
metal and plastic. The trucks currently used in Rolling Hills _
Estates will stop by at the end of their runs to empty the
containers, as needed. City Manager Nealis added that this service
is being provided at no cost to the City and that B.F.I. will be
responsible for maintaining the location.
Mayor Pro Tem Pernell said that many residents are currently
separating their recyclable materials and might not like to see
them co -mingled after going to the trouble of sorting them. He
suggested that aluminum cans be put in a separate container from

-the other co -mingled materials. Mr. Scholz stated that the
containers will be color coded and signed to indicate what
materials they are to contain. He said that B.F.I. will provide
any technical materials and information the City would like for
its Newsletter or other publications.
Councilwoman Leeuwenburgh added that two parking places will
have to be designated as "Parking for Recycling" adjacent to the
bins. The Traffic Engineer will make a recommendation as to their
exact placement.
Councilmembers thanked Mr. Scholz for his cooperation and
expressed their eagerness to make. this a successful program. It
was agreed that the program will begin on Monday, November 26, and
information will be disseminated to residents in the November 21
Newsletter.
B. CONSIDERATION OF PARTICIPATION IN THE HOLIDAY DRIVING UNDER
THE INFLUENCE (DUI) ENFORCEMENT PROGRAM.
City Manager Nea1is reported that the Sheriff's Department has
requested that the City of Rolling Hills participate with the other
Peninsula cities in the DUI Enforcement Program to be operated on
eight nights between December 21 and December 30, 1990. The cost
to the City will be ten percent of the total, not to exceed
$356.60. Lt. Mike Bauer of the Sheriff's Department explained the
program, indicating a total of 13 man -shifts will be used.
It was moved by Councilwoman Swanson and seconded by
Councilwoman Leeuwenburgh that the City of Rolling Hills
participate in the Holiday DUI Program. The motion was passed
without exception.
OPEN AGENDA
Mr. Bill Peters of #11 Johns Canyon Road updated
Councilmembers on the status of the Johns Canyon sewer project.
Four of the seven homeowners in the area have negotiated a contract
with Dalcin Cummings Associates and have paid for the engineering
of the sewer. They are now involved in the County process and have
arranged with the Community Association to use the Association
easement. They have obtained three bids for the construction,
which ranged from $64,370 to $108,266, and are planning to use
Lawson Construction Company, Inc.
The participating homeowners have contacted the Community
Association attorney regarding how to prevent the homeowners who
did not share in the construction costs from connecting in to the
line, or how to force them to pay one-seventh of the total cost if
they do wish to be connected. The Association attorney was not
able to provide an answer, and Mr. Peters. asked if the City
Attorney could help. Councilmembers advised that this issue could
be presented to the City Attorney through the City Manager.
Mr. Peters suggested that after the sewer is built and paid
for, the residents could ask the City to create a sewer district
and incorporate the Johns Canyon sewer with no liabilities. It
could then be bonded and the residents could have their investment
returned.
Mayor Pro Tem Pernell commended the group on their progress
and said the City is willing to cooperate in any way it can.
Councilwoman Swanu°Dn suggested Mr. Peters keep notes for the
benefit of other residents who might have similar projects in the
future.

MATTERS FROM MEMBERS OF THE CITY COUNCIL
Councilwoman Swanson brought up the city ordinance which
allows five years for completion of construction projects as long
as some work is proceeding. She asked that staff research the
matter and come back with recommendations as to a more stringent
ordinance, perhaps with a "not to exceed" time, a period shorter
than five years under certain circumstances, and other options. -
Councilwoman Swanson also discussed the requirement that 200
square feet on each property be set aside for a barn. She said
that with some of the very large residences that have been built
in Rolling Hills over the last several years, perhaps the number
of square feet required for barns should be examined. Councilwoman
Leeuwenburgh stated that the Planning Commission is currently
looking into this matter.
Councilwoman Leeuwenburgh reported that public comment on the
Miraleste High School EIR is scheduled for Tuesday evening,
November 13. She suggested staff be directed to write a letter
expressing concerns which were not addressed in the draft or final
EIR. Councilwoman Leeuwenburgh agreed to work with City Manager
Nealis to prepare the letter.
Councilwoman Leeuwenburgh also reported that the December 10
Holiday Party arrangements are proceeding and the invitations are
expected to be mailed out on November 13. As the party is
scheduled on a regular Council meeting night, it is expected that
the meeting will be adjourned to December 17.
Mayor Pro Tem Pernell reported* on the remodeling being
considered for the maintenance building. A definitive plan has not
been arrived at yet. The preliminary plan requires encroachment
into the easement belonging to Rolling Hills Estates, primarily
consisting of some parking spaces on the north side of the
facility. The Mayor of Rolling Hills Estates has indicated
willingness to consider this encroachment but it would have to -go
through their planning process. Mayor Pro Tem Pernell said it was
suggested by Peggy Minor, Association Manager, that an area could
be blacktopped and used as temporary parking for the large trucks
doing business in Rolling Hills which are not allowed on the City
streets, as an incentive to Rolling Hills Estates.
MATTERS FROM STAFF
City Manager Nealis reported the City has received an
invitation from the Rolling Hills Board of Realtors to attend their
installation luncheon on Wednesday, December 10. Additionally, he
requested approval for Diane Sawyer to attend the League of
California Cities "City Clerks New Law and Election Seminar" in
Costa Mesa on December 5 through 7, 1990 at a cost of $155. There
being no objection, the cost of the seminar was approved.
CLOSED SESSION
The meeting was adjourned at 8:15 p.m. to a closed session for
the purpose of discussing personnel matters and pending litigation.

MEETING RECONVENED
The meeting was reconvened at 8:50 p.m. Mayor Pro Tem Pernell
directed City Manager Nealis to verify that Robert Lamb, a
contractor doing work for the City, is covered by appropriate
liability insurance.
ADJOURNMENT
Mayor Pro Tem Pernell adjourned the meeting at 8:52 p.m. to
Monday, November 26, 1990 at 7:30 p.m.
